Box 1130 Oshkosh, 54903-1130 54 City of Oshkosh 903 -113 OfHKOIH April 7, 2011 Mr. Kevin Radloff 2162 James Road Oshkosh, WI 54904 Dear Mr. Radloff: This letter is to confirm the lease agreement for four parcels of land in the South West Industrial Park equating to approximately 78 acres of land at $75.00 per acre. The lease property shall solely be used for agricultural purposes. Lessee has inspected properties and leases them as is. Lessee cannot sublease these parcels. Payment should be sent (78 acres X $75.00 per acre = $5,850 payable to the City of Oshkosh, PO Box 1130, Oshkosh, WI 54903 -1130 by September 1, 2011. As agreed you will lease the land for the term from the date of signing until September 1, 2011. Location descriptions of the four parcels of land are as follows: Parcel 1: A portion of parcel # 1334030000 is approximately 14 acres with a legal description is Lot 3 of Certified Map Number 6090. Actual acreage will be determined by lesser and lessee via GPS measurements from fertilizing and planting operations. Crops on this parcel must be removed no later than September 1, 2011. Parcel 2: A portion of parcel #1334140000 is approximately 13 acres with a legal description of Section 32 /Town 18 North/Range 16 East lying Northwesterly of the railroad right -of -way. Actual acreage will be determined by lessee via GPS measurements from fertilizing and planting operations. Planting operations must stay 50 feet East of the existing sanitary sewer manholes. Crops on this parcel must be removed no later than September 1, 2011. Parcel 3: Parcel #1334140000 is approximately 38 acres with a legal description as NW 1 /4 of the SW 1 /4 of Section 32, Town 18 North Range 16 East. Crops on this parcel must be removed no later than September 1, 2011. Parcel 4: A portion of parcel #1334120000 is approximately 13 acres with a legal description as SW 1 /4 of the NW 1 /4 of Section 32, Town 18 North Range 16 East excluding the West 208.7 fee of the South 417.42 feet. Actual acreage will be ••• • determined by lesser and lessee via GPS measurements from fertilizing and planting operations. Crops on this parcel must be removed no later than September 1, 2011. As part of this lease agreement lessee will protect/hold harmless the City of Oshkosh against any actions, claims or demands of any kind or character arising from use of the land. Lessee further agrees to fully indemnify and refund to the City within 30 days of written demand all such sums the City may obligated to pay on such actions, claims or demands. Should the City of Oshkosh need to access any of the land on these parcels before September 1, 2011, the lessee will be compensated for any crops that are planted on these parcels at a rate of $300 per acre. The City of Oshkosh will not be held liable for any damage incurred to crops on these parcels that are not removed by September 1, 2011. If the City of Oshkosh damages any portion of the crops not removed after September 1, 2011, the lessee will not be responsible for rent payment on the specific acres of land with crop damage. The dates identified in this agreement are firm and time is of the essence.
