PURPOSE: APPROVAL OF LAND PURCHASE FROM LEE ENGLEMAN AT
915 SOUTH WASHBURN STREET IN THE AMOUNT OF

STORMWATER DETENTION BASIN PROJECT
INITIATED BY: PUBLIC WORKS DEPARTMENT
WHEREAS, on November 9, 2010, by Resolution No. 10-343, the Common
Council approved a Relocation Order pursuant to Sections 62.22 and 32.05 of the
Wisconsin Statutes declaring that it was in the public interest for the City of Oshkosh to
acquire 915 South Washburn Street for stormwater detention in the Campbell Creek
Drainage Basin; and
WHEREAS, the parties have concluded negotiations that include these points of
agreement:
Purchase price $600,000.00
Real estate taxes shall be prorated through closing
NOW, THEREFORE BE IT RESOLVED by the Common Council of the City of
Oshkosh that the proper City officials are authorized and directed to purchase 915
South Washburn Street as outlined above, and to execute all documents necessary for
purpose of same.
Money for this purpose is appropriated from:

RE: Approve Land Purchase at 915 South Washburn Street for the 9th Avenue/Washburn Street Area
Storm Water Detention Basin
BACKGROUND
On November 9, 2010, the Common Council approved a relocation order relating to the purchase of
property located in the SW quadrant of the 9th Avenue-Washburn Street intersection. This area is an
undeveloped property that is currently owned by three different property owners. The City has officially
mapped these properties for construction of a storm water detention basin.
ANALYSIS
Our right-of-way consultant has had discussions with one of the property owners. The property owner(Lee
Engelman) has agreed to sell his property (3.77 acres) for$600,000. The following information pertains to
this property acquisition:

FISCAL IMPACT
Funding for this acquisition is included in the "Storm Sewer Section" of the Capital Improvement Program.
RECOMMENDATION
I recommend approval of the land purchase.
