HomeMy WebLinkAbout11-368AUGUST 23, 2011 11 -368 RESOLUTION (CARRIED 6 -0 LOST LAID OVER WITHDRAWN ) PURPOSE: ACCEPT EASEMENT FROM OSHKOSH AREA SCHOOL DISTRICT BETWEEN 1400 & 1412 WEST 9TH AVENUE ON FRANKLIN SCHOOL PROPERTY AT 1401 WEST 5TH AVENUE INITIATED BY: DEPARTMENT OF PUBLIC WORKS PLAN COMMISSION RECOMMENDATION: Approved BE IT RESOLVED by the Common Council of the City of Oshkosh that the proper City officials are hereby authorized and directed to accept a sidewalk easement from the Oshkosh Area School District on the Franklin School property on West 9th Avenue, per the attached, and to execute any and all documents necessary for purposes of same. O.IHKOlH ON THE WATER TO: Honorable Mayor and Members of the Common Council FROM: Darryn Buri Director of Tanning Services DATE: August 18, 2011 RE: Approve Sidewalk Easement at the 1400 Block of W. 9 1h Avenue (Plan Commission recommends approval) BACKGROUND The subject site is a 53.78 -foot strip of land located between 1400 and 1412 W. 9 th Avenue and is part of the Franklin Elementary School property (1401 W. 5 th Avenue). With exception of the school and a flower shop to the southeast of the site, the land use in the area is predominately single - family residential. ANALYSIS The proposed easement is an approximately five -foot by 53.78 -foot strip along the north side of the 1400 block of W. 9 th Avenue. The site serves as a pedestrian access to the school, as well as vehicular access for the single family residence at 1412 W. 9 th Avenue. The easement is needed to allow the construction of an ADA- compliant wheelchair ramp leading from the street onto the public sidewalk and school property. The construction of the ramp will not interfere with vehicular access to 1412 W. 9 th Avenue residence. The Department of Public Works and City Attorney will work with the Oshkosh Area School District to have appropriate easement documents signed and recorded at the Winnebago County Register of Deeds. FISCAL IMPACT None anticipated. RECOMMENDATION The Plan Commission approved of this request at its August 16, 2011 meeting. Approved, ,_KK_ City Manager ITEM: ACCEPT SIDEWALK EASEMENT AT THE 1400 BLOCK OF W. 9TH AVENUE (FRANKLIN ELEMENTARY SCHOOL) Plan Commission meeting of August 16, 2011 GENERAL INFORMATION Petitioner City of Oshkosh Department of Public Works Owner: Oshkosh Area School District Action Requested: The Department of Public Works is requesting the acceptance of a sidewalk easement to allow construction of an ADA- compliant wheelchair ramp. RECOMMENDATION /CONDITIONS Staff recommends approval of the acceptance of the proposed easement as requested. The Plan Commission approved of the acceptance of the easement as requested. The following is the Plan Commission's discussion on this item. Mr. Nau presented the item and reviewed the site and surrounding area and explained the purpose for the easement request. Mr. Vajgrt inquired how it would affect the driveway that was located there. Mr. Nau replied that it would be handled by an agreement between the Oshkosh Area School District and the property owner adjacent to the site at 1412 W. 9 Avenue. Motion by Vajgrt to approve the sidewalk easement at the 1400 block of W. 9th Avenue as requested. Seconded by Cummings.
