DATE: April 19,2012 RE: Approve Development Plan for Temporary Parking Lot at 3665 South Washburn Street(Plan Commission recommends approval) BACKGROUND The request involves a temporary use of two properties comprising approximately 35 acres of land owned by the petitioner. They are located on the west side of S. Washburn Street, approximately 1,500 feet north of W. Ripple Avenue. The properties contain a par three golf course, mini-golf, a two-family dwelling(former farmhouse)with various accessory buildings and an approximately 50-stall off-street paved parking area. ANALYSIS The petitioner is requesting approval for the continuation of a temporary parking lot at the Sunset Par 3 Golf Course property for the general public for the purpose of three events scheduled at the Ford Festival Grounds. A similar planned development was approved in 2011 for these events including a one year sunset clause and this application is necessary to satisfy said clause. The proposed parking lot will be located entirely on the five acre parcel containing a 50+/- stall paved off-street parking lot,two-family dwelling, driving range, and various accessory structures. In addition to the paved parking lot,the petitioner proposes to utilize the driving range as unpaved parking with an estimated 150 to 200 vehicles occupying the area. Vehicles will not be allowed within the 75-foot setback area of the navigable stream along the north lot line unless documentation is provided that this stream is no longer deemed navigable by the DNR and the parking lot will have use of the existing lighting on the driving range. Access to Ford Festival Grounds will be by use of the terrace area on the west side of S. Washburn Street with ingress and egress of vehicles from the lot being consistent with traffic movement on S. Washburn Street which becomes one-way during the event. The Police, Fire, Public Works, and Transportation Departments are working together to develop a strategy to increase separation of pedestrian and vehicular traffic but have not finalized a concept at this time. The Police Department is requesting that the applicant provide temporary lighting at the southeast corner of the property where pedestrians will be entering and exiting the property this year. No overnight camping will be permitted. FISCAL IMPACT None anticipated. RECOMMENDATION The Plan Commission approved of this request at its April 17,2012 meeting. WASHBURN STREET (SUNSET PAR 3 GOLF COURSE) Plan Commission meeting of April 17, 2012 GENERAL INFORMATION Petitioner/Owner: Robert Albright,Northern Real Estate Investments, LLC Action(s) Requested: The petitioner is requesting Development Plan approval for continuation of a temporary parking lot located at Sunset Par 3 Golf Course located at 3665 S. Washburn Street. The parking lot is proposed to be available for compensated parking by the general public for the three events scheduled in 2012 at the Ford Festival Grounds. A similar Planned Development for parking during the Country U.S.A. event was granted in April 2010, with conditions including a one year sunset clause. The Planned Development was reapproved in April of 2011 to satisfy the sunset clause as well as to expand the request to include Rock USA and Waupaca Boatride Volleyball Tournament, scheduled in 2011 in addition to a sunset clause. This Planned Development request is necessary to satisfy the 2011 sunset clause and add a condition requiring pedestrian lighting at the south side of the property along S. Washburn Street. Applicable Ordinance Provisions: Parking lots are permitted by right in the M-1 Zoning District. The Zoning Ordinance establishes criteria and guidelines for the establishment of a PD overlay district in Section 30-33 (A). The site plan shows the proposed parking lot to be located entirely on the five acre parcel containing a 50+/- stall paved off-street parking lot, two-family dwelling, driving range, and various accessory structures. In addition to the paved parking lot, the petitioner proposes to utilize the driving range as unpaved parking. Although the petitioner did not indicate the number of vehicles proposed to park on the driving range, staff estimates 150 to 200 vehicles could potentially occupy the area. Since the proposed parking area is unimproved, a base standard modification is required to allow the use of grass as a parking surface, which staff is supporting. A navigable stream is located along the north lot line of the five acre parcel. Shoreland zoning requires a minimum of a 75-foot setback for any structure from the navigable stream; therefore staff is placing a condition that no vehicles be parked closer than 75 feet from the edge of the navigable stream. The temporary parking lot will utilize the existing fixtures used for the driving range. Staff believes the lighting is an appropriate amenity as it adds security and safety for event goers/parkers. In addition, the applicant has indicated that an attendant(s) will be on site at all times to provide information, direct traffic and provide additional security. Visitors using the parking lot will access Ford Festival Grounds by use of the "terrace" area on the west side of S. Washburn Street. The terrace area provides approximately 40 to 45 feet of walking area from the edge of the road to the right-of-way line. The distance from the parking lot to the main entrance of Ford Festival Park is approximately 3,800 feet or 2/3 of a mile. Police and Fire Departments have expressed concerns regarding the safety of pedestrian traffic along the frontage roads from satellite parking areas as there are currently no sidewalks or dedicated pedestrian ways. The Police and Fire Departments, the Department of Public Works and the Transportation Department are working together to develop a strategy to increase separation of pedestrian and vehicular traffic on the frontage roads but have not finalized a concept at this time. Staff understands there is a need for parking for those wanting to attend events at the Ford Festival Park including Country U.S.A. (June 21-25), Waupaca Boatride Volleyball Tournament (July 6- 10) and Rock U.S.A. (July 14-16). Parking is at a premium as the Country U.S.A. music celebration has historically drawn a large regional crowd and it is assumed the other two events will as well. The petitioner states that business at the golf course drops considerably because of the traffic congestion brought about by Country U.S.A. and is attempting to recoup some of the lost revenue by providing parking for visitors. This request is similar to temporary unimproved parking lots created for the Experimental Aircraft Association's AirVenture. The main difference is that the subject site is located within a Planned Development District requiring Plan Commission review and Common Council approval per code, whereas other temporary parking lots fall under staff review only. Item-S Washburn CUP/PD TempPLot 2 The Oshkosh Police Department has requested that the applicant provide at least one temporary light stand device to provide lighting for pedestrians and to increase their visibility to vehicular traffic. The lighting shall be located near the southeast corner of the property where pedestrians will be entering and exiting the property. Staff has spoken to the applicant about providing the temporary lighting and does not have an issue with the request. No other concerns from the Fire Department, Police Department, the Department of Public Works, nor Transportation Department were raised at the interdepartmental review meeting other than those addressed in this staff report. RECOMMENDATION/CONDITIONS Staff recommends approval of the conditional use permit/development plan as proposed with the following conditions: 1. Base standard modification for the use of grass as a parking surface. 2. Attendant is on-site while any vehicles are parked there. 3. Ingress and egress traffic movements will be coordinated and consistent with traffic patterns on S. Washburn Street before, during and after events. 4. No parking permitted within 75 feet of navigable stream on the north side of the five acre parcel. 5. Applicant provides temporary lighting located at the southeast corner of the property as approved by the Oshkosh Police Department. The Plan Commission approved of the conditional use permit/development plan as requested with conditions noted. The following is the Plan Commission's discussion on this item. Mr. Buck presented the item and reviewed the site and surrounding area as well as the site plan for the temporary parking lot. He explained that this request was a renewal from 2010 and 2011 with the only proposed change being the addition of temporary lighting at the southeast corner of the property located by the entrance at the request of the Police Department. He reviewed the conditions recommended for the request. Ms. Propp questioned if the conditional use permit for the events would be coming back before the Commission to address the strategy to increase separation of pedestrian and vehicular traffic. Mr. Buck responded that it may come back for review however the Police Department is currently working with the petitioner at this point and if significant changes are made, the request would have to come back through the process for review and approval. Mr. Bunch added that the City is looking at how to best accommodate pedestrian needs and if it does not require review this year, it would be coming back to renew the conditional use permit in the future as the conditional use permit expires in the next few years. Mr. Hinz inquired if the satellite parking lots in the area would create issues with the traffic movements that are restricted on Washburn Street during these events. Mr. Buck indicated that the Police Department coordinates traffic movements during these events and they would be working with operators of the satellite parking lots as well as the petitioner to ensure the events take place as safely and smoothly as possible. During the Country USA Event, the golf course's income decreases immensely due to traffic passing Par 3 traveling directly to the event. By applying for the Conditional Use Permit we are trying to recapture a portion of the lost income. We feel the blacktopped driveway and lighted parking area might be inviting to event goers. The walk to and from the event would involve using the ditch well off the road and away from the traffic. We will install right turn only sign at the driveway to facilitate a smooth flow of traffic.
