PURPOSE: APPROVE FINAL COOPERATIVE PLAN WITH TOWN OF
BLACK WOLF
INITIATED BY: CITY ADMINISTRATION
WHEREAS, on June 13, 2011 and June 14, 2011, the Town of Black Wolf and
City of Oshkosh, respectively, adopted resolutions authorizing participation in the
preparation of a cooperative plan pursuant to Wis. Stat., Section 66.0307 and approving
an intergovernmental agreement to provide the basic foundation of the proposed
cooperative plan; and
WHEREAS, the municipalities drafted the proposed Cooperative Plan between
City of Oshkosh and Town of Black Wolf, and held a joint public hearing on October 3,
2011, in accordance with Wis. Stat., Section 66.0307(4)(b), to solicit input on the
Cooperative Plan; and
WHEREAS, the City and Town have allowed 20 days after the joint hearing for
any person to comment on the proposed plan in accordance with Wis. Stat., Section
66.0307(4)(c); and
WHEREAS, all comments received have been considered by the City and Town
in the preparation of the final version of the Cooperative Plan; and
WHEREAS, prior to submitting the final Plan to the Department of Administration,
Wis. Stat. Section 66.0307(4) requires a 30 day period after adoption of the final
Cooperative Plan to allow qualified electors an opportunity to request an advisory
referendum.
NOW, THEREFORE BE IT RESOLVED by the Common Council of the City of
Oshkosh as follows:
1) The final version of the Cooperative Plan between City of Oshkosh and
Town of Black Wolf, dated January 23, 2012 (on file in the Office of the
City Clerk) is approved.
2) The proper City officials are authorized and directed to execute the
Cooperative Plan document and all other necessary, implementation
documents, to take all appropriate actions to obtain approval of the
Cooperative Plan from the State of Wisconsin Department of
Administration, and to take such actions as are necessary to implement
the provisions of this Agreement.

RE: Approve Final Cooperative Plan with Town of Black Wolf
BACKGROUND
The Cooperative Plan was approved by the Town on January 9, 2012 and Council is now being
asked to approve the Plan that will be forwarded to the State Department of Administration for
final review and approval, after a required 30 day waiting period.
A joint (City /Town) public hearing regarding the Cooperative Plan was held at the Town of
Black Wolf Town Hall on October 3, 2011. The purpose of the hearing was to allow residents to
comment on the plan and for the City and Town to make adjustments to the Plan based on
comments received during the public hearing or during the waiting period before action could be
taken on the Plan. It should be noted that no significant changes were made to the Plan from the
public hearing or in the interim between the public hearing and the Town's adoption of the
Cooperative Plan in January.
On December 9, 2008 the Common Council approved Resolution 08 -467 that approved an
Intergovernmental Agreement between the City of Oshkosh and Town of Black Wolf. On June
14, 2011 Council approved a resolution (the Town approved a similar resolution) authorizing
preparation of the Cooperative Plan, which has been developed as submitted and is the subject of
the public hearing.
The boundary agreements /cooperative plans with the nearby /adjacent towns provide a broad
working framework within which new growth and development can take place, both within the
City as well as within the towns. The agreements do not propose specific land uses for specific
areas, nor do they set forth the actual timing as to when growth and development will occur —
those decisions are left to the respective communities' comprehensive plans and to the approval
process for development activities.
ANALYSIS
The Cooperative Plan has been drafted to implement the recommendations of the approved
Intergovernmental Agreement (Resolution 08 -467) between the City and the Town of Black
Wolf. The Cooperative Plan also contains all necessary statutorily required components and
information as required by Wisconsin Statutes and the Department of Administration. The Plan
is similar in nature to the Cooperative Plan developed with the Town of Nekimi.
FISCAL IMPACT
The Intergovernmental Agreement and subsequent Cooperative Plan will not obligate the City to
any specific capital improvements and infrastructure projects /expenditures. What this agreement
does is to create a general framework within which growth and development can logically and
reasonably occur. This general framework provides an assurance to the City of its ability to meet
future growth and development needs on the south /southwest sides of the community. By so
doing, this should serve to minimize leap frog development and urban sprawl — both of which
can result in higher costs for the extension of public infrastructure and the delivery of urban
services.
RECOMMENDATION
Through the meetings that have been held between the City and the Town, we believe we have
arrived at a proposed Cooperative Plan that would appear to be a win -win for both the City of
Oshkosh and the Town of Black Wolf. As with the other towns, discussions with the Town of
Black Wolf involved give and take in order to achieve a mutually beneficial agreement. During
our discussions, City staff and Town representatives worked very hard to develop and maintain a
cooperative and positive relationship, and it would be our hope this approach will continue into
the future with the consideration of the proposed agreement and its implementation.
