PURPOSE: APPROVE AGREEMENT WITH WISCONSIN PUBLIC SERVICE
CORPORATION FOR SIDEWALK REPLACEMENT ON VARIOUS
CONCRETE PAVING PROJECTS
INITIATED BY: PUBLIC WORKS DEPARTMENT
BE IT RESOLVED by the Common Council of the City of Oshkosh that the attached
Agreement with Wisconsin Public Service Corp. for the replacement of sidewalk which is
removed to accommodate utility relocation work on various concrete paving projects, is
hereby approved and the proper City officials are authorized to execute and deliver the
agreement in substantially the same form as attached hereto, any changes in the
execution copy being deemed approved by their respective signatures, and said City
officials are authorized and directed to take those steps necessary to implement the terms
and conditions of the Agreement.

RE: Approve Agreement with Wisconsin Public Service for Sidewalk Replacement on Various
Concrete Paving Projects.
BACKGROUND
During the reconstruction of streets�Wisconsin Public Service (WPS) typically performs a variety of utility
upgrades and replacements to the electrical and gas systems. These upgrades often require the removal
and replacement of sidewalk sections. In the past, WPS has hired a contractor to replace these sidewalk
sections. This has resulted in coordination issues during the restoration of the sidewalk. Additionally,
WPS typically pays a significantly higher price for the work.
ANALYSIS
Coordinating the replacement of the sidewalk by one contractor will provide a better end product for the
citizens. The projects will be able to be completed in a more efficient manner and fewer construction
joints in the sidewalk will improve its durability.
FISCAL IMPACT
WPS will pay for the costs of replacing any sidewalk sections removed for their work, including a 6% fee
for the City to perform the inspection of the work.
RECOMMENDATIONS
I recommend approval of the agreement with WPS.

AGREEMENT FOR SIDEWALK REPLACEMENT /RECONSTRUCTION
THIS AGREEMENT, made on the day of , 2011, by and
between the CITY OF OSHKOSH, hereinafter referred to as CITY, and Wisconsin Public
Service, , hereinafter
referred to as WPS,
The City and WPS, for the consideration hereinafter named, agree as follows:
ARTICLE I. SCOPE OF WORK
When relocation of utilities is necessitated by City construction or reconstruction
projects and sidewalk sections need to be removed solely to accommodate the utility
relocation work, City hereby agrees to furnish all of the materials and all of the equipment
and labor necessary to replace /reconstruct those sidewalk sections required to be
replaced /reconstructed to accommodate the utility relocation work.
Prior to the commencement of the project, the City and WPS will work together to
identify those sections of sidewalk which will be removed as a part of the City project and
those additional sidewalk sections required to be removed solely to accommodate the
utility relocation work. To the extent that the WPS work falls within the area of sidewalk
that will be removed as a part of the City project, WPS will not be required to pay for
replacement or reconstruction of those sections of sidewalk.
In the event the work performed to accommodate the utility relocation is outside the
work limits for the City's project, the City may elect not to replace /reconstruct the sidewalk.
WPS shall ensure the sidewalk is repaired /replaced to City Standards in these locations
ARTICLE II. INVOICE/ PAYMENT
The City will invoice WPS for the City's costs to replace /reconstruct those sidewalk
sections necessary to accommodate the utility relocation work. This cost shall be
calculated based on the bid price per square foot for sidewalk under the City's contract with
a third party for the replacement/reconstruction of sidewalk for the project plus a 6%
inspection fee.
WPS shall pay such invoice within 30 days of the date of the invoice.
ARTICLE III. Termination of Agreement
The Agreement shall be in effect for 2011 City construction projects.

to be sealed with its corporate seal and to be subscribed to by its City Manager and City
Clerk and countersigned by the Comptroller of said City, and the party of the second part
hereunto set its, his or their hand and seal the day and year first above written.
