HomeMy WebLinkAboutMinutes BOARD OF APPEALS MINUTES February 8, 2012 PRESENT: Dan Carpenter, Robert Cornell, Janet Duellman, Dennis Penney, Kathryn Larson, Jane Cryan, Robert Krasniewski EXCUSED: none STAFF: Todd Muehrer, Associate Planner/Zoning Administrator; Deborah Foland, Recording Secretary Chairperson Cornell called the meeting to order at 3:30 p.m. Roll call was taken and a quorum declared present. The minutes of December 14, 2011 were approved as presented. (Carpenter/Krasniewski-Penney abstained as he was not present) ITEM I: 2215 OREGON STREET Green Bay Sign & Design-applicant, Coyote of Wisconsin LLC-owner, requests the following variance to permit a double-faced internally illuminated ground mount sign in the front yard setback: Description Code ReferenceMinimum Proposed Front yard setback 30-25(B)(2)(c) 25’ 2’ Mr. Muehrer presented the item and distributed photos of the subject site. The property is zoned C-2 and is rd located on the northwest corner at the intersection of Oregon Street and W. 23 Avenue. The parcel is used by multiple tenants for commercial retail, office space and professional services purposes. The applicant is proposing to construct a double-faced internally illuminated commercial ground sign for identification and way-finding purposes in the southeast corner of the parcel fronting Oregon Street which will intrude 23’ into the required front yard setback area. The subject dental office tenant space is located in the southern-most principal structure and is part of an overall single-story facility built in 1947. The principal structure possesses a substandard front yard setback along Oregon Street making code compliant placement of the ground sign impossible. Proper identification signage is critical for overall public safety on high traffic volume streets and the placement of the structure creates a degree of hardship. A larger wall sign or projecting sign would have limited visibility due to the mature landscaping on the site and the granting of the variance will not result in harm to the public interest. Mary Mettler, Green Bay Sign & Design, 2803 S. Packerland Dr., Green Bay, stated that she conducted a study of the site and the proposed placement of the sign would be out of the vision triangle. There is a canopy over the door; however, it is hidden by trees and due to the sidewalk area, there is not much setback area for signage placement. Mr. Penney questioned how far the sign will be from the sidewalk. Ms. Mettler responded that there is about 11 feet between the sidewalk and building and the sign would be rd about two feet from the sidewalk and 35 feet from the corner of W. 23 Avenue and Oregon Street. Board of Appeals Minutes 1 February 8, 2012 Mr. Krasniewski inquired if the sign would be located south of the entrance to the office. Ms. Mettler responded affirmatively. Mr. Carpenter questioned if there would be any landscaping placed around the base of the sign. Judy Swanson, 2990 Waldwic Lane, indicated that they had not considered it; however, it would be a possibility. Mr. Carpenter then inquired if the City required landscaping at the base of the sign. Mr. Muehrer responded negatively and added that there was not a need for it in this case but Board members could request it. Mr. Carpenter stated that with the existing landscaping on site it probably would not be necessary. rd Mr. Krasniewski voiced his concerns with the utility pole and the evergreen trees on the corner of W. 23 Avenue and Oregon Street impeding the view of oncoming traffic and if the placement of the sign would make visibility of oncoming vehicles more difficult. Mr. Muehrer replied that the evergreens and the utility pole were already impeding the view of traffic on Oregon Street and the addition of the sign would not make the visibility any more difficult than currently exists. Board members briefly discussed the parking areas utilized for the clients of the dental office and determined that the sign placement would not make the intersection any more hazardous as there are multiple other accesses available to the parking areas. Motion by Penney to approve the request for a variance to permit a double-faced internally illuminated ground mount sign with a 2’ front yard setback. Motion carried 5-0. Seconded by Carpenter. Finding of Facts: No harm to public interest. Hardship present due to lack of area for setback. OTHER BUSINESS There being no further business, the meeting adjourned at 3:44 p.m. (Cryan/Carpenter).
