HomeMy WebLinkAbout08. 12-119 MARCH 27, 2012 12-119 RESOLUTION (CARRIED___6-0_____LOST________LAID OVER________WITHDRAWN________) PURPOSE: APPROVAL OF LAND PURCHASE FROM GAIL DEMLER AT TH 2115 WEST 9 AVENUE IN THE AMOUNT OF $600,200.00 FOR TH THE 9 AVENUE-WASHBURN STREET AREA STORMWATER DETENTION BASIN PROJECT INITIATED BY: DEPARTMENT OF PUBLIC WORKS WHEREAS, on November 9, 2010, by Resolution No. 10-343, the Common Council approved a Relocation Order pursuant to Sections 62.22 and 32.05 of the Wisconsin Statutes declaring that it was in the public interest for the City of Oshkosh to th acquire a portion of 2115 West 9 Avenue for storm water detention in the Campbell Creek Drainage Basin; and WHEREAS, the parties have concluded negotiations that include these points of agreement: Purchase price $600,200.00.  Real estate taxes shall be prorated through closing  NOW, THEREFORE BE IT RESOLVED by the Common Council of the City of Oshkosh that the proper City officials are authorized and directed to purchase a portion th of 2115 West 9 Avenue as outlined above, and to execute all documents necessary for purpose of same. Money for this purpose is appropriated from: Acct. Patek, Director of Public Works DATE: March 22, 2012 RE: Approve Land Purchases at 2107 and 2115 West 9th Avenue for the 9th Avenue/Washburn Street Area Storm Water Detention Basin BACKGROUND On November 9, 2010, the Common Council approved a relocation order relating to the purchase of property located in the SW quadrant of the 9th Avenue-Washburn Street intersection. This area is an undeveloped property that is currently owned by three different property owners. The City has officially mapped these properties for construction of a storm water detention basin. ANALYSIS Our right-of-way consultant has had discussions with all of the property owners. The Common Council had previously approved land acquisition from Lee Engelman. Gail Demler has agreed to sell 3.775 acres located at 2115 West 9th Avenue for $600,200 and the Angela Demler Life Estate/Gail Demler have agreed to sell 3.569 acres located at 2107 West 9th Avenue for $567,450. The following information pertains to these property acquisitions: Initial Offer Owner Request Agreed Upon Price 2107 W. 9th Avenue $405,000 $932,800 $567,450 2115 W. 9th Avenue $430,000 $986,700 $600,200 FISCAL IMPACT Funding for these acquisitions is included in the "Storm Sewer Section" of the Capital Improvement Program.
