HomeMy WebLinkAboutBoard of Public Works/ Waive Bids Storm Sewer Outfall Blackhawk Street NOVEMBER 11, 2011 BOARD OF PUBLIC WORKS RESOLUTION CITY OF OSHKOSH, WISCONSIN PURPOSE: DECLARE EMERGENCY UNDER §62.15(1b), STATS. AND SECTION 12-10 OF THE CITY OF OSHKOSH MUNICIPAL CODE AND WAIVE BIDS & AUTHORIZE REPLACEMENT OF STORM SEWER OUTFALL TO FOX RIVER AT VACATED BLACKHAWK STREET INITIATED BY: DEPARTMENT OF PUBLIC WORKS WHEREAS, the existing 30" CMP (Corrugated Metal Pipe) storm sewer outfall to the Fox River at vacated Blackhawk Street has failed and should be replaced as soon as possible; and WHEREAS, this outfall is critical to allowing storm water runoff to discharge to the Fox River and minimize the potential for flooding in the Kolf Sports Center area of the University of Wisconsin — Oshkosh, and time is of the essence; and WHEREAS, the existing outfall was installed 1967 and has reached the end of its useful life; and WHEREAS,the delivery time for the pipe and manhole needed to replace this outfall is approximately 5 days; and WHEREAS, there is significant concern that further delays in replacement of the storm sewer outfall will result from the City's traditional bidding process may endanger the public's health, safety and welfare; and WHEREAS, Section 62.15(1b), of the Wisconsin Statutes, and Section 12-10(D) 2., of the City of Oshkosh Municipal Code, authorize the waiving of bidding requirements for the repair and reconstruction of public facilities when the Board of Public Works (the City Manager, per section 2-20(C) of the City of Oshkosh Municipal Code) determines by resolution that damage or threatened damage creates an emergency in which the public health, safety or welfare of the city is endangered; and WHEREAS, the Department of Public Works has secured quotations from four utility contractors and the most advantageous quotation appears to be from PTS Contractors, 4075 Eaton Road, Green Bay, WI, in the amount of $64,333.50, subject to conditions beyond the vendor's control; and WHEREAS, funds for this purpose are available in the Storm Water Utility accounts; NOW, THEREFORE, BE IT RESOLVED by the Board of Public Works (City Manager, or designee) that the failure and replacement of the storm sewer outfall in vacated Blackhawk creates an emergency threatening the health, safety and welfare of the city, requiring replacement of said Influent storm sewer outfall. BE IT FURTHER RESOLVED that the proper city officials are authorized and directed to waive bids and enter into an agreement with an appropriate utility contractor to complete all necessary repairs. Money for this purpose is appropriated from Acct No. 561-2050-6426-00000 — Storm Water Utility — Maintenance Expense BE IT FURTHER RESOLVED that, once the repairs have been completed and the emergency no longer exists, the Common Council of the City of Oshkosh be asked to approve an appropriate motion pursuant to section 62.15(1b), of the Wisconsin Statutes, declaring an end to the emergency.
