The church and parsonage were constructed in the late 1800's and the former school in 1960. The subject property was issued a CUP for a daycare facility in 2001 that was discontinued prior to 2007 when a CUP was issued for the establishment of a community center and fellowship hall for the Solutions 12-Step Recovery Club. Solutions 12-Step Recovery Club will continue use of the school structure until they find a structure that better serves their needs or by April 2012,whichever is earlier. ANALYSIS The two properties contain three principal structures, a detached garage, and 27 associated surface parking stalls in a residential neighborhood. The applicant is requesting a conditional use permit for the re-establishment of a worship center/church use in the old church at 824 East Parkway Avenue, a parsonage in the home that shares the lot at 820 East Parkway Avenue and an education center in the former daycare/school at 621 Evans Street. The church and parsonage are considered historically significant as an example of late nineteenth century design. The congregation has approximately 50 active members and is proposing operating hours of 9 am until early evening for prayer meetings, counseling, bible studies and leadership training with full worship services on Sundays and Christian holidays. Activities will be confined to the interior of the structures with no site improvements for outside activities. Staff is recommending that the hours of operation for the education center use be limited to between 8 am and 10 pm to minimize any potential impact on the surrounding residential neighborhood. It is also suggested that the lots be combined into one tax parcel for the entire development. FISCAL IMPACT None anticipated. RECOMMENDATION The Plan Commission approved of this request at its November 1, 2011 meeting. PARKWAY AVENUE Plan Commission meeting of November 1, 2011 GENERAL INFORMATION Petitioner: Jericho Road Ministries,Inc. Owner: Kornerstone Recovery, Inc. Action(s) Requested: This is a request for a conditional use permit(CUP) for the re-establishment of a worship center/church and accessory uses at 824 East Parkway Avenue, 820 East Parkway Avenue, and 621 Evans Street. Applicable Ordinance Provisions: Churches and associated uses are permitted through conditional use permits in R-2 Two Family Residence Zoning District as regulated in Section 30-19 (A) (3) of the Zoning Ordinance. Standards imposed on Conditional Use Permits are located in Section 30-11 (D) of the Zoning Ordinance. Property Location and Type: The two properties contain three principal structures (1250 sq. ft. parsonage, 5000 sq. ft. church, and 4500 sq. ft. school), a detached garage, and associated surface parking of 27 stalls. The subject properties are located in an east side residential neighborhood consisting primarily of single-family uses with two family uses interspersed throughout the area. The subject property is bordered on all sides by single-family uses with the exception of along the west property line where a two family use is present. The subject property is not located in any neighborhood improvement, redevelopment, or TID districts. The former Mercy Medical Center Hospital facility, which is undergoing redevelopment, is located one block to the east. Subject Site Existing Land Use Zoning Institutional (Community/Recovery Center) R-2 Adjacent Land Use and Zoning Existing Uses Zoning North Residential (single family) R-2 South Residential (single and two family) R-2 East Residential (single family) R-2 West Residential (single and two family) R-2 Comprehensive Plan Land Use Recommendation Land Use 10 Year Land Use Recommendation Residential 20 Year Land Use Recommendation Residential ANALYSIS The applicant is requesting a conditional use permit (CUP) for the re-establishment of a worship center/church use in the 100 +year old church at 824 East Parkway Avenue, a parsonage in the home that shares the lot at 820 East Parkway Avenue, and an education center in the former daycare/school at 621 Evans Street. The church structure and parsonage are original to the site being constructed in 1896 and are located on one lot (820-824 East Parkway). The school structure was constructed in 1960 on the lot to the north(621 Evans). The structures housed St. Paul's Evangelical Church and Calvary Chapel until around 1998. A daycare use was established in the school structure in 2001 and a drug and alcohol recovery center was established in 2007. The church remained vacant during these times and the parsonage was a rental housing unit. This church and parsonage are considered historically significant as an example of late nineteenth century design, which in Oshkosh was often a combination of Queen Anne- Shingle Style-Colonial Revival elements. Although covered with aluminum siding, the church has not been structurally altered as have most of the churches designed during this period in Oshkosh. The school building has not been surveyed for historic significance but is over 50 years of age. The application states that the congregation proposing to re-establish the place of worship and educational use on the site has approximately 50 active members, many of which live in the immediate area. They proposed operating hours are to be daily from 9 a.m. until early evening including daily prayer meetings, individual counseling, small group bible studies and leadership training. Full worship services are scheduled for Sundays and Christian holidays. All activities are to be confined to the interior of the structures and no site improvements or plans have been presented for outside site improvements or activities. As typical with institutional uses within residential areas, staff recommends that hours of operation for the education center use be limited Item—CUP/Church/Evans&Parkway 2 to between 8 am and 10 pm to minimize any potential impact of traffic and noise on the surrounding residential neighborhood. The site appears to have ample room to provide the services proposed in the church, parsonage and school including access and parking. However, as the parking lot and school are located on one lot and the church and parsonage on another, it is suggested that the lots be combined to assure that the parking remain available for the church use. Staff feels the proposed use is not only returning the site back to the purpose that it was originally designed but that it also will facilitate proper maintenance and upkeep of a historic structure in the community. The proposed re-establishment of the site as a worship and educational center use remains consistent with the regulations of the Zoning Ordinance. RECOMMENDATION/CONDITIONS Staff recommends a finding that the proposed conditional use permit request is consistent with Section 30-11(D) of the Zoning Ordinance and be approved with the following conditions: 1. Hours of operation for the education center use are limited to between 8 am and 10 pm. 2. The separate tax parcels are to be combined in one tax parcel for the entire development. The Plan Commission approved of the conditional use permit as requested with conditions noted. The following is the Plan Commission's discussion on this item. Mr. Nau presented the item and reviewed the site and surrounding area as well as the current land use and zoning classifications in said area. He reviewed the history of the site and stated that the educational center and parsonage on site would be accessory uses to the proposed re-establishment of the church. The church structure is a historical building and he reviewed photos of the structure. The recommended hours of operation for the educational center were 8 am through 10 pm and he reviewed the conditions recommended for this request. He also reviewed two emails from adjacent property owners who were unable to attend the meeting. One was from Bill Parkin, 622 Bowen Street, who was requesting privacy screening along the property line between his home and the parking lot and the other was from Virginia Jungwirth, 810 E. Parkway Avenue, who had concerns with the children current living at the parsonage home and any outside activities that the church was proposing. Mr. Nau indicated that the church did not request any site improvements for outside activities in their application. Mr. McHugh questioned if the school use should require a separate conditional use permit. Mr. Burich responded that the proposed school use is not a public school but is an accessory use related to the church function therefore only one conditional use permit is required. Mr. McHugh then inquired if previous uses of this nature only required one conditional use permit. Mr. Burich replied that public schools require a separate conditional use permit and at times, the school use in connection to the church was established after the original use received approval and in that case required an amendment to the conditional use permit. In this case, since the request Item—CUP/Church/Evans&Parkway 3 was presented for the church and accessory structure use together, there was no need to require two separate conditional use permits. Mr. Cummings stated that the educational building was used as a Sunday school years ago when the church was previously still operating. Mr. Thorns inquired if the number of parking stalls meets code requirements and if the recommended hours of operation were for the educational center only. Mr. Burich responded that the parking lot was an existing legal nonconforming lot and if stalls were not adequate, on street parking may be utilized. The hours of operation were meant to address activities other than church services which are consistent with the requirements placed on the request for the previously approved mosque. Mr. Thorns then questioned if the educational center's limited hours of operation were consistent with the hours approved for the current use on site of the Kornerstone Recovery Club. Mr. Burich responded affirmatively. Mr. Thorns also inquired about the screening suggested by the neighbor and if it could be included and if it was legally required. Mr. Burich indicated that this was an existing structure and the site was not changing therefore there were no requirements in place for screening as the use of the parking lot was not changing. Mr. Hinz questioned if there was adequate room for screening as it appeared there was limited space in this area. Mr. Burich replied that with the limited area, he was not sure if there was sufficient space to add privacy screening between the lots. Mr. Cummings inquired what the plans were for the parsonage and if there were any major alterations planned for the church as the structures are in need of exterior maintenance. Mr. Burich responded that the application did not indicate what repairs were planned for the structures but if conditions exist that are code violations; correction notices could be issued to address the situation. Mr. Borsuk questioned if the current conditional use permit for this property had expired if the site had been vacant for more than a year. Mr. Burich replied that the CUP had not expired as the educational building was still being used although the church structure may not be in use at this time. Ms. Lohry arrived at 4:15 pm. Robert Langlitz, representing Jericho Road Ministries, Inc., 429 N. Sawyer Street, discussed some of the maintenance plans to be completed and estimated that about $50,000 would be invested in Item—CUP/Church/Evans&Parkway 4 site improvements to the structures however they were not planning on changing the look of the buildings. Mr. Thorns inquired if the renovations were presented to the Landmarks Commission. Mr. Langlitz responded that they had not reviewed the renovations with the Commission however they were not proposing to alter the structures. The church would become a worship center again with the educational building being utilized for Sunday school and after school activities for children. Bible studies and religious training would also be part of the use which would be going back to the original use of the site. Mr. Fojtik questioned if the privacy fencing suggested by the adjacent property owner was possible. Mr. Langlitz replied that he was not sure if there was adequate space available for the screening feature but they wanted to be good neighbors and was willing to look into it. Mr. McHugh stated that he heard that there were plans to establish a kindergarten through 10th grade school on the site. Mr. Langlitz responded that this was not the case and the educational center was to be used for Sunday school and other religious training only. Sarah Anderson, 627 Evans Street, stated that she was in favor of the re-establishment of a church on the site but was questioning who would be occupying it. She voiced her concerns with it being rented out to other entities as the building was in need of substantial repairs which the previous owner was not capable of funding and she was seeking assurance that the necessary maintenance to the structures would be done. She also had concerns with no on street parking being available on Bowen Street or Parkway Avenue leaving Evans Street as the only available street to utilize for parking as the number of members exceeded the parking stalls in the lot. Mr. Burich indicated that the structures cannot be rented out to community organizations without the conditional use permit coming back for approval of an amendment as the original proposal does not include that use. The nonconforming parking lot currently exists on the site and on street parking can be utilized during standard church services which are common practice with most churches in older neighborhoods of the city. Ms. Anderson stated that she had concerns with the site converting space to establish a homeless shelter or low income housing. Mr. Burich responded that this use could not be established without first amending the conditional use permit as those are not uses indicated in the application. Marlin Harris, 820 E. Parkway Avenue, stated that the no parking restrictions on Parkway Avenue have been removed so on street parking would be allowed and maintenance work has been lined up for painting and other renovations with volunteers completing the work. A Service Ministry of Zion Lutheran Church Evans St./Parkway Use permit Narrative This property consists of a beautiful 100 year old church, a house with a garage and an education buuilding. The church currently has only lit iterl usage. The house and garage are currently rental properties. The education building is currently being used by Solutions Recovery to provide support and encouragement for recovery from drug and alcohol addiction, Our desire is for the church building to revert to its original use as a Christian worship center. The house will become a parsonage and the garage will continue to be used for storage. The education building will be used for Sunday School classes and after school Christian activities. Solutions Recovery will continue to use the education building until they find a building that better meets their needs or until April 30,2012. The congregation will utilize the parking lot for parking during church services and related church activities. Traffic flow will be • entering and exiting from Evans Street and exit only onto Bowen Street. Parking is also available on Parkway Ave. and on Evans Street. This congregation of Christians has fifty active members. Many of the congregants live in the immediate area and do not have vehicles. These people will be utilizing the sidewalks and crosswalks on Parkway and Evans Streets. They will be entering the church from the Parkway entrance. We do not expect pedestrian or vehicle traffic to be an issue with our neighbors. The congregants have been gathering at Menomonee Park during good 429 N. Sawyer Street, Oshkosh, WI 54902 (920) 231-1287 TO weather and at the Zion Lutheran Church chapel during inclement weather and through out the winter. The goal of this ministry is to preach the Word of God and to train leaders in service to Christ. We filly expect this ministry to be a positive influence for the local community. The operating hours will be daily from 9:00 A.M.,until early evening. During the week there will be daily prayer meetings lasting approximately one.hour. Individual counseling will be on an as requested basis. Evenings will have small groups doing Bible studies and leadership training. Worship services will be scheduled for Sundays and Christian Holidays. While there will be a joyful noise made unto the Lord, we do not expect to be a disturbance to our neighbors. - The surrounding properties are residential.
