HomeMy WebLinkAboutBoard of Public Works/Waive Bids/Repair Sewer Main APRIL 14, 2011 BOARD OF PUBLIC WORKS CITY OF OSHKOSH, WISCONSIN RESOLUTION PURPOSE: DECLARE EMERGENCY UNDER §62.15(1b), STATS. AND SECTION 12-10 OF THE CITY OF OSHKOSH MUNICIPAL CODE AND WAIVE BIDS & AUTHORIZE REPAIR OF SANITARY SEWER MAIN INITIATED BY: DEPARTMENT OF PUBLIC WORKS WHEREAS, the sanitary sewer pipe in the west terrace of Bowen Street, between Custer Avenue and Tennessee Avenue has failed; and WHEREAS, the root cutter used to clean the line is stuck between manholes due to a failed pipe; and WHEREAS, failed pipe and obstruction of the sanitary sewer main may cause a sanitary sewer backup into nearby homes; and WHEREAS, there is significant concern that further delays in repair of the sanitary sewer line and removal of the root cutter, that will result from the City's traditional bidding process, will endanger the public's health, safety, and welfare; and WHEREAS, Section 62.15(1b), of the Wisconsin Statues, and Section 12-10(D)2., of the City of Oshkosh Municipal Code, authorize the waiving of bidding requirements for the repair and reconstruction of public facilities when the Board of Public Works (the City Manager, per Section 2-20(C) of the City of Oshkosh Municipal Code) determines by resolution that damage or threatened damage creates and emergency in which the public health or welfare of the City is endangered; and WHEREAS, the City Engineer has secured information regarding repairs from an appropriate vendor. NOW, THEREFORE, BE IT RESOLVED by the Board of Public Works (City Manager, or designee) that the failure creates an emergency threatening the health, safety, and welfare of the City, requiring repair to the sanitary sewer main. BE IT FURTHER RESOLVED that once the repairs have been completed and the emergency no longer exists, the Common Council of the City of Oshkosh be asked to approve and appropriate motion pursuant to Section 62.15(1b), of the Wisconsin Statutes, declaring an end to the emergency.
