A-) QJW0fH ON THE WATER TO: Honorable Mayor and Members of the Common Council FROM: Darryn Burich Director of Planning Services DATE: September 8, 2011 RE: Accept Storm Sewer & Drainage Easement at 1035 Maricopa Drive / Lawrence Sobolik & Vicki Krause, owners (Plan Commission recommends approval) BACKGROUND The subject site is located on the southwest side of Maricopa Drive between W. 9 th Avenue and Viking Place in the Westhaven Subdivision. The land use in the immediate area is predominately single - family residential with exception of Westhaven Golf Course to the south and west. ANALYSIS The proposed easement is a 15 -foot by 19 -foot, 285 square foot area located adjacent to the public sidewalk at the northeast corner of the property. Neighborhood drainage from the surrounding area causes water to collect and flow across the public sidewalk in front of 1035 Maricopa Drive causing a potential hazard and nuisance. The Department of Public Works proposes to construct a yard drain behind the public sidewalk to collect runoff and enter the city's storm sewer. Construction will be part of the city's mini- storm/storm sewer contract for 2011. The Department of Public Works and City Attorney will work with the property owners to have appropriate easement documents signed and recorded at the Winnebago County Register of Deeds. FISCAL IMPACT None anticipated. RECOMMENDATION The Plan Commission approved of this request at its September 6, 2011 meeting. Approved, City Manager ITEM: ACCEPT STORM SEWER AND DRAINAGE EASEMENT AT 1035 MARICOPA DRIVE Plan Commission meeting of September 6, 2011 GENERAL INFORMATION Petitioner City of Oshkosh Department of Public Works Owner: Lawrence Sobolik & Vickie Krause Action Requested: The Department of Public Works is requesting the acceptance of a storm sewer and drainage easement to allow construction of a yard drain and storm sewer. RECOMMENDATION /CONDITIONS Staff recommends approval of the acceptance of the proposed storm sewer and drainage easement as requested. The Plan Commission approved of the proposed easement as requested. The following is the Plan Commission's discussion on this item. Mr. Nau presented the item and reviewed the site and surrounding area and explained the reasoning for the easement request. There was no discussion on this item. Motion by Vajgrt to approve the consent agenda. Seconded by Borsuk. Motion carried 9 -0. Accept Storm Sewer and Drainage Easement Lawrence Sobolik & Vicki Krause and the City of Oshkosh 1035 Maricopa Drive Project Narrative Neighborhood drainage in the vicinity of 1035 Maricopa Drive currently causes water to flow across the public sidewalk, and down the sidewalk to the nearest driveway. Drainage from a fairly large area behind the properties along Maricopa drains through the property at 1035 Maricopa Drive. This drainage pattern creates a nuisance and hazard on the public sidewalk in front of 1035 Maricopa Drive. The property owners contacted the Department of Public Works to evaluate alternatives to mitigate the nuisance and hazard. In order to provide a reasonable mitigation of these issues, the Department of Public Works proposes to install an yard drain behind the public sidewalk to capture runoff and convey it to the storm sewer system prior to the runoff reaching the public sidewalk. The purpose of the easement is to provide for drainage and storm sewer system conveyance. A yard drain and storm sewer will be installed, and the area will be graded to drain to the yard drain. The work will be performed in conjunction with the City's Mini -Storm / Storm Lateral contract in 2011.
