HomeMy WebLinkAbout12-05 JANUARY 10, 2012 12-05 RESOLUTION (CARRIED___7-0_____LOST________LAID OVER________WITHDRAWN________) PURPOSE: ACCEPT DONATION OF PORTABLE LIGHT TOWER TO OSHKOSH COMMUNITY MEDIA SERVICES INITIATED BY: CITY ADMINISTRATION WHEREAS, Baldor Generator has previously donated the use of a portable gas powered light tower to provide additional lighting for Oshkosh Community Media Services coverage of the Oshkosh Holiday Parade; and WHEREAS, Baldor Generator has offered to donate the light tower to the City of Oshkosh with the conditions that the City maintain the light tower in good working condition and that the item not be made available for or sold for personal use but that the City must scrap the tower when the City no longer has use for it; and WHEREAS, the City has adopted a gift policy which allows the City to take on future maintenance costs related to a gift upon consideration of the community’s need or desire for the donation; whether and to what extent the proposed donation provides a new or diverse experience for the community and its visitors; the financial capacity of the donor; the ease of maintenance and repair; and whether the annual maintenance cost is so low as to be negligible; and WHEREAS, city staff has evaluated the proposed donation and has identified several needs/uses for the donation and determined that the maintenance costs are so low as to allow them to be absorbed into the current Electric Division operating budget. NOW, THEREFORE, BE IT by the Common Council of the City of Oshkosh that the generous donation by Baldor Generator of a Portable Light Tower is accepted with the conditions that the City maintain the light tower in good working condition and that the item not be made available for or sold for personal use but that the City must scrap the tower when the City no longer has use for the tower. BE IT FURTHER RESOLVED that the proper city officials are hereby authorized and directed to take those steps necessary to accept the donation and to properly maintain such donation during its useful life. CITY HALL 215 Church Avenue P.O.Box 1130 Oshkosh Wisconsrn 54903-1130 City of Oshkosh OfHKOlH TO: Honorable Mayor and Members of the Common Council FROM: Jon Urben,General Services Director DATE: December 29,2011 RE: Waive Exceptions to City of Oshkosh Gift Policy-Light Tower Donation BACKGROUND For the last several years Baldor Generator has donated the use of a portable diesel powered light tower to provide additional street lighting for Oshkosh Community Media Services' television coverage of the Oshkosh Holiday Parade. Baldor Generator has offered to donate this light tower to the City of Oshkosh. The City of Oshkosh Gifts Policy authorizes the City Manager to accept donations of materials or other items that are typical in use in a city department or division. Because Baldor's donation form has two exceptions to the City's gift policies, this donation will require the Common Council's approval. ANALYSIS Baldor's two exceptions would require a) that the City maintain the light tower in good working condition and b)that the City not sell the tower for surplus after it is no longer suitable for use. As per page 7 of the Gift Policy the City may agree to take on future maintenance costs of donations as long as the following criteria are considered when making such decision: the community's need or desire for the donation or improvement; whether, and to what extent, the proposed gift/donation provides new or diverse experiences for community members and visitors; the financial capacity of the donor; ease of maintenance and repair; and whether the annual maintenance cost is so low as to be negligible. In considering the above criteria with this donation it is the consensus of Media Services and Electric Division staff that this light tower would provide a great value to various City departments(e.g. Parks, Fire & Police) with relatively minor or insignificant maintenance/operating costs. This tower is a 6000-watt generator(2000-watt when all lights are on)which could be used in emergency situations to power an intersection, communication systems, transit fuel system, limited building power, and other needs for temporary lighting/power. This unit could be used anywhere when utility power is inaccessible/unavailable. • FISCAL IMPACT The fiscal impact of accepting this donation would be the fuel costs for using the generator and any maintenance/repairs of the unit. Fuel and/or maintenance costs would be absorbed by the Electric Division's operating budget. RECOMMENDATION Purchasing recommends the Common Council waive the exceptions to the City of Oshkosh Gift Policy and accept Baldor Generator's Light Tower donation.
