PURPOSE: GRANT PRIVILEGE IN STREET TO UW-OSHKOSH ETAL
TO INSTALL UNDERGROUND CONDUIT IN PEARL AVENUE
RIGHT-OF-WAY, WEST OF OSCEOLA STREET
INITIATED BY: UNIVERSITY OF WISCONSIN –OSHKOSH
PLAN COMMISSION RECOMMENDATION: Approved w/conditions
WHEREAS, the University of Wisconsin-Oshkosh requests the Common Council
grant a privilege in street to the University and its contractors as may be required to
relocate existing conduit from the Osceola Street right-of-way and install new
underground conduit in Pearl Avenue, west of Osceola Street; and
WHEREAS, Section 66.0425, Wis. Stats., provides for the granting of a privilege
in a right-of-way; and
WHEREAS, the Plan Commission has approved of this request with conditions.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of
Oshkosh that the proper City officials are hereby authorized and directed to grant the
University of Wisconsin-Oshkosh and its contractors, a privilege in street to relocate
existing conduit from the Osceola Street right-of-way and install new underground
conduit in Pearl Avenue, west of Osceola Street, per the attached, contingent upon the
following:
1) Placement of the underground conduit shall be coordinated with the Department
of Public Works to prevent conflicts with existing underground utilities.
2) The underground conduit be installed in a manner that is approved by the
Department of Public Works with no modification or changes in construction
procedure without prior approval by the City.
3) If no longer needed, the underground conduit be properly abandoned and
removed in accordance with City standards and under the direction of the
Department of Public Works.
4) Any problem which may arise as a result of the placement of the underground
conduit be the responsibility of the petitioner/contractors to correct in coordination
with the Department of Public Works.

5) All appropriate permits be obtained prior to the start of placement of the
underground conduit.
6) The underground conduit be modified or removed immediately upon the request
of the City.
7) The petitioner and contractors secure and submit to the City Clerk a separate
insurance policy which names the City as an additional insured with a minimum
coverage of$200,000 per person and $500,000 in general aggregate.
8) It is the responsibility of the petitioner/owner to file in a timely manner a new
insurance certificate with the City Clerk upon expiration of an existing certificate.
Failure to do so will result in the revocation of the privilege in street upon 10 days
notice.
9) The petitioner/owner and contractors execute hold harmless agreements with the
City.
10) The facility be part of and documented with Digger's Hotline system.

BACKGROUND
The subject site lies within the University of Wisconsin Oshkosh Campus with exclusive University
facilities. To the north are the University's tennis courts, athletic fields and parking ramp, River
Commons to the east, surface parking to the south and the Wellness Center to the west. University of
Wisconsin Foundation, Inc. requests a privilege in the street permit to install underground conduit
across Pearl Avenue west of Osceola Street. The conduit will house electric, communication lines and
fiber optic cable.
ANALYSIS
At the request of the Department of Public Works,the University is proposing to relocate a series of
electrical conduits out of the Osceola Street right-of way to complete an Osceola Street Utility Project.
The new conduit will be located on University-owned property north of Osceola Street, running
parallel to the right-of-way. The privilege request is to allow for the conduit to cross Pearl Avenue,
west of Osceola Street to connect to the University's system on the south side of Pearl Avenue. The
Department of Public Works has reviewed and recommends approval of the privilege request with the
final design to be coordinated and approved by the Public Works office to avoid conflicts with existing
underground utilities.
FISCAL IMPACT
None anticipated.
RECOMMENDATION
The Plan Commission approved of this request at its April 3, 2012 meeting.

GENERAL INFORMATION

Action Requested:
University of Wisconsin Foundation, Inc. requests a privilege in the street permit to install
underground conduit across Pearl Avenue west of Osceola Street. The conduit will house electric,
communication lines and fiber optic cable.

Property Location and Type:
The subject site lies within the University of Wisconsin Oshkosh Campus with exclusive
University facilities. To the north are the University's tennis courts, athletic fields and parking

ANALYSIS
At the request of the Department of Public Works,the University is proposing to relocate a series

Project(11-04). The new conduit will be located on University-owned property north of Osceola

RECOMMENDATION/CONDITIONS
Staff recommends approval of the privilege in street request subject to the following conditions:
1. Placement of the underground conduit shall be coordinated with the Department of Public

2. The underground conduit is installed in a manner that is approved by the Department of Public
Works with no modification or changes in construction procedure without prior approval by
the Department of Public Works.

The Plan Commission approved of the privilege in street as requested with conditions noted. The
following is the Plan Commission's discussion on this item.
Mr. Buck presented the item and reviewed the site and surrounding area as well as the zoning
classifications in said area. He stated that the Department of Public Works is requesting the
University relocate a series of electrical conduit out of the Osceola Street right-of-way to complete
an Osceola Street Utility project. The privilege in street is required to allow for the conduit to
cross Pearl Avenue west of Osceola Street. He also reviewed the conditions recommended for this
request which are standard for a privilege in street request.
There was no discussion on this item.
Motion by Thorns to grant the privilege in the street at Pearl Avenue west of Osceola Street
as requested with the following conditions:
1. Placement of the underground conduit shall be coordinated with the Department of Public
Works to prevent conflicts with existing underground utilities.
2. The underground conduit is installed in a manner that is approved by the Department of
Public Works with no modification or changes in construction procedure without prior
approval by the Department of Public Works.
3. If no longer needed, the underground conduit be properly abandoned and removed in
accordance with City standards and under the direction of the Department of Public Works.

A"Privilege in Street"permit is being applied for by the University of Wisconsin Oshkosh to
facilitate moving of an existing electrical/signal duct bank. The Privilege in the Street permit
would allow the campus to cross Pearl Ave. near the Osceola intersection with 10—4 inch
electrical conduits.
This crossing of Pearl Ave is the result of a request from the City of Oshkosh Public Works
Department to move the University's existing bank of electrical conduits out of the Osceola
Street right of way to allow for the completion of the Osceola Street Utility project#11-04. The
new duct bank will simply replace the existing duct bank which provides electrical and
communication service to the campus's Student Rec and Wellness Center. Also within the duct
bank are several lines containing fiber optic cable that provide the Wisnet communication
backbone for UW-Oshkosh, UW-Fox Valley, Fox Valley Technical College, the cities of
Oshkosh,Appleton, Menasha and Neenah, counties of Winnebago and Outagamie, and Appleton
and Oshkosh School Districts.
The surrounding property is all owned by the University and will not affect any other property
owners. Southwest of the crossing is the UW Oshkosh Student Rec and Wellness Center,
northwest is a campus intramural field, northeast is the UW Oshkosh River Center and southeast
is a campus parking lot. During construction a traffic lane will be maintained to allow the
passing of traffic.
Construction for the duct bank relocation is scheduled to begin in May of 2012 with completion
date of early July 2012. This time schedule will allow the City finish the Osceola Street project
by September 1st, 2012.
