HomeMy WebLinkAbout11-495 NOVEMBER 8, 2011 11-495 RESOLUTION (CARRIED___7-0_____LOST________LAID OVER________WITHDRAWN________) PURPOSE: APPROVE LAND PURCHASE AT 1508 SOUTH KOELLER STREET FOR THE NATIONAL GUARD ARMORY AREA STORMWATER DETENTION BASIN PROJECT INITIATED BY: PUBLIC WORKS DEPARTMENT WHEREAS, on November 23, 2010, by Resolution No. 10-364, the Common Council previously approved a Relocation Order pursuant to Sections 62.22 and 32.05 of the Wisconsin Statutes declaring that it was in the public interest for the City of Oshkosh to acquire a portion of 1508 South Koeller Street for stormwater detention in the Campbell Creek Drainage Basin; and WHEREAS, the parties have concluded negotiations that include these points of agreement:  Purchase price $920,000  Real estate taxes shall be prorated through closing NOW, THEREFORE BE IT RESOLVED by the Common Council of the City of Oshkosh that the proper City officials are authorized and directed to purchase a portion of 1508 South Koeller Street as outlined above, and to execute all documents necessary for purpose of same. Money for this purpose is appropriated from: Acct. Patek, Director of Public Works DATE: November 3, 2011 RE: Approve Land Purchase at 1508 South Koeller Street for the National Guard Armory Area Storm Water Detention Basin BACKGROUND On November 23, 2010, the Common Council approved a relocation order relating to the purchase of property located immediately east of the new Best Buy Store. This area is a portion of the former Menard's Store Complex. The City has officially mapped this property for construction of a storm water detention basin. ANALYSIS Our right-of-way consultant has had discussions with the property owner. It has been determined that 8.34 acres (from a total parcel area of approximately 18.58 acres) is required for this storm water management facility. The property owner (2323 East Capital LLC) has agreed to sell the property for $920,000. The following information pertains to this property acquisition: Initial Offer Owner Request Agreed Upon Price $910,000 $920,000 $920,000 FISCAL IMPACT Funding for this acquisition is included in the "Storm Sewer Section" of the Capital Improvement Program.
