HomeMy WebLinkAbout11-543 DECEMBER 13, 2011 11-543 RESOLUTION (CARRIED___7-0____LOST_______LAID OVER_______WITHDRAWN________) PURPOSE: APPROVE CONDITIONAL USE PERMIT TO ALLOW INSTALLATION OF ADDITIONAL TELECOMMUNICATION / CELLULAR ANTENNAE ON ROOFTOP AT 522-530 NORTH MAIN STREET INITIATED BY: US CELLULAR, PETITIONER PLAN COMMISSION RECOMMENDATION: Found to be consistent with Section 30-11(D) and approved with conditions BE IT RESOLVED by the Common Council of the City of Oshkosh that a conditional use permit to allow the installation of three new telecommunication/cellular antennae on the rooftop at 522-530 North Main Street, per the attached, is hereby approved with the following conditions: 1) Antennae, mounts and cable runs are blended in with the appearance of the building as much as possible, with approval by the Department of Community Development. 2) A complete inventory and building/elevation plans of all facilities located on the structure is provided prior to installation of the proposed antennae. 3) No additional adjustments, alterations or additions to telecommunication equipment (beyond the three proposed) are permitted until a plan to stealth all facilities is provided, reviewed and approved by the City. 4) Status update on progress of the stealth plan is provided to the City of Oshkosh within 6 months of Common Council approval of this CUP. 5) Plans and building permits for the roof rehabilitation and equipment concealment are provided by December of 2012 or the Conditional Use Permit be considered null and void and the three antennae included within this request be removed (&) OJHKOJH ON THE WATER TO: Honorable Mayor and Members of the Common Council FROM: Darryn Burich Director of Planning Services DATE: December 8, 2011 RE: Approve Conditional Use Permit to Allow Installation of Additional Telecommunication/Cellular Antennae on Rooftop at 530 North Main Street(Plan Commission recommends approval) BACKGROUND The subject structure is a multiple-family apartment building with 110 rental units and commercial/service space on the ground floor located north of the North Main Street and Church Avenue/Merritt Avenue intersection. The structure is a 10 story brick building and was constructed in 1927/1928 as a hotel that was adapted for elderly housing. It is included in the North Main Street Historic District and was included in the 1981 Intensive Historic Survey where it is identified as a "pivotal" contributing structure of the district and eligible for listing on the local, state and national register. The existing rooftop and wall structures at the roofline are dominated by an unknown number of legal nonconforming antenna facilities that were installed when the Housing Authority was part of the City of Oshkosh. As the Authority is now a private agency, any modifications or installation of new equipment requires the issuance of a conditional use permit. ANALYSIS US Cellular is requesting approval to place three additional antennae and adjustment of support structures on the rooftop of Mainview Apartments with the purpose of increasing signal speed and capacity of communication devices. The structure houses multiple telecommunication facilities but staff is unclear as to location, ownership, and number of said facilities. Staff is recommending allowing this installation with the caveat that the antennae, mounts and cable runs be blended in with the appearance of the building and that an inventory, including building/elevation plans of all facilities, is provided prior to installation. Multiple requests for antenna placement/replacement/relocation have been made for the property over the last several years which have been reviewed and addressed by the Oshkosh Landmarks Commission who objected to the installations due to the adverse affects on the historic district from an aesthetic standpoint. Staff feels that if the facilities were not visible or were "stealth" as to be blended into the architecture of the building, the negative impact could be mitigated. The property owner has indicated that his goal is to stealth all of the equipment within the next few years and staff is recommending that no additions or alterations other than the installation of the three proposed antennae be permitted until a plan to stealth all facilities is provided,reviewed and approved by the City with status updates on progress being provided within 12 months. This item was laid over from the October 4, 2011 Plan Commission meeting to provide the applicant time to develop a rooftop/wall mechanical inventory, telecommunication equipment stealth plan and installation timeline. As no further information was submitted from the owner/applicant at the November 1, 2011 Plan Commission meeting, the item was once again laid over to the December 6, 2011 meeting. An inventory of the current antennae was submitted however as it is not a complete inventory of all equipment on the rooftop; a complete compilation of all facilities is being requested prior to the installation of the proposed new antennae. The applicant has also provided several antenna concealment examples although they do not constitute a screening plan for the subject property but provide options being considered for the requested stealth plan. The property owner has indicated that a new membrane and flashing on the roof is anticipated to take place prior to the end of 2012 and the actual stealth plan would be incorporated with the overall rooftop design. Staff is recommending that the installation of the three proposed antennae be allowed with the condition that a status update be provided within six months and the roof rehabilitation and equipment concealment be provided by December of 2012 or the approval of the conditional use permit will be considered null and void and the antennae included in this petition would be required to be removed. FISCAL IMPACT None anticipated. RECOMMENDATION The Plan Commission approved of this request at its December 6, 2011 meeting. Approved, City Manager ITEM: CONDITIONAL USE PERMIT TO ALLOW THE INSTALLATION OF ADDITIONAL TELECOMMUNICATION/CELLULAR ANTENNAE ON THE ROOFTOP OF MAINVIEW APARTMENTS AT 522-530 NORTH MAIN STREET Plan Commission meeting of December 6, 2011. THIS ITEM WAS LAID OVER AT THE OCTOBER 4,2011 AND NOVEMBER 1,2011 PLAN COMMISSION MEETINGS TO PROVIDE THE APPLICANT TIME TO DEVELOP A ROOFTOP/WALL MECHANICAL INVENTORY,TELECOMMUNICATION EQUIPMENT STEALTH PLAN AND INSTALLATION TIMELINE. The applicant has provided an inventory of the existing antenna layout for the rooftop of the building as well as multiple examples of antenna concealment techniques that they are considering. Attached to this staff report update, please find the original staff report with background information and staffs original recommendation. GENERAL INFORMATION Petitioner: Faulk&Foster on behalf of US Cellular Owner: Oshkosh Housing Authority Action(s)Requested: US Cellular is requesting Conditional Use Permit approval to allow placement of three(3)new telecommunication/cellular antennae on the rooftop of the building known as Mainview Apartments(formerly the Raulf Hotel)at 530 North Main Street,to increase signal speed and capacity of cellular communication devices. Applicable Ordinance Provisions: Wireless telecommunication facilities, including antennae, are regulated in Section 30-35(J)of the Zoning Ordinance requiring all towers/antennae proposed to be constructed in commercial zoning districts receive a conditional use permit. The Zoning Ordinance establishes criteria and guidelines for the approval of CUPs in Section 30-11(D). INVENTORY OF THE EXISTING ANTENNA The inventory plan provided specifically identifies existing US Cellular(in red),existing AT&T(in blue)and existing Verizon(in orange) owned antennae as well as identifying some unused mounts(in Blue)that can be removed. The submitted plans include a roof plan as well as photographs of the roof and penthouse facades from all four cardinal directions. The submitted rooftop plan includes a note addressing these omissions that states"A cursory antenna inventory focused on mobile phone providers ...a thorough walk- through with the landlord is required to further inventory other communication antennae". The use and/or ownership of these unidentified elements on the roof will therefore require additional research to identify and to determine if they need to remain and be included in a stealth plan or can be removed. ANTENNA CONCEALMENT EXAMPLES Included in the submittal is a plan sheet depicting several antenna facility concealment examples provided by Edge Consulting and also photo examples of other screening techniques provided by the property owner. These examples do not constitute a screening plan for the subject property but are provided to supply the Plan Commission with options that are being considered for incorporation into a future site/rooftop specific telecommunication equipment stealth plan. Most of the examples provided include faux parapet walls,faux cupola and faux architectural features that could be utilized to disguise the antenna and other telecommunication equipment. All of these examples are considered to be acceptable types of concealment/screening/stealthing by planning staff and would be appropriate to use on the rooftop of the subject building. INSTALLATION TIMELINE The submittal partially meets the requirements of the Plan Commission to provide a comprehensive inventory of rooftop telecommunications equipment and also depicts many examples of how concealment of the equipment can be accomplished, however it does not constitute a stealth plan for the subject site. The omission of an actual site specific stealth plan is predicated on the timeline that is established for the overall roof reconstruction plans. In discussions with the property owner, removal of the antenna and cables on the structure must take place prior to the anticipated installation of a new membrane and flashing on the roof, anticipated to be before the end of 2012. The collocation as included in a yet to be developed stealth plan would need to be completed prior to avoid repairs associated with locating the equipment after the new roof membrane is installed. Therefore,the petitioner would develop the actual stealth plan for equipment on the rooftop in conjunction with the overall rooftop design plan that will take place throughout 2012. Staff understands that there must be coordination in the rooftop redevelopment plan and the equipment stealth plan as they are essentially elements of the same project and agree that it would be counterproductive to develop either without consideration of affects they have on both. At this time, the proposed three antenna US Cellular installation included in this petition includes: 1)installing 1 new antenna on the north wall of the rooftop penthouse; 2) installing 1 new antenna on the west wall of the rooftop penthouse; and 3) installing 1 new antenna on the south wall of the rooftop penthouse with equipment associated with the antenna installation located within an equipment room of the penthouse structure. Because Item —522-530 NMain/JIainview US CellAntenna CUP 2 of the scope and urgency of the proposed installation, Planning staff suggests allowing this installation as proposed with the caveat that the antennae, mounts and cable runs be blended in with the appearance of the building as much as possible and that a complete inventory of all facilities located on the structure, be provided prior to installation of the three proposed US Cellular antennae. Staff feels that if the telecommunication facilities were not visible or were"stealthed"as to be blended into the architecture of the building or unnoticed, the negative impacts can be mitigated. The property owner has indicated that his goal is to stealth all of the equipment over time and stated that he is working with the carriers and other lessees on the facility to "stealth"all the equipment on the roof as part of an overhaul rehabilitation of the structure planned to take place within the next few years. With this in mind, staff suggests that no additional adjustments,alterations or additions to telecommunication facilities be permitted until a plan to stealth all facilities is provided, reviewed and approved by the City with status updates on progress being provided within 6 months. Furthermore, if plans and building permits for the roof rehabilitation and equipment concealment are not provided by December of 2012,this Conditional Use Permit is considered null and void and the three antennae included within this petition be removed. RECOMMENDATION/CONDITIONS Staff recommends approval of the proposed CUP to install three(3)additional antennae with the following conditions: 1) Antennae,mounts and cable runs are blended in with the appearance of the building as much as possible,with approval of the Department of Community Development. 2) A complete inventory and building/elevation plans of all facilities located on the structure is provided prior to installation of the proposed antennae. 3) No additional adjustments, alterations or additions to telecommunication equipment(beyond the three proposed)are permitted until a plan to stealth all facilities is provided, reviewed and approved by the City. 4) Status update on progress of the stealth plan is provided to the City of Oshkosh within 6 months of Common Council approval of this CUP. 5) Plans and building permits for the roof rehabilitation and equipment concealment are provided by December of 2012 or the Conditional Use Permit be considered null and void and the three antennae included within this petition be removed. The Plan Commission approved of the conditional use permit as requested with conditions noted. The following is the discussion on this item from the December 6, 2011 Plan Commission meeting. Mr.Buck presented the item and reviewed the previous actions for this request. He also reviewed the site and surrounding area,the zoning classifications and land use for said area, and the site plan showing the location for the three proposed new antennae. He also reviewed the inventory for the existing antennae which does not account for all the current facilities on the rooftop and reviewed examples of stealthing features provided by the applicant. He explained that the roof was to be reconstructed by the end of 2012 and the stealth plan was to be incorporated into those plans. The owner/petitioner was requesting approval for the three additional antennae now to maintain quality service for the area. Mr. Buck also reviewed the conditions recommended for this request. Mr. Bowen arrived at this time. Mr.Nollenberger questioned if condition#5 addressing the removal of the three new antennae if an equipment concealment plan is not provided by December of 2012 could be revised to include all the antennae currently on the rooftop. Item —522-530 NMain/Mainview US Ce1L4ntenna CUP 3 Mr. Buck responded negatively as the other antennae that currently exist on the structure are all grandfathered as they have existed on the site since prior to this conditional use request for the three additional antennae installation. Ms. Propp inquired if condition#3 relating to the stealth plan would include all the antennae existing on the roof. Mr. Buck responded that the stealth plan would include all the facilities on the rooftop and the consultant for US Cellular would be working with the other carriers on all the facilities including the removal of unused equipment. Mr. Borsuk questioned what type of leverage the city had to ensure that the property owner would follow through with the stealth plan as intended. Mr. Buck replied that the three new antennae for US Cellular would have to be removed if the stealth plan was not provided as required. Mr. Borsuk then questioned if US Cellular could just decide to move their facilities elsewhere. Mr. Buck responded that it was possible but the conditions address that no additional alterations or additions could be made to any other facilities on the rooftop without providing a stealth plan for the equipment. Mr. Borsuk also inquired if the facilities would be removed and stealthed when the roof is reconstructed, can a condition be added that the roof must be reconstructed. Mr. Buck replied that the reconstruction of the roof would require the removal of the equipment however it cannot be added as a condition as the request was for the addition of the three antennae only. Mr. McHugh questioned why we do not have any rights to require that anything be done with the roof and if the City has reviewed the agreements with the cellular companies that own the equipment. Mr. Buck responded that the City does not own the property and the roof reconstruction was at the discretion of the property owner which was the Housing Authority who may have leases with the carriers but the City has not reviewed them. Mr.Thorns suggested that condition#6 be added that all equipment not in use be removed and commented that condition#1 to blend the three antennae additions into the building does not address stealthing the equipment. Mr. Burich indicated that a general association could be made that the unused equipment would be removed and he could consult the City Attorney on the matter. Mr. Cummings desired to affirm that condition#5 to conceal all the equipment would include both existing and the three proposed new additions and questioned the time period that a building permit was allowed. Mr. Buck confirmed that the condition to provide an equipment concealment plan included all facilities and that a building permit was valid for 12 months from the date of issuance. Ms. Lohry voiced her concerns with health factors related to radio waves and felt that some type of testament that these antennae were not causing health issues was necessary as there were 29 inventoried antennae on the rooftop of a building that housed tenants. Mr. Borsuk wished to confirm that condition#5 would stealth all facilities and not just the three additional antennae. Item —522-530 N Main/Olainview US CellAntenna CUP 4 Mr. Buck responded that the condition addressed all equipment be screened at the time of the roof reconstruction and if not completed,the three additional antennae requested today would have to be removed as the conditional use permit would be revoked. Mr. Borsuk also questioned if the occupancy permit for the building could be revoked if the conditions were not met. Mr. Burich responded negatively as the apartment use was not part of this request and further stated that any amendments to the conditions would require the owner/petitioner to come back to the Plan Commission and Common Council for approval. Brad Masterson, Executive Director of the Oshkosh Housing Authority, stated that the agency has a lease with each cellular carrier and pager company that has equipment on the rooftop and could have inactive pagers removed from the rooftop within 30 days. The wireless antenna equipment could be moved to not be visible however the leases with the cellular carriers were to rent specific spaces on the roof. He did not feel there would be any problems with relocation of the equipment and the other carriers would be required to improve their equipment in time to remain competitive. He did have concerns with removing unused mounts until the roof reconstruction was under way as this could make the situation less stable. The apartment renovation was scheduled to be completed by summer at which time the roof reconstruction could be addressed. He further commented that there was a$5 million dollar investment in the renovation for the building and aesthetics were important to the tax credit funding they were receiving. Mr.Fojtik questioned if the building renovation was the reason that they had to be sensitive to the condition of the rooftop. Mr. Masterson responded affirmatively. Ms. Lohry inquired if he was aware of health issues related to cellular antennae. Mr.Masterson replied that he would defer that question to the cellular engineer present but he had the understanding that FCC standards only had concerns with people standing directly next to an antenna for it to create a health issue. Ms. Propp questioned if the Housing Authority had the funding to cover the costs for the removal of the mounts not in use. Mr. Masterson responded that a rental crane would be on site for the roof reconstruction and the unused mounts could be removed at that time. Jim Weinmann, 2310 Mill Street,New London,representing US Cellular, stated that health issues relating to cellular antenna equipment could be researched online but FCC standards relate to permitted maximum exposure and explained the differences between radiation from these sources and X-ray type radiation. He explained the distance guideline requirements and how the proximity of antennae and people contact is calculated when the equipment is placed. Mr. Thorns questioned if each carrier is responsible for only their own equipment. Mr. Weinmann responded that the carriers are required to collectively work together in the placement of the facilities. Mr.McHugh questioned if US Cellular pays an entity for the services of having the equipment on the roof. Item -522-530 N Main/Mainview US CellAntenna CUP 5 Mr. Weinmann confirmed that payments are made to the property owner which in this case would be the Housing Authority. He further stated that the Plan Commission desires to correct the aesthetic issues with the site and US Cellular would like to address issues with capacity for technology services as businesses in the downtown area require it. US Cellular needs to address the technology issues and in turn would be willing to spearhead the effort to develop a stealth plan for all the existing equipment of both their company and the other carriers located on the rooftop. He further stated that the three new antennae would not be visible and he would be working with the property owner and the other carriers however this is a complicated matter and will take some time to develop. If the Plan Commission does not wish to allow US Cellular time to work out a development plan to stealth all the equipment,they would probably opt to relocate their equipment elsewhere however they are willing to absorb the expense to correct the issues. Mr. Borsuk stated that his concerns were with the ability of the property owner to follow up on the project not with the carriers. Mr. Weinmann commented that he was confident that the property owner will follow through with his obligations. Mr.Nollenberger suggested that the City look at developing an ordinance in the future to regulate the installation of all antenna facilities and to have them screened or concealed. Mr. Burich indicated that staff is currently researching the matter to develop an ordinance for such installations. Mr. Thorns commented that we are trying to fix a situation that was created without an ordinance in place and there was a necessity for an ordinance to address these situations. Antenna installations will become more prevalent in years to come with current technology advancing. He further stated that he felt the property owner made a compelling argument for not removing the unused antennae at this time. Mr. McHugh questioned if this was a historic property, could it be defaced in any way with these installations. Mr. Buck replied that there are guidelines for what can be done with historic structures and the owner is working with the Historical Society on the renovations but modifications were allowed on the building. Mr. McHugh commented that the stealthing examples provided were not on historical buildings and would not work on this structure and the City has invested a lot of money in the beautification of downtown and he could not support adding more clutter to the rooftop of this building. He felt other sites could be used for these antennae and there was no reason to approve it as it had no direct benefit to the City. Motion by Bowen to approve the conditional use permit to allow the installation of additional telecommunication/cellular antennae on the rooftop of Mainview Apartments at 522-530 North Main Street as requested with the following conditions: 1) Antennae, mounts and cable runs are blended in with the appearance of the building as much as possible, with approval of the Department of Community Development. 2) A complete inventory and building/elevation plans of all facilities located on the structure is provided prior to installation of the proposed antennae. 3) No additional adjustments, alterations or additions to telecommunication equipment(beyond the three proposed) are permitted until a plan to stealth all facilities is provided, reviewed and approved by the City. 4) Status update on progress of the stealth plan is provided to the City of Oshkosh within 6 months of Common Council approval of this CUP. 5) Plans and building permits for the roof rehabilitation and equipment concealment are provided by December of 2012 or the Conditional Use Permit be considered null and void and the three antennae included within this petition be removed. Item —522-530 N Main/Mainview US CellAntenna CUP 6 Plan Commission meeting of November 1, 2011 ITEM: CONDITIONAL USE PERMIT TO ALLOW THE INSTALLATION OF ADDITIONAL TELECOMMUNICATION/CELLULAR ANTENNAE ON THE ROOFTOP OF MAINVIEW APARTMENTS AT 522-530 NORTH MAIN STREET THIS ITEM WAS LAID OVER FROM THE OCTOBER 4,2011 PLAN COMMISSION MEETING TO PROVIDE THE APPLICANT TIME TO DEVELOP A ROOFTOP/WALL MECHANICAL INVENTORY,TELECOMMUNICATION EQUIPMENT STEALTH PLAN AND INSTALLATION TIMELINE. Staff had attempted to meet with the property owner and applicant to review the items listed above for inclusion in this staff report but it did not take place so staff has no additional information to report. We hope the owner and/or applicant will be able to provide an update to the Plan Commission at the meeting but staff is unable to provide recommendation. The original staff recommendation with conditions is still valid. The building is a 10-story brick structure and was constructed in 1927/1928. It was originally developed (and used until the late 1970s)as a hotel that was adapted for elderly housing. The structure is included in the North Main Street Historic District and was included in the 1981 Intensive Historic Survey where it was identified as a"pivotal"contributing structure of the North Main Street Historic District and eligible for individual listing on the local, state and national register. The structure is further described within the survey as follows: "The Raulf Hotel is architecturally significant as an example of the `exotic' styles employed during the 1920's...the scale and vertical emphasis of the structure dominates this portion of Main Street and makes it a visual landmark for the community". Item —522-530 N Main/Mainview US CellAntenna CUP 7 The existing rooftop and wall structures at the roofline are currently dominated by an unknown number of legal nonconforming antenna facilities. The placement of the existing antennae is nonconforming as Conditional Use Permits were not necessary when the facilities were installed as the Housing Authority was part of the City of Oshkosh at that time. However, approximately 6 years ago it split off and become its own private agency, thereby making their antenna installations legal nonconforming uses (sometimes referred to as"grandfathered"). Any modification to the existing equipment and/or installation of new equipment, other than maintenance, now requires the issuance of a Conditional Use Permit. The purpose of the antenna placement request is to increase signal speed and capacity of US Cellular communication devices in the area. Capacity and coverage are extremely important at this location as the structure is the tallest in the area with density of users and frequency of cellular actions in the downtown area being high. The structure currently houses multiple telecommunication facilities but staff is unclear exactly how many, who they belong to and where they are exactly located. US Cellular has supplied plans that depict the location of their six(6)existing antenna at this location including: 1)two (2)on the north wall of the rooftop penthouse, 2) two(2)on the west wall of the rooftop penthouse, and 3)two(2)on the south wall of the main building. Staff requested an inventory of all other telecommunication facilities and related equipment from the property owner and received a list(attached)that is extremely basic and does not include number of antenna or locations. The property owner has indicated that the list may not be complete and additional research will be necessary to finalize it. The proposed US Cellular installation included in this petition includes: 1)installing a new antenna on the north wall of the rooftop penthouse; 2) installing a new antenna on the west wall of the rooftop penthouse; and 3) installing a new antenna on the south wall of the rooftop penthouse. Other equipment associated with the antenna installation is currently located within an equipment room of the penthouse structure and is not proposed to be modified. Because of the scope and urgency of the proposed installation,Planning staff suggests allowing this installation as proposed with the caveat that the antennae, mounts and cable runs be blended in with the appearance of the building as much as possible and that an inventory, including building/elevation plans of all facilities located on the structure,be provided prior to installation of the proposed antenna. Item —522-530 NMain/Mainview US CellAntenna CUP 8 Multiple requests for antenna placement/replacement/relocation have been made for the property over the last several years. Because the structure is historic and also utilizing Federal funds,the State Historic Preservation Office requires that the carriers notify the community to get input on potential effects of the proposed installations on historic properties/areas. No less than three (3) such requests have come to the city for this property from various companies and have been reviewed and addressed by the Oshkosh Landmarks Commission. The Landmarks Commission has registered a statement"completely objecting"to installation of cell phone antenna on this structure and feel any proposed location is inappropriate and disputes any findings that there would be no adverse affects on the historic district. They state that"the proliferation of antenna lining the perimeter of the building distract from the historic elements of the structure as well as have a negative affect on the historic view-shed from the north, south, east and west within the North Main Street Historic District and from many of the contributing historic buildings". Attached please find a copy of correspondence from the Landmarks Commission to Edge Consulting, agent for US Cellular. Planning staff understands and agrees with the conclusion of the Landmarks Commission that the past installation of the telecommunication equipment on the structure was inappropriate from a historic/aesthetic standpoint and does have a negative impact on the historic nature of the North Main Street Historic District, as well as the general aesthetics for the area; however, we disagree that no installations should be allowed in any instance. Staff feels that if the telecommunication facilities were not visible or were"stealth"as to be blended into the architecture of the building or unnoticed,the negative impact could be mitigated. The property owner has indicated that his goal is to stealth all of the equipment overtime and stated that he is working with the carriers and other lessees on the facility to"stealth"all the equipment on the roof as part of an overhaul rehabilitation of the structure planned to take place within the next few years. With this in mind, staff suggests that no additional adjustments,alterations or additions to telecommunication facilities be permitted until a plan to stealth all facilities is provided,reviewed and approved by the City with status updates on progress being provided within 12 months. RECOMMENDATION/CONDITIONS Staff recommends approval of the proposed CUP to install three(3)additional antennae with the following conditions: 1) Antennae,mounts and cable runs are blended in with the appearance of the building as much as possible, with approval of the Department of Community Development. 2) An inventory and building/elevation plans of all facilities located on the structure is provided prior to installation of the proposed antennae. 3) No additional adjustments,alterations or additions to telecommunication facilities until a plan to stealth all facilities is provided, reviewed and approved by the City. 4) Status update on progress of the stealth plan is provided within 12 months of Common Council approval. The following is the Plan Commission's discussion on this item from the October 4th and November 1st meetings. October 4, 2011 Plan Commission minutes Mr. Buck presented the item and reviewed the site and surrounding area as well as the land use and zoning classifications in said area. He discussed the history of the site and commented that the building was located in the North Main Street Historic District. He reviewed photos of the site and discussed the numerous installations of antennae on the roof of the structure and reviewed the site plans for US Cellular to add three additional Item —522-530 N Main/Mainview US CellAntenna CUP 9 antennae to the six they own already existing on the site. He discussed the condition requiring the additional antennae be blended into the structure and the previous requests in the last several years for additional installations. He stated that the request had been reviewed by the Landmarks Commission who objected to this it as they felt the past installations had been done inappropriately. Planning staff felt the installation could be allowed if mitigated by"stealthing"the antennae which the property owner has agreed to over time. He also reviewed the conditions recommended for this request. Mr. Fojtik inquired if there were examples of stealthing the equipment in the community. Mr. Buck and Mr. Burich described a number of ways that could be utilized to hide the appearance of the antennae or blend it into the structure to make it more aesthetically pleasing. Mr. McHugh commented that since the conditions were requiring an inventory of all the facilities on the structure be submitted, he felt that there were reasons the city did not want to do this. Mr. Buck responded that the city does not know what is currently on the structure and the inventory was necessary to ensure compliance with the conditions. Mr.McHugh inquired what the reason was for the urgency to have to this request approved. Mr. Buck replied that the reasoning was financial issues for the Housing Authority. Mr. McHugh commented that he did not want to deface property of a historical nature and questioned what the benefit to the city would be from the approval of this request. Mr. Buck responded that the increased capacity of the antennae would benefit the residents who are users of the system in the community. Ms. Propp questioned what the height of the proposed new antennae would be. Mr. Buck replied that the proposed three additional antennae would be dropping down below the roof line and would possibly be eight feet in length but would not be extending entirely above the roof line. Mr. Thorns questioned what the reasoning was for condition#2 relating to the inventory of all facilities on the roof. Mr. Buck responded that the city needs to verify what is currently located on the roof as this request is to approve only three additional facilities and it is necessary to know what exists on the structure to confirm that only three antennae are being added to the site. Mr. Thorns requested that condition#3 be clarified as it relates to no alterations or additions be allowed yet the request is to add three additional antennae. Mr. Buck indicated that the condition was to address any further alterations or additions and that the request was recommended to approve the three additional antennae at this time. Mr.Nollenberger questioned what the ramifications would be if the Commission turned down the conditional use permit until the inventory of the facilities was provided. Mr. Burich replied that there was no down side to the city but it may have a negative impact on the Housing Authority and their carriers. Item —522-530 N Main/Mainview US CeliAntenna CUP 10 Brad Masterson, Executive Director of the Housing Authority, stated that the structure was listed on the National Register of Historical Places and he was currently working with the state and federal offices on approval of the renovation of the building. He further commented that he had been working with the cellular carriers for several years on relocating and stealthing the equipment and Verizon was leading the project but has since backed out. US Cellular has taken over the lead however their incentive to move forward with these plans was the addition of three antennae at this location. A representative from the historical office will be here on a regular basis and he would like to provide a green space on the roof for the tenants. He was utilizing US Cellular's need for additional antennae to get the project completed and the Housing Authority makes money from the installations on the rooftop. The urgency on the Housing Authority's part to receive approval for this request was due to the fact that they need the funding from the antennae to pay bills and this has been in the planning stage for a number of years. He discussed the inventory of the existing antennae and he believed that most of the hardware on the rooftop was currently being utilized however some may be obsolete. He also discussed various stealthing methods to obscure the view of the hardware. Mr. Thorns questioned how many companies have contracts with the Housing Authority. Mr.Masterson responded that three major companies have contracts and there are also satellite dishes and pager installations on the roof. Mr. Thorns then questioned if some of the equipment could be removed if no contract was currently enforced. Mr. Masterson was not sure if that was allowed by State law depending on the wording in the individual contracts. Mr. Borsuk asked for clarification if the three new antennae would be included in the stealth plans when installed. Mr. Masterson responded that they will go as far as they can with the process at the time of installation. Mr. Borsuk commented that he was confused with the oversight of the existing contracts as the Housing Authority does not seem to know what is currently located on their roof. Mr. Masterson replied that there may be a number of installations up there that are not active however he is not certain. Mr. Borsuk inquired what the down side would be to holding off on this request until further information could be obtained. Mr.Masterson responded that US Cellular may look elsewhere for the relocation of their antennae on another building. Mr. Borsuk questioned if the relocation on another building would have to receive approval from the Plan Commission and Common Council. Mr. Burich replied that it depended on the zoning of the property that is chosen. If the property would be in an industrial district, it would not require Plan Commission or Common Council approval. Ms. Propp commented that it was mentioned that the building was going to have the roof renovated and she questioned if all the hardware would have to be removed for that process. Mr. Masterson discussed the matter of which ones would require to be removed however it would not be all of the installations. Item —522-530 NMain/Mainview US CellAntenna CUP 11 Ms. Propp inquired if the existing antennae could be replaced with smaller less obtrusive ones. Mr. Masterson discussed the technology and that some of the units have gotten smaller however some are still eight feet in height. He also discussed the use of signage to help hide the presence of the antennae. Mr. Buck stated that the stealth package when complete will come back before the Plan Commission and Common Council for approval. Mr. Borsuk questioned how long it would take to develop this plan. Mr.Masterson responded that it would most likely take until shortly after the new year to complete or at least three months. Mr. Buck added that the conditions on this request require an update be provided within a 12 month time frame. Mr. Fojtik inquired if the owner found the conditions satisfactory. Mr.Masterson replied that the carriers may not be able to meet deadlines if the time lines were too short. Mr. McHugh asked for clarification of the equipment currently existing on the roof. Mr. Masterson discussed the various antennae, pagers, and other equipment currently located there. Mr.McHugh commented that this should not be allowed to continue without any benefit to the city and he did not see any way the antennae could be adequately hidden on the building. He felt it was inappropriate as the city has just spent millions of dollars on the beautification of Main Street. Mr.Thorns questioned how long the antennae have existed on the top of the building. Mr.Masterson responded that some have been up there since the late 1970's or early 1980's and the income derived from these installations is used by the Housing Authority to benefit their tenants. Mr. Nollenberger stated that he cannot support this request without the submission of a stealth plan for review. He felt the request should be tabled until this plan is submitted. Mr.McHugh inquired if the remodeling plan for the building's renovation would be coming before the Plan Commission for approval. Mr. Buck replied that those plans would go to the Landmarks Commission for review and that this request is only for the antennae installation. Mr. Thorns questioned if we don't approved this request, how we get a stealth plan submitted for the existing installations. Mr.Nollenberger stated that he felt the item should be tabled until a stealth plan is submitted for review. Mr. Borsuk commented that tabling the request usually does not involve a period of more than four weeks and that he was less concerned with historical issues than his lack of confidence in the Housing Authority's ability to manage the matter. Mr.Nollenberger reiterated that he still prefers to table the request until the stealth plan and the inventory is submitted. Item —522-530 NMain/Mainview US CellAntenna CUP 12 Mr. Thorns discussed the bad planning in the past involving the installation of the existing antennae and the affects on the historical area. Mr. Bunch commented that the request could go forward to the Common Council with the Plan Commission's recommendation to approve or deny it as it is and let the Council make the decision, or it could go to the Council with a recommendation to approve with the condition that an inventory and stealth plan be submitted prior to it the installation of the three additional antennae. Mr. Nollenberger stated that he would prefer to see the stealth plan prior to the Plan Commission making a recommendation on the matter. Mr. Hinz commented that the owner seems committed to the renovations with the oversight of the Historical Preservation Society and the request is clear that any future alterations or additions will not be allowed until a plan is submitted to stealth all facilities. Mr. Borsuk stated that it was the Plan Commission's responsibility to act on what is considered good planning and he would prefer to lay the request over for two to four weeks until further information can be obtained. Mr. Bunch indicated that Mr. Masterson is willing to lay the request over for four weeks and come back to the Plan Commission at their first meeting in November. Mr.McHugh commented that he felt there was no urgency to approve this request and more information was necessary. Motion by Nollenberger to lay over the conditional use permit to allow the installation of additional telecommunication/cellular antennae on the rooftop of Mainview Apartments at 522-530 North Main Street until the first meeting in November with the request including an inventory of the existing installations and a plan to stealth all facilities. It would be presented again to the Commission at the first meeting in December. Completely object to installation of a cell phone antenna on historic strictures that are on the state and national historic register, eligible for the register, locally landmarlced, or contributing structures within a historic district; 2. Strongly discourage installation of antenna on historic structures that are on the register or eligible for the register, locally landmarked, or contributing structures within a historic district even if they are incorporated into the building's architecture as not to be visible (because they pose a threat to the historic integrity of the building/structure); 3. Discourage installation on non-contributing structures within an historic district; but, if sited on said structures, the installation should be incorporated into the architecture and/or sited, and screened as not to be obvious or visible within the historic district; 4. Are concerned with an installation of a tower or antenna on non-contributing structures outside a historic district if they have a visual impact on a historic district or other structures of local historic significance. The Verizon project to install additional antennae structures on 530 N. Main Street is in a historic district. Moreover, it is on a historic structure, the city's 1927 ten-story skyscraper, the tallest building in Oshkosh's historic downtown. The proposed antennae collocation is totally inappropriate and would fit under# 1, above. The Commission unanimously disputes the company's finding that there would be No Adverse Effects on the historic district. The present proliferation of antennae line the perimeter of the building on 530 N. Main Street and totally distract from the historic high-rise's glazed terra cotta facade, with pinnacles, spires, crenellated parapet, shields and tiles. "The scale and vertical emphasis of the structure dominate this portion of Main Street and makes it a visual landmark" in the historic view-shed from north, south, east, and west within the North Main St. Historic District and from many of the contributing historic buildings. The citizens of Oshkosh recently celebrated the reopening of Oshkosh's Main Street after a $6 million reconstruction. Most of the proud owners of historic downtown buildings are local residents who have personally invested millions of dollars into preserving the heart of this city. Partnering with the Oshkosh Area Community Foundation, business owners are investing in remodeling storefront facades. The City of Oshkosh has buried the utility lines to better allow for the skyline of historic buildings and the total vista of a historic district. The Irving-Church Historic District and local-landmark 226 High Avenue, within two to three blocks from the proposed antennae installations on 530 N. Main Street, also have views of Oshhkosh's Downtown historic skyscraper and are distracted because of the present installations and any future conspicuous additions to the roof terrace and observation tower. • In August 2009 the City of Oshkosh adopted the Downtown Overlay District Building Design Standards (30-27) with architectural guidelines. The present installations on the building's rooftop and tower would never be approved in today's review because of the detrimental visual impact on the building and the surrounding historic district. The Landmarks Commission proposes that no new additions be allowed on the building and as the antennae become obsolete that they would not be replaced. The Landmarks Commission's job is to be vigilant and safeguard the integrity of Oshkosh's architectural heritage and prevent any further compromise to its treasure of historic buildings. The Landmarks Commissioners are in total agreement that the present antennae have compromised the visual impact of the historic skyline and oppose any antennae additions to the building. The Landmarks Commissioners concur that"enough is enough!"
