HomeMy WebLinkAbout17. 12-186 APRIL 24, 2012 12-186 RESOLUTION (CARRIED___7-0_____LOST________LAID OVER________WITHDRAWN________) PURPOSE: APPROVE REVISED AGREEMENT WITH WISCONSIN DEPARTMENT OF TRANSPORTATION TO BE REIMBURSED FOR UTILITY RELOCATION REQUIRED FOR RECONSTRUCTION OF US HIGHWAY 41: OSHKOSH AVENUE SANITARY SEWER (Total Cost : $129,760.00 / City Share $12,976.00) INITIATED BY: DEPARTMENT OF PUBLIC WORKS BE IT RESOLVED by the Common Council of the City of Oshkosh that the attached Agreement with the Wisconsin Department of Transportation to be reimbursed for Utility Relocation Required for the Reconstruction of US Highway 41 for the Oshkosh Avenue Sanitary Sewer, is hereby approved and the proper City officials are hereby authorized to execute and deliver the agreement in substantially the same form as attached hereto, any changes in the execution copy being deemed approved by their respective signatures, and said City officials are authorized and directed to take those steps necessary to implement the terms and conditions of the Agreement. Gohde, Assistant Director of Public Works DATE: April 19, 2012 RE: Approval of Revised Agreement with Wisconsin Department of Transportation for Utility Relocation Required for Reconstruction of US Highway 41 —Oshkosh Avenue Sanitary Sewer(Revised Agreement Increase: $129,760.00, City Share: $12,976.00) BACKGROUND, The Wisconsin Department of Transportation (WDOT) is reconstructing the USH 41 and STH 21 interchange. Due to elevation changes of STH 21 including significant undercutting depth and stone backfill needed to support the pavement, the existing sanitary sewer and laterals will be in conflict with the new road construction. The sanitary sewer main and laterals need to be lowered to avoid damage and/or failure. The age and condition of the main and laterals also warrant replacement. ANALYSIS The WDOT will fund 90%of the costs associated with relocating the sanitary sewer and laterals. The City has received quotes for the work. The estimated cost to complete this work, including engineering services is $129,760.00. The total estimated cost of the additional work to the City is $12,976.00. This work is being added to an existing utility agreement the City has with the WDOT. The total value of the agreement is now$543,040.62. FISCAL IMPACT Funding was not included in the 2012 Capital Improvement Program for this work. Adequate funding is available in the Sanitary Sewer section of the CIP from other projects coming in under budget. Approximately $2,500 of the City's $12,976 share will be recouped through special assessment to adjoining owners for their new laterals. The acceptance of this order by the Utility and its approval by the Wisconsin Department of Transportation shall constitute a mutual agreement as a part of the original agreement binding upon both parties in the same manner as though the essence of the order had originally been in the agreement.
