HomeMy WebLinkAbout39. 12-150 R E V I S E D MARCH 27, 2012 12-150 ORDINANCE FIRST READING (CARRIED________ LOST________ LAID OVER________ WITHDRAWN_______) PURPOSE: REPEAL AND RECREATE SOLID WASTE DISPOSAL / SECTION 23-7, STANDARDS OF SERVICE FOR RESIDENTIAL AREAS / SECTION 23-8, POINT OF STORAGE & POINT OF COLLECTION, RELATED TO PLACEMENT FOR COLLECTION / SECTION 23-9, GENERAL REQUIREMENTS, RELATED TO CART & YARD WASTE REQUIREMENTS INITIATED BY: DEPARTMENT OF PUBLIC WORKS A GENERAL ORDINANCE OF THE CITY OF OSHKOSH REPEALING AND RECREATING CHAPTER 23 - SOLID WASTE DISPOSAL, SECTION 23-7 PERTAINING TO STANDARDS OF SERVICE IN RESIDENTIAL AREAS, SECTION 23-8 PERTAINING TO POINT OF STORAGE AND POINT OF COLLECTION, AND SECTION 23-9 PERTAINING TO GENERAL REQUIREMENTS The Common Council of the City of Oshkosh does ordain as follows: SECTION 1. That Chapter 23, Solid Waste Disposal, Sections 23-7(A)(1) and 23- 7(A)(3) of the Oshkosh Municipal Code pertaining to Standards of Service is hereby repealed and recreated to read as follows: SECTION 23-7 Standards of Service (A) Residential Areas (1) Solid waste, with the exception of recyclable materials, shall be collected once a week from residential dwelling units according to a schedule set by the City. The maximum volume of refuse/garbage collected per dwelling unit shall be 96 gallons per week. The owner of each residential dwelling unit will be charged fees established by resolution on an annual basis by the Common Council for the collection of refuse/garbage that exceeds a volume of 96 gallons per week. In the case of mobile home parks, the owner of the mobile home park will be charged the fees for each mobile home lot in the mobile home park that exceeds a volume of 96 gallons per week of refuse/garbage. (3) (Repealed 4/10/12) SECTION 2. That Chapter 23, Solid Waste Disposal, Section 23-8(B)(4) and Section 23-8(C)(2) of the Oshkosh Municipal Code pertaining to Point of Storage and Collection is hereby repealed and recreated to read as follows: SECTION 23-8 Point of Storage and Point of Collection. (B) Collection (4) Solid waste shall not be placed out for collection before 4 o'clock p.m. of the day preceding a regularly scheduled pick-up or a previously announced date for collection of solid waste materials. Carts shall be returned by the persons to the point of storage within twelve (12) hours after collection. Carts must be set out by 7:00 a.m. on the day of collection. A collection charge and administrative fee per occurrence will be assessed when the City must return to collect a cart set out after the regularly scheduled collection has occurred; the amount charged to each lot or parcel of land shall be charged to the owner of the property and if not paid shall be assessed against the real estate as a special charge pursuant to State Statutes. (C)Solid Waste Cart Placement Recommendations (2) There must be at least three (3) feet of space between the cart and other objects i.e.: trees, poles, mailboxes, plantings, or parked cars.  SECTION 3. That Chapter 23, Solid Waste Disposal, Sections 23-9(A), 23-9(C), 23-9(D), 23-9(I), 23-9(J) (numbered paragraphs unchanged) 23-9(K), 23-9(M), and 23- 9(O) of the Oshkosh Municipal Code pertaining to General Requirements is hereby repealed and recreated to read as follows: SECTION 23-9 General Requirements (A) All garbage shall be drained and wrapped in paper and kept in carts issued by the Sanitation Division. (C) No rear loaded containers (dumpsters) shall be allowed with the exception of Municipal Properties. (D) (Repealed 4/10/12) (I) Animal feces shall be properly disposed of by wrapping in paper and then placing it in a suitable plastic disposable bag not less than two (2) mil thickness. No more than twenty-five (25) pounds of animal waste shall be placed in a bag. (J) Stones, concrete, dirt, tires, batteries, antifreeze, medical waste, hazardous , substances electronics, and automotive engine waste oil are not allowed in the solid waste stream and will not be picked up. Any cart with such prohibited materials will not be collected. (K) Yard waste, except brushas outlined below, shall not be allowed in the solid waste stream and will not be collected. Such waste shall be deposited only at the City- designated collection site. Such waste shall be deposited loose and only during the hours posted at the collection site. The collection site may be used after purchasing a permit for the yearly fee established by the Common Council as part of the budget process. Brush may be set out for collection once per month, provided it is prepared for collection as outlined in this Chapter, and may also be deposited at the City-designated collection site as yard waste. Twigs and hedge trimmings may be set out for collection at the same time as brush collection provided that such items are placed within biodegradable paper bags. Yard waste which is brought to the drop off center shall not exceed six (6) inches in diameter and/or six (6) feet in length. All yard waste being transported to the drop off center must be properly secured with a tarp. The deposit of stumps, stones, and dirt shall be prohibited at the drop off center. Private tree care or gardening/landscape contractors shall be prohibited from using the drop off center. Brush with stems less than three (3) inches in diameter shall be tied in bundles that do not exceed four (4) feet in length and fifty (50) pounds in weight. (M) The owners of the collection carts shall keep them clean and in a sanitary condition. Maintenance and repair of all carts used for the collection of solid waste shall be the responsibility of the owner. (O) If solid waste is not prepared according to the provisions of this Chapter, or is not placed in suitable carts (issued by the Sanitation Division) or location or if a cart is damaged, employees of the Sanitation Division shall "tag" these carts and collection shall not be made until the condition is remedied in compliance with this ordinance. SECTION 4. This ordinance shall be in full force and effect on October 1, 2012. SECTION 5. Publication Notice. Please take notice that the City of Oshkosh enacted ordinance #12-XXX (A GENERAL ORDINANCE OF THE CITY OF OSHKOSH ON SOLID WASTE DISPOSAL REPEALING AND AMENDING SECTIONS 23-7, 23-8, AND 23-9, on April 10, 2012. The ordinance revises standards of service for residential areas, cart placement requirements, and general requirements for cart collection of solid waste. Patek, Director of Public Works DATE: March 22, 2012 RE: Chapter 23 of the Municipal Code of the City of Oshkosh — Revisions Relating to Disposal of Garbage and Recyclable Materials BACKGROUND Chapter 23 of the Municipal Code of the City of Oshkosh covers the regulations relating to the disposal of garbage and recyclable materials. The current text of this chapter needs to be revised to clarify procedures required due to the conversion to automated refuse/garbage collection. ANALYSIS The following changes are recommended: 23-7 Standards of Service (A)(1) Establish 96 gallons (equivalent of three (3) regular cans) as the maximum volume of refuse/garbage for disposal each week per residential dwelling unit. (A)(3) Eliminate text relating to disposal of building materials. This waste can be put out each week for automated collection in a cart. 23-8 Point of Storage and Point of Collection (B)(4) Clarify that recyclable and refuse/garbage materials are collected via carts. (C)(2) Minor grammar revision. 23-9 General Requirements (A) Clarify that carts are issued by the Sanitation Division. (C) Require refuse/garbage disposal on Lake Rest Lane via carts. (D) Eliminate text relating to disposal of bulky items. Cardboard can be placed in the recycling cart, carpet can be placed in the refuse/garbage cart, and text relating to brush is added to 23- 9(K). (I) Require animal waste be placed in plastic bags prior to disposal in a cart. (J) Revise text from"container"to"cart". (K) Clarify that brush is to be bundled as four(4)foot lengths and fifty(50)pounds in weight. (M)&(0) Revise text from"container to"cart". FISCAL IMPACT The change to automated refuse/garbage collection is anticipated to save $66,604 per year for the operating budget of the Sanitation Division.
