HomeMy WebLinkAbout11-394SEPTEMBER 13, 2011 11 -394 ORDINANCE FIRST READING (CARRIED LOST LAID OVER WITHDRAWN ) PURPOSE: APPROVE REZONING OF PROPERTIES AT 302 -304 OHIO STREET FROM C -2 GENERAL COMMERCIAL TO C -2 GENERAL COMMERCIAL WITH A PLANNED DEVELOPMENT OVERLAY INITIATED BY: OSH INC, PETITIONER A GENERAL ORDINANCE OF THE CITY OF OSHKOSH AMENDING SECTION 30 -16 (B) OF THE OSHKOSH MUNICIPAL CODE PERTAINING TO ZONING DISTRICTS. The Common Council of the City of Oshkosh do ordain as follows: SECTION 1. That Section 30 -16(B) of the Oshkosh Municipal Code pertaining to Zoning Districts and the map therein described is hereby amended by changing the district character of the following described area from C -2 General Commercial to C -2 General Commercial with a Planned Development Overlay. Unit 302 A, B, C, D, E, F, & G; also Unit 304, all in Ohio Street Condominium and the interests in the common elements in Doc. No. 818361, Register of Deeds, all in the 6th Ward, City of Oshkosh, Winnebago County, Wisconsin, plus public right -of -way abutting said lots extending to the centerline of Ohio Street. SECTION 2. This Ordinance shall be in full force and effect from and after its passage and publication. SECTION 3. Publication Notice. Please take notice that the City of Oshkosh enacted Ordinance #11 -XXX APPROVE REZONING OF PROPERTIES AT 302 -304 OHIO STREET FROM C -2 GENERAL COMMERCIAL TO C -2 GENERAL COMMERCIAL WITH A PLANNED DEVELOPMENT OVERLAY on September 27, 2011. Created by - D 0 Rezone From C -2 ,fHK .fH To C - 2 PD ON THE warF City of Oshkosh Department of Scale: 1" - 300' Community Development 8/29/11 0 OfHKOfH ON THE WATER TO: Honorable Mayor and Members of the Common Council FROM: Darryn BuricllN� Director of Planning Services DATE: September 8, 2011 RE: Approve Rezoning the Properties at 302 -304 Ohio Street From C -2 General Commercial to C -2 General Commercial with a Planned Development Overlay (Plan Commission action 9/20/11) BACKGROUND The property owner at 300 -304 Ohio Street (Ron Detjen, ImproMed, LLC) is proposing a development project that will involve construction of a new 14,000 square foot 2 story office building and related surface improvements that will involve partial acquisition of the adjacent property to the north at 290 Ohio Street. The planned acquisition will involve reconfiguration of the property lines and parking areas between the two properties that will create a 0 foot setback through the new parking lot. The property at 290 Ohio Street is zoned C -2 PD and the subject property of this zone change is zoned C -2. The City does not permit the creation of "split zoned" parcels so a zone change request to add the PD overlay designation has been requested by the applicant for his property. As the property owners involved in the request would like to expedite acquisition of the property and subsequent ground breaking for the new development by the end of September the first reading or public hearing is being requested at this time to permit final reading and action by the Council at its September 27` meeting. Additionally, Council will be considering the PD review for the proposed development at that meeting. Staff has notified the adjacent property owners of the zone change request and public hearing before the Council and will consider any comments received at the public hearing when developing its recommendation to Plan Commission and Common Council. ANALYSIS Adding the PD overlay to the base zone C -2 General Commercial zone is consistent with the other zoning in the area to the north that is part of the Excelsior/Badger redevelopment district and also doesn't violate City's prohibition about creating a split zoned parcel. FISCAL IMPACT None anticipated. RECOMMENDATION Public hearing only, no action is being taken.
