THESE CONDITIONS OF APPROVAL MUST BE MET BEFORE YOU EXERCISE THE PRIVILEGE IN THE STREET. On April 28,2009,by resolution#09-140, the City of Oshkosh Common Council approved a privilege in street permit subject to certain conditions that are made a part of the approval resolution.In order for the permit to be valid, each one of these conditions must be satisfied before the permit will be issued through the Public Works Department. To that end, please find enclosed for your signature an Agreement releasing, and holding the City harmless, from all liability arising from your use of the permit. This, along with the insurance filing requirements($200,000/$500,000 limits)are part of state law that enables the City to allow you this use. Kindly return to this office the signed Agreement along with your proof of insurance, either a separate policy or naming the City as an additional insured on your policy. Please execute and return to us as soon as possible. The city is empowered to shut down any activities undertaken before the paperwork is fmished. Direct any questions about insurance and liability releases to this office.Any other questions concerning the remaining conditions should be directed to the Public Works Department at 236-5065. WHEREAS, State law provides that by its acceptance of this privilege the undersigned shall become primarily responsible for damages to person or property by reason of the granting of the privilege; NOW, THEREFORE, in consideration of the City of Oshkosh, a Municipal Corporation granting permission to the undersigned to place an obstruction within the street right -of -way, the undersigned agrees that it is solely responsible for its activities under this agreement. Director of Co unity Development DATE: April 23, 2009 RE: Approve Privilege in Street to KEE Architecture and UW- Oshkosh to Install Geothermal Lines under West Lincoln Avenue, near McKinley Street BACKGROUND /SUBJECT PROPERTY The property is a 5 acre parcel encompassing the entire block bounded by West Lincoln Avenue on the north, Cherry Street on the east, West Irving Avenue on the south and Elmwood Avenue on the west all of which are located within the University of Wisconsin - Oshkosh campus. The parcel is currently developed with multiple institutional uses including two student residence halls and the Elmwood Center office building which is proposed to be expanded and remodeled. ANALYSIS The petitioner is requesting installation of private geothermal lines across West Lincoln Avenue near McKinley Street as part of the expansion project located at 759 Elmwood Avenue. Private 6 -inch geothermal lines will be installed under existing city right -of -way. The Department of Public Works has reviewed the request and recommends approval of the privilege in the street as requested with the condition that the location be approved. FISCAL IMPACT None anticipated. RECOMMENDATION The Plan Commission approved of this request at its April 21, 2009 meeting. Approved, 7e(e.— City Manager ITEM: GRANT PRIVILEGE IN THE STREET FOR PLACEMENT OF GEOTHERMAL PIPING NEAR THE INTERSECTION OF WEST LINCOLN AVENUE AND MCKINLEY STREET Plan Commission meeting of April 21, 2009 GENERAL INFORMATION Petitioner: University of Wisconsin - Oshkosh Owner: City of Oshkosh Action Requested: The petitioner is requesting installation of private geothermal lines across West Lincoln Avenue near McKinley Street. This construction is part of the University's plan for the expansion and remodeling of the Elmwood Center Building located at 759 Elmwood Avenue. Applicable Ordinance Provisions: N/A but any location of a non -city or private utility use in city right -of -way requires issuance of a privilege in street permit. Property Location and Type /Analysis: Private 6 -inch geothermal lines will be installed under existing city right -of -way per the attached illustrations. The Department of Public Works has reviewed the requests and recommends approval of the privilege as requested with the conditions that locations be approved and that the facility be part of and documented with Digger's Hotline system. The Plan Commission approved of the privilege in street as requested with conditions noted. The following is the Plan Commission's discussion on this item. Mr. Nau presented the item and explained that the geothermal lines would connect with geothermal wells that the University would be installing on the site adjacent to the Elmwood Center. He also commented that the conditions in the staff report referred to fiber optic conduit which should have been geothermal lines. Tom Sonnleitner, representative for the University, 800 Algoma Boulevard, explained the details of the new geothermal heat field system being installed as part of the renovation of the Elmwood Center. He further stated that this was the first building of its kind in the state and that he also had members of the design team present if any Commission members had further questions regarding the matter.
