WHEREAS, the Common Council previously approved planned developments for
construction of various automobile dealerships as part of the Bergstrom Import Super
Center Automobile Sales Complex in the 3000 block of South Washburn Street; and
WHEREAS, the owner desires to amend the previously approved planned
developments by:
1) Removing the existing 45 ft. tall Import Super Center sign at the Toyota
dealership at 3155 South Washburn Street.
2) Removing the existing 30 ft. tall NextMedia billboard at the Subaru dealership at
3325 South Washburn Street.
3) Installing a new 48 ft. tall Import Super Center sign and electronic message
center/digital video board at the Used Car dealership at 3365 South Wasbhurn
Street.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of
Oshkosh that the previously approved planned development to remove existing ground
identification signs at 3155 South Washburn Street and 3325 South Washburn Street,
as noted above, and install a new 48 ft. tall Import Super Center sign and electronic
message center/digital video board at 3365 South Washburn Street, per the attached, is
hereby approved with the following conditions:
1) Base standard modification to allow the proposed electronic message
center/digital video board to be 1,165 sq. ft. in area (both sides).
2) Deed restriction not permitting any additional electronic message centers on the
properties comprising the Bergstrom Import Super Center.
3) No off-site display of messages, except community service/emergency
announcements.

BACKGROUND
The subject site, referred to as the Bergstrom Import Super Center, consists of five individual parcels of land
containing six automobile dealerships on approximately 30 acres of land with over 1,500 feet of South
Washburn Street frontage. It is located on the 3000 block of South Washburn Street approximately one-third
mile south of West Waukau Avenue. The underlying zoning for the site(s) is M-1 Light Industrial District but
all properties are located within the Highway 41 Corridor Overlay District and all have Planned Development
Overlay designation as well. The Hawthorne Inn and Suites Hotel/La Sure's Banquet Hall are to the north,
vacant/undeveloped land is to the west and south and USH 41 right-of-way is to the east.
ANALYSIS
The applicant is proposing to alter the signage plans by removing the existing sign and electronic message
center at 3155 S. Washburn Street as well as the existing billboard sign at 3325 S. Washburn Street and
installing a new 60 foot tall sign at 3365 S. Washburn Street. The new sign will consist of 963 square feet of
sign area and 1,164 square feet of electronic message center. The end result will be the number of overall signs
will be reduced by one and the general sign area will be reduced however the electronic message center sign
area will be increased by 969 square feet. The request meets code requirements for allowable general signage
area but exceeds the allowable electronic message center signage by 164 square feet. The applicant feels the
base standard modification should be granted as primary visibility for their signage is from the highway and the
newly constructed collision barrier wall is limiting visibility. They also feel their situation is unique as there are
six individual dealerships with over 30 acres of area over a 1/4 mile of street frontage. Staff agrees that the base
standard modification should be granted providing no additional electronic message centers are permitted on the
properties and no off-site display of messages other than community service/emergency announcements.
FISCAL IMPACT
None anticipated.
RECOMMENDATION
The Plan Commission approved of this request at its May 1, 2012 meeting.

Actions Requested:
The applicant is requesting an amendment to the Planned Development District and a base standard
modification to the signage code to allow the installation of a digital electronic message center/video
board at 3365 South Washburn Street, the southern property included in the 5 lot/30 acre Bergstrom
Import Super Center Automobile Sales Complex.
Applicable Ordinance Provisions:
The Zoning Ordinance establishes criteria and guidelines for the Planned Development (PD) Overlay
district in Section 30-33(A)(1).
Property Location and Background Information:
The subject site, referred to as the Bergstrom Import Super Center, consists of five individual parcels
of land containing six automobile dealerships on approximately 30 acres of land with over 1,500 feet

ANALYSIS
The applicant is proposing to alter the signage plans and therefore the site plans for the five properties
comprising the Bergstrom Import Super Center Complex (3135/3155/3265-3285/3325/3365 South
Washburn Street)by:
A. Removing the existing 45 ft tall Import Super Center sign consisting of 720 sq ft of sign area
and 195 sq ft of electronic message center at the Toyota dealership on 3155 S Washburn Street;
B. Removing an existing 30 ft tall NextMedia billboard consisting of 1,344 sq ft of sign area at the
Subaru dealership at 3325 South Washburn Street; and
C. Installing a new 60 ft tall Import Super Center sign consisting of 963 sq ft of sign area and
1,164 sq ft of electronic message center(digital video board) at the Used Car dealership at 3365
South Washburn Street.

To summarize:
A. The number of overall signs at the Super Center would be reduced by one from six to five (not
including a future used car sales/auto body sign);
B. A reduction in general sign area (non electronic) by 1,501 square feet from 3,466 square feet to
1,965 square feet; and
C. An increase in electronic message center sign area by 969 square feet.
Any individual property within the M-1PD/HWY 41 District is permitted 800 square feet of area and
up to 200 square feet of electronic message center allowing a combined total square footage of 4,800
square feet of general sign area and 1,000 square feet of electronic message center signage. The
applicant's request meets code requirements for the allowable general signage area but exceeds the
allowable electronic message center signage by 164 square feet.
The petitioner had originally proposed the electronic message center at 1,344 square feet(14'x 48')
and be placed at the top of the sign placing it at 60 feet high but revised the submittal by reducing the
sign area to 1,165 square feet (12'7" x 46'3"), dropping the height to 48 feet high and incorporating
architectural accents tying the message center into the sign design. If taken as a single entity, the
applicants make the argument in their application that if the automobile dealership Super Center were
situated on a single parcel as it functions and has been considered by the City in the past, that the base
standard modification would be minimal, especially in light of the fact that there are six individual
dealerships on the five parcels. They further state that:

A. The location of the property is such that the primary visibility is from the highway and that the
increased level of signage is necessary as the auto mall is a destination based business and must
be seen;
B. Visibility is limited due to the newly constructed collision barrier wall placed between the north
and south bound traffic lanes;
C. The Super Center is unique in that is extremely large with over 30 acres of area with over a '/4
mile of street frontage; and
D. There are similar signs located to the north between County Road GG & County Road G in the
Town of Vinland and to the south near Ripple Avenue in the Town of Nekimi.
During staff review, concern was expressed regarding the potential impact of the digital signage on the
residential uses to the west and the precedent that could be set by allowing a larger area of electronic
message center sign area within the Highway 41 Corridor. However, when reviewing the individual
planned developments in the past, the City has considered the individual properties as a single campus
entity and in that vein has granted base standard modifications to dimensional regulations for such
items as side yard setbacks and location of the existing multiple tenant Bergstrom Import Super Center
sign.
Staff believes this approach remains valid and agrees with the applicant that the location of the Super
Center along the densely commercial highway minimizes the potential impacts to neighboring uses or
at least gives reason for them. Staff confirms the applicant's statement that if each of the five
individual properties were permitted an individual sign as allowed by code, 1,000 square feet of
electronic message center area would be allowed via five individual signs that could be at 60 feet in
height where the proposed electronic message center component is proposed at 48' in height. Lastly,
staff feels the proposed electronic message center signage is offset by the removal and reduction in
general sign area of the 1,344 square foot billboard and the 195 square foot electronic message center
sign area currently located on the Import Super Center campus.
RECOMMENDATION/CONDITIONS
Staff recommends a finding that the proposed amendment to the Planned Development District is
approved with the following conditions:
1) Base standard modification to allow the proposed electronic message center/digital video
board to be 1,164 square feet in area (both sides).
2) Deed restriction not permitting any additional electronic message centers on the properties
comprising the Bergstrom Import Super Center.
3) No off-site display of messages, except community service/emergency announcements.
The Plan Commission approved of the planned development amendment as requested with conditions
noted. The following is the Plan Commission's discussion on this item.
Mr. Burich presented the item and reviewed the site and surrounding area as well as the zoning and
land use in said area. He reviewed the multiple dealerships on the site as well as the digital signage
proposed. He stated that the proposed digital sign exceeded the amount of allowable square footage
for a single development however since there are six individual dealerships on the five parcels, if
considered as a single entity, the base standard modification would be minimal. He also reviewed
examples of what the site could look like if each dealership had its own individual signage. He

reviewed the existing sign inventory and the two signs that would be removed with the addition of the
new digital sign and the conditions placed on this request.
John Hogerty, general counsel for Bergstroms, stated that the proposed digital sign was a necessary
component to the auto mall and was present to answer any questions the Commission may have.
There was no discussion on this item.
Motion by Vajgrt to approve the development plan amendment for new digital signage at 3155-
3365 South Washburn Street with the following conditions:
1) Base standard modification to allow the proposed electronic message center/digital video
board to be 1,164 square feet in area (both sides).
2) Deed restriction not permitting any additional electronic message centers on the properties
comprising the Bergstrom Import Super Center.
3) No off-site display of messages, except community service/emergency announcements.

I. Summary: Bergstrom is requesting a Base Standard Modification to allow a 1,344 sq. ft.
electronic message video board("EMU") at its Exit 116 Automall (5 automotive brands in 6
buildings encompassing over 100,000 sq. ft. on 30 acres of land). (See Exhibit A, Site Plan and
Exhibit B,Proposed EMU.) Bergstrom will take down an existing 1,344 sq. ft. for all sides
billboard and a 45-foot high, 720 sq. ft. sign with an EMU. Our goal is a professional, cohesive
landmark development signaling the southern bookend of the Fox Valley.
II. Existing Conditions:
A. Property is zoned M-1PD.
B. The property consists of six automotive dealership buildings encompassing over 100,000 sq. ft.
situated on 30 acres of land.
C. The Automall has frontage on S. Washburn Street and the U.S.Hwy 41 corridor: each property
is allowed one ground sign with a maximum of 60 feet in height,maximum of 800 sq. ft. for all
sides,and one EMU with a maximum of 200 sq. ft. for all sides.
D. The total square footage of signage at the six developed properties at this Automall is as
follows:
1. Combined total square footage of existing ground signs of 2,122 sq. ft. for all sides.
2. Combined total square footage of existing message center of 195 sq. ft. for all sides.
3. Combined total square footage of existing NextMedia Billboard of 1,344 sq. ft. for all
sides.
4. All brand signs are 30 feet high.
5. See Exhibit C for pictures of existing signs.
Summary by definition of allowable square footage from existing sign regulations:

N. Background of Digital Electronic Message Center Signs:
A. Digital billboards display static messages that resemble standard painted/printed billboards
when viewed. Digital technology is a means for changing static copy.
B. OAAA Code of Industry Practices Standards provides that digital billboards will not feature
animation, flashing lights, scrolling,or full motion video.

Digital Billboard Regulations:
> In 1996,the Federal Highway Administration(FHA)issued a memo opinion allowing
changeable-message billboards if acceptable under state/federal agreements.
➢ Most states, including Wisconsin, allow changeable-message billboards.
> States determine"dwell time"of a display on a digital billboard. Wisconsin regulations allow
changes every eight seconds.
V. Bergstrom Operating Plan:
A. One stationary display changed no earlier than every 10 seconds (8 seconds are allowed).
B. No animation, scrolling,flashing, or full action video will be displayed per OAAA Code.
C. Light output from EMU at brightest daylight hours would be 5400 Nit then begin to
automatically dim down to 900 Nit at total darkness.
D. Use of EMU will be to advertise the Exit 116 Automall. Space will not be sold to third parties.
E. EMU will be made available for Amber Alert notices.
VI. Rationale for Request:
A. The location of this property is such that the primary visibility is from the Hwy 41 corridor.
B. Visibility from the Hwy 41 corridor is imperative as the business plan for the Automall is to
create a destination for shoppers from a 100-mile radius.
C. Visibility of this complex is now limited to traffic headed North by the new collision barrier
wall that has been put in place between the North and South bound traffic flow. (See
Exhibit E.)
D. Bergstrom could request six different EMUs at this site,at 60-feet high.
E. Bergstrom is a unique user with over 100,000 sq. ft. of buildings on 30 acres of land.
F. There are two similar signs nearby—to the South(35 feet high) and North(55 feet high). (See
Exhibit F for map showing locations.)
VII. Summary of proposed request: (See Exhibit G.)
A. Combined total square footage after improvements of existing ground signs is 2,540 of 4,800
sq. ft. allowed.
B. Five brand signs at 30 feet high(vs. 60 feet high allowed).
C. Combined total square footage of EMU is 1,344 of 1,200 sq. ft. allowed(standard size for
