A GENERAL ORDINANCE OF THE CITY OF OSHKOSH CREATING SECTION 2 -47
PERTAINING TO CREATION OF A PUBLIC ARTS ADVISORY COMMITTEE
The Common Council of the City of Oshkosh does ordain as follows:
SECTION 1. That Section 2-47 of the Oshkosh Municipal Code pertaining to the
creation of a Public Arts Advisory Committee is hereby created to read as follows:
SECTION 2 -47 PUBLIC ARTS ADVISORY COMMITTEE
(A) Membership and Terms
The Public Arts Advisory Committee shall be composed of five (5) voting members
consisting of: Two (2) citizen members, one (1) Plan Commission member, one (1)
Landmark Commission member and one (1) Council Member. The Director of
Community Development or designee shall serve as coordinator and recording
secretary for the Committee. There shall also be appointed two (2) alternate
members, who shall be authorized to act in the place of any member who is unable
to attend a meeting. Citizen members shall serve three (3) year terms. In addition
to these voting members, the Director or his/her designee of the Paine Art Center
and Gardens and the Director or his /her designee of the Oshkosh Public Museum
and Oshkosh Public Library shall be advisory members of the Committee.
(B) Purpose, Duties and Functions: The Public Arts Advisory Committee shall
have the responsibility to:
1. Advise the Common Council on Gifts or donations of public art pursuant to
the City of Oshkosh Gifts and Donations Policy.
2. Advise the Common Council on Public Murals and Art.
3. Act upon appeals under the City's Mural ordinance.

SECTION 2. This ordinance shall be in full force and effect from and after its
passage and publication.
SECTION 3. Publication Notice.
Please take notice that the City of Oshkosh enacted ordinance #11 -XXX CREATE
PUBLIC ARTS ADVISORY COMMITTEE, on September 13, 2011. The ordinance
creates a Public Arts Advisory Committee to advise Council upon gifts or donations
of public art, public murals and art and to act as an appeals board under the City's
mural ordinance.

BACKGROUND
On March 8, 2011, the Common Council passed the gift policy which, in part,
anticipated the creation of a Public Arts Advisory Committee to review and make
recommendations to the Plan Commission and Council regarding works of art,
including statues, monuments, memorials, tributes, sculptures, graphics and
signs. At that time staff was also working on a draft ordinance for murals and it
was anticipated that the Public Arts Advisory Council may play a role in the
review of proposed murals as well. Therefore, creation of the Public Arts
Advisory Committee was delayed to allow for consideration of the committee's
potential role under the proposed mural ordinance. The mural ordinance is now
ready for Council consideration, so it is appropriate to also bring forward the
ordinance to create the Public Arts Advisory Committee.
ANALYSIS
The Public Arts Advisory Committee was originally proposed in connection with
the City's gift policy which was adopted by Council earlier this year. At that time
staff was also working toward bringing forward a mural ordinance and had
identified a potential role for a citizen committee in the mural review process.
The proposed ordinance would establish a five (5) member committee consisting
of two (2) citizen members, one (1) plan commission member, one (1) landmarks
commission member and one (1) Council member. The proposed legislation
would also provide for the appointment of two (2) alternate members. In addition,
the Director of the Paine Art Center and Gardens, the Oshkosh Public Library
and Oshkosh Public Museum would serve in an advisory capacity to the
Committee. The committee would be staffed by the Department of Community
Development and would meet on an as- needed basis. The committee's
responsibilities would be to advise the Common Council on murals and public art
and upon gifts or donations of public art pursuant to the City of Oshkosh Gifts
and Donations Policy. In addition, the committee would act as the appeals board
for determinations by the Director of Planning Services under the mural
ordinance.
FISCAL IMPACT
There is no anticipated fiscal impact from the creation of this advisory committee.
RECOMMENDATION
Staff recommends that the Council pass the ordinance creating a Public Arts
Advisory Committee for the purposes designated therein.
