HomeMy WebLinkAbout11-421REVISED SEPTEMBER 13, 2011 11 -421 RESOLUTION CARRIED LOST 0 -6 LAID OVER WITHDRAWN ) PURPOSE: APPROVE PLANNED DEVELOPMENT TO ESTABLISH WATERCRAFT MOTOR SALES AND TRANSIENT BOAT & TRAILER STORAGE AND CONTINUATION OF A SINGLE FAMILY HOME AT 3764 JACKSON STREET INITIATED BY: ROY SCHUMACHER REVOLVING TRUST, PETITIONER PLAN COMMISSION RECOMMENDATION: Denied BE IT RESOLVED by the Common Council of the City of Oshkosh that a planned development to establish antique /vintage boat motor sales within an existing warehouse facility, transient boat and trailer storage within a fenced in area to the north and east of the existing single family home and accessory garage, as well as continuation of the existing single family home at 3764 Jackson Street, per the attached, is hereby approved with the following conditions: 1) A parking plan meeting all standards set forth in Section 30 -36 Off - Street Parking & Loading Facilities shall be submitted to and approved by the Community Development Department prior to establishment of the use. 2) Open storage of inoperable vehicles, parts or other junk/debris is prohibited. 3) Outdoor repair and service, other than within the warehouse, is prohibited. 4) No more than 20 boats /trailers shall be stored on site at any time. 5) Grading and drainage plan be submitted to, and approved by, the Public Works Department prior to establishment of the use. 6) The planned development be reviewed one year from Council approval to determine compliance. 7) A plan be submitted to, and approved by, the Community Development Department, for the hard surfacing of the open storage area prior to establishment of the use. 8) A landscaping plan meeting all standards set forth in Section 30 -35(H) Landscaping shall be submitted to, and approved by, the Community Development Department prior to establishment of the use. • Indicates revision 0 O.IHKOlH ON THE WATER TO: Honorable Mayor and Members of the Common Council FROM: Darryn Burichlr Director of Planning Services DATE: September 8, 2011 RE: Approve Planned Development to Establish Watercraft Motor Sales and Transient Boat & Trailer Storage and Continuation of a Single Family Home at 3764 Jackson Street (Plan Commission recommends denial) BACKGROUND The subject property encompasses 1.47 acres of land that is proposed to be used for antique and classic boat motor sales and transient boat and trailer storage within a fenced outdoor area. The parcel included in this petition contains a warehouse, single - family home and gravel drive and is located on the east side of Jackson Street approximately 250 feet north of Snell Road. The area is a partially developed highway commercial corridor fronting Jackson Street /STH 76 with uses including automobile service stations, automobile sales and a daycare center. Multiple family residential uses exist adjacent to the east. The petitioner purchased the property, which was formerly a moving company with single - family home (originally developed in the Town), and without first securing any zoning approval began operation of a boat service, sales, and transport and storage facility until a correction notice was issued on August 28, 2009. Periodic communication did not result in the discontinuance of the use or correction of violations so a second notice was issued on June 2, 2011, at which time the application for Conditional Use Permit and Development Plan was submitted. The application for a sales and service use was brought before the Plan Commission on August 16, 2011 and was tabled following the petitioners request to change the proposed use to interior motor sales and fenced boat and trailer storage, prior to the start of the Plan Commission meeting. ANALYSIS This request involves the establishment of antique /vintage boat motor sales within the existing warehouse facility and transient boat and trailer storage within a fenced in area as well as the continuation of the single - family home use. There will not be any outside servicing, salvage or sales of inoperable vehicles outdoors however trailers and boats will be stored outside. Improvements to the site are proposed to be the addition of 20,000 square feet of gravel storage area and drive aisle with both wall and ground signage. The previously proposed sales and service business use was compatible with the highway business corridor on Jackson Street however the outdoor storage use is not consistent with the existing and planned commercial corridor. There is concern with this request as operations have taken place on the lot since it has been under the current ownership without approval or permits even after correction notices were issued. Also storage of unlicensed inoperable vehicles and open storage of junk and debris on the premises suggests that if the PD would receive approval, this type of storage should be limited to within a structure or prohibited altogether and a one year review of the use be conducted to determine compliance. The other concern is the omission of any permanent improvements to the property such as landscaping, hard surfacing and other code requirements addressed by new developments in this area and the incompatibility with adjacent uses one of which has submitted a letter of opposition to the proposed use that has characterized the site as being a "junk yard ". Staff is concerned that the property has been and will be used as a junk yard for recreational vehicles and other equipment as this has been the city's experience with this property. Prior to the applicant's making the application for the CUP /PD approval, boats, trailers, parts, tires, building materials, windows etc. were stored openly and randomly on the site and in full view from the right -of -way along Jackson Street and to the adjacent property owners. After the applications were made some of the junk and debris were cleaned up or removed from the site (presumably to his two other sites in the area located in the town) but the concern still remains about the use looking and becoming a junk yard along a major arterial into the City. FISCAL IMPACT None anticipated. RECOMMENDATION The Plan Commission denied this request at its September 6, 2011 meeting. Approved, City Manager ITEM: PLANNED DEVELOPMENT APPROVAL FOR ANTIQUE /CLASSIC BOAT MOTOR SALES AND SCREENED OUTDOOR STORAGE OF TRANSIENT BOATS AND TRAILERS ALONG WITH A SINGLE - FAMILY HOME USE AT 3764 JACKSON STREET Plan Commission meeting of September 6, 2011 GENERAL INFORMATION Applicant/Property Owner: Roy J. Schumacher Rev. Trust Action(s) Requested: The applicant is requesting Development Plan Approval to establish watercraft motor sales and transient boat and trailer storage use and the continuation of the single - family home use at 3764 Jackson Street. Applicable Ordinance Provisions: The C -1 Neighborhood Business District allows interior sales of motors as a permitted use but does not permit any type of outdoor storage either as a permitted use or conditional use. However, as this site is governed by the Planned Development Overlay District, a Development Plan could be approved allowing such a use if it meets the criteria and guidelines for Planned Developments located in Section 30 -33 (A) of the Zoning Ordinance. Additional Planned Development approval must be given to allow the existing single - family home use and proposed light industrial and commercial uses on the same lot. The applicant has stated that there will not be any outside servicing, salvage or storage of inoperable vehicles on the lot (outside of the warehouse) however trailers and boats will be stored /parked outside. The petitioner indicates on the submitted site plan that site improvements as part of this PD would include the addition of approximately 20,000 square feet of gravel storage area and drive aisles. The application also includes the request to add a 4 X 8 foot wall sign (32 square feet) on the warehouse structure west facade and the inclusion of a 4 X 8 foot ground sign (32 square feet /64 square feet total) along the Jackson Street right -of -way. Staff was previously in support of sales and service business uses at this location, with the condition of compliance with Municipal Code requirements for sales and service operations including but not limited to impervious surfacing, setbacks and screening being instituted. The sales use is compatible with the highway business corridor on Jackson Street and was felt to be consistent with other commercial (non- industrial) uses such as the Car Credit Center across the street at 3815 Jackson Street and the automobile service stations at 3700 and 3785 Jackson. The proposed outdoor storage use, even if located behind a fence, is not a compatible or consistent use with the existing and planned Jackson Street commercial corridor. To further emphasize this point, the underlying zoning designation of C -1 Neighborhood Commercial does not allow outdoor storage as a permitted or conditional use, forcing the applicant to make the request through PD approval. Additionally, the PD is necessary to allow the use of a single- family home and light industrial /commercial uses to coexist on the same parcel at the same time, which is not permitted in the Zoning Ordinance. As mentioned in the previous request, there is also concern with this particular PD request based on the operations that have taken place on the lot since it has been under the current ownership as code violations including the establishment and continuation of the transport and open storage use without approval or permits even after correction notices were issued, storage of unlicensed inoperable vehicles on grass and within setbacks, open storage of junk and debris on the premises and within the right -of -way (see attached photos). The city has and continues to deal with several properties throughout the community being used for inappropriate outside storage and quasi - salvage operations and suggests that if the Plan Commission and Common Council decide to approve the PD, that repair /storage of inoperable vehicles be limited to within a structure or be prohibited altogether, a one year review of the use be conducted to determine compliance with code requirements and storage of inoperable vehicles, parts or other junk/debris outside of structures be prohibited. The other concern staff has with this proposal is the omission of any permanent improvements for the property (other than fencing) to bring the property up to code requirements relative to landscaping, hard surfacing, stormwater, etc. like other new developments in this area have had to adhere to. Lack of improvement to the property conflicts with the PD regulations that seek to promote better development through "utilization of site planning principles common to high quality development ", for which this proposal is lacking at this time and as proposed. Furthermore, developments within PD's are supposed to be compatible with adjacent uses and with the character of the general area. As the city has received a letter of opposition from the owners of the adjacent residential properties to the east characterizing the development as a ``junk yard ", staff cannot be supportive of the proposal in its current form. RECOMMENDATION /CONDITIONS Based on the information provided in the application, historic issues at the site and information contained in the staff report, staff recommends denial of the PD request for transient boat and trailer storage on the site. The Plan Commission denied the planned development request as recommended. The following is the Plan Commission's discussion on this item. The applicant is requesting Development Plan Approval to establish watercraft motor sales and transient boat and trailer storage use and the continuation of the single - family home use at 3764 Jackson Street. Mr. Burich presented the item and explained that the request was tabled at the last meeting due to the petitioner changing his request for the proposed use. He reviewed the site and surrounding area as well as the zoning classifications and land use in said area and explained that the petitioner is now requesting to store boats and trailers on the site rather than sales and service. He reviewed the revised site plan submitted and explained the history of the site and discussed staff's concerns with the proposed use. The petitioner is not proposing any improvements to the site and staff is concerned with the future use of the property and the condition of the site. An adjacent property owner has submitted an objection to the proposed use as it is not adequately maintained and looks like a junk yard. Mr. Borsuk questioned why it took two years for the second correction notice to be issued to the property owner after the initial notice had been issued and the violations not corrected. Mr. Burich responded that he was not sure how the process proceeded but the unpermitted use on the site has intensified over time. Item -3764 Jackson St —PD: Motor Sales /Boat Storage Mr. Thorns stated that the staff report discusses both sales and storage and questioned if staff found either use acceptable. Mr. Burich replied that staff was recommending denial of the entire request. Roy Schumacher, 3764 Jackson Street, stated that this was a hobby business for him and that he has always had boats on the site. He wants to store 5 -6 boats that are his personal property in addition to some trailers. He further stated that the Pioneer Marina will take some of the items off his site but he would still be storing his personal boats and approximately 12 trailers on the property and he has finished off an area for the proposed storage. Mr. Hinz questioned if the request was denied today, if the petitioner could resubmit another application in the future as his proposed use seems to keep changing. Mr. Burich responded that the request will proceed to the Common Council next week for review and if denied at that level, he could come back to the Plan Commission with another application at a later date. Mr. Thorns inquired if the city has an ordinance that prevents storage of personal boats. Mr. Burich replied that the City's ordinance requires that personal boats must be stored in a code compliant parking area for residential properties however this site is not zoned residential, it is zoned C -1 Neighborhood Business District which has different requirements. He also noted that the signage the petitioner was requesting for the site appears to be for a business related use. Motion by Vajgrt to approve the planned development to allow for antique /classic boat motor sales and screened outdoor storage of transient boats and trailers along with a single-family home use at 3764 Jackson Street as requested. It consistently looks like a junkyard and the cars and trailers are not displayed in an appealing manner. It is a disgrace to have this located on one of the main arteries going into Oshkosh. We do not want this behind our apartment buildings.
