HomeMy WebLinkAboutBoard of Public Works/Waive Bids for failed pump #3 FEBRUARY 23, 2009 BOARD OF PUBLIC WORKS RESOLUTION CITY OF OSHKOSH, WISCONSIN PURPOSE: DECLARE EMERGENCY UNDER §62.15(1b), STATS. AND SECTION 12-10 OF THE CITY OF OSHKOSH MUNICIPAL CODE AND WAIVE BIDS & AUTHORIZE REPLACEMENT OF INFLUENT PUMP #3 VARIABLE FREQUENCY DRIVE FOR REPAIR OF WASTEWATER TREAMENT PLANT FACILITIES INITIATED BY: DEPARTMENT OF PUBLIC WORKS WHEREAS, the influent pump #3 variable frequency drive at the wastewater treatment plant has failed and been repaired and it has been determined that the unit would not be able to function reliably and should be replaced as soon as possible; and WHEREAS, this drive and pump are critical components to managing wet weather flows, and time is of the essence; and WHEREAS, the drive was installed in 1992 and was discontinued by the manufacturer in 1995; and WHEREAS, we have currently standardized on the Allen Bradley Powerflex line of variable frequency drives for the Wastewater Treatment Plant and Liftstations because of availability of parts and service from numerous sources, which allows a competitive process on both parts and service; and WHEREAS, we are informed the delivery time for this piece of equipment is 6 weeks; and WHEREAS, there is significant concern that further delays in replacement of the pump will result from the City's traditional bidding process which threatens damage to the plant's facilities and may endanger the public's health, safety and welfare; and WHEREAS, Section 62.15(1 b), of the Wisconsin Statutes, and Section 12-10(D)2., of the City of Oshkosh Municipal Code, authorize the waiving of bidding requirements for the repair and reconstruction of public facilities when the Board of Public Works (the City Manager, per section 2-20(C) of the City of Oshkosh Municipal Code) determines by resolution that damage or threatened damage creates an emergency in which the public health or welfare of the city is endangered; and WHEREAS, the Superintendent of Utilities has secured quotations from appropriate vendors and the most advantageous quotation appears to be from WW Electric Motors, Inc., N5527 Miranda Way, Fond du Lac, WI 54937, in the amount of$48,550.00, subject to conditions beyond the vendor's control; and WHEREAS, funds for this purpose are available in the Sewer Utility accounts; NOW, THEREFORE, BE IT RESOLVED by the Board of Public Works (City Manager, or designee)that the failure and repair of Influent Pump#3 Variable Frequency Drive with a determination that the unit would not be able to function reliably at the Wastewater Treatment Plant creates an emergency threatening the health, safety and welfare of the city, requiring replacement of said Influent Pump #3 Variable Frequency Drive. BE IT FURTHER RESOLVED that the proper city officials are authorized and directed to waive bids and enter into purchase order with an appropriate contractor to complete all necessary repairs. Money for this purpose is appropriated from Acct No. 551-1946-6426-00000 — Sewer Utility— Maintenance Expense BE IT FURTHER RESOLVED that, once the repairs have been completed and the emergency no longer exists, the Common Council of the City of Oshkosh be asked to approve an appropriate motion pursuant to section 62.15(1b), of the Wisconsin Statutes, declaring an end to the emergency.
