HomeMy WebLinkAbout11-397SEPTEMBER 13, 2011 11 -397 RESOLUTION (CARRIED 6 -0 LOST LAID OVER WITHDRAWN ) PURPOSE: GRANT PRIVATE UTILITY EASEMENT AT NORTHWEST CORNER OTTER AVENUE & STATE STREET WITHIN THE OTTER AVENUE PARKING LOT INITIATED BY: PUBLIC WORKS DEPARTMENT PLAN COMMISSION RECOMMENDATION: Approved BE IT RESOLVED by the Common Council of the City of Oshkosh that the proper City officials are hereby authorized and directed to grant a utility easement to allow appropriate city staff to coordinate with private utility companies regarding the installation of various private utilities within the Otter Avenue Parking Lot, per the attached, and the proper City officials are hereby authorized and directed to execute any and all documents necessary for purposes of same. 0 O.IHKOIH ON THE WATER TO: Honorable Mayor and Members of the Common Council FROM: Darryn Burich�� =T Director of Planning Services DATE: September 8, 2011 RE: Grant Private Utility Easement at the Northwest corner Otter Avenue & State Street Within the Otter Avenue Parking Lot (Plan Commission recommends approval) BACKGROUND The subject site is at the northwest corner of Otter Avenue and State Street. The property is a city - owned public parking lot located in downtown Oshkosh. The surrounding area is a mix of commercial and residential uses. ANALYSIS The Otter Street parking lot is scheduled for reconstruction later this year which prompted WPS to evaluate its facilities at the site. After their review, WPS is proposing to reconfigure and update its service to the lot which will result in a reduction of utility poles and overhead lines at the site. The proposed ten -foot wide easement will be located along the west and north side of the property and will not interfere with the reconstruction of the parking lot. This utility easement may also accommodate other facilities in addition to WPS. The Department of Public Works and City Attorney will work with Wisconsin Public Service and possibly other companies to have appropriate easement documents signed and recorded at the Winnebago County Register of Deeds. FISCAL IMPACT None anticipated. RECOMMENDATION The Plan Commission approved of this request at its September 6, 2011 meeting. Approved, City Manager ITEM: GRANT PRIVATE UTILITY EASEMENT AT THE NORTHWEST CORNER OF OTTER AVENUE AND STATE STREET (OTTER STREET PARKING LOT) Plan Commission meeting of September 6, 2011 GENERAL INFORMATION Petitioner: Wisconsin Public Service Corporation Owner: City of Oshkosh Action Requested: Wisconsin Public Service Corporation (WPS) is requesting the city to grant a private utility easement at the Otter Avenue parking lot. RE COMMENDATION /CONDITIONS Staff recommends granting the proposed private utility easement as requested. The Plan Commission approved of the proposed easement as requested. The following is the Plan Commission's discussion on this item. Mr. Nau presented the item and reviewed the site and surrounding area. He explained that the staff report referred to WPS as the only party who would be utilizing the easement area however other companies with utilities in that location may also do so. The Otter Street parking lot is scheduled for reconstruction later this year which has prompted the request as it gives the companies an opportunity to relocate utilities and reduce the overhead lines in the area. Mr. McHugh questioned what will be buried in the easement area. Steve Gohde, Assistant Director of Public Works, replied that the easement would allow WPS to replace out dated equipment and eliminate some overhead lines from the site. Motion by Vajgrt to approve the consent agenda. Seconded by Borsuk.
