HomeMy WebLinkAbout11-279JUNE 28, 2011 11 -279 RESOLUTION (CARRIED 7 -0 LOST LAID OVER WITHDRAWN ) PURPOSE: GRANT UTILITY EASEMENT TO WISCONSIN PUBLIC SERVICE CORPORATION WITHIN THE LAKESHORE MUNICIPAL GOLF COURSE AT 2175 PUNHOQUA STREET NEAR USH 41 AND RATH LANE INITIATED BY: WISCONSIN PUBLIC SERVICE CORPORATION, PETITIONER PLAN COMMISSION RECOMMENDATION: Approved w /condition BE IT RESOLVED by the Common Council of the City of Oshkosh that the proper City officials are hereby authorized and directed to grant a utility easement to Wisconsin Public Service Corporation on the Lakeshore Municipal Golf Course property at 2175 Punhoqua Street, near USH 41 and Rath Lane, per the attached, with the condition that if the City requires the utilities to be relocated, it will be at the expense of Wisconsin Public Service. The 107 acre property is bounded by U.S. Highway 41 to the west, Rath Lane & Oshkosh Avenue to the south, Punhoqua Street to the east and Lake Butte des Morts to the north. ANALYSIS Wisconsin Public Service is requesting a 12 foot wide private utility easement located on the southwest corner of Lakeshore Municipal Golf Course which follows the property line running west from Rath Lane and continuing north and west to the U.S. Highway 41 right -of -way. The purpose of the easement is to underground utilities and for future extension to utilities located along Highway 41. The Advisory Park Board unanimously recommended approval of the request and the Parks Department and City Attorney will work with Wisconsin Public Service to have appropriate easement documents signed and recorded at the Winnebago County Register of Deeds. If the City would require relocation of any of the utilities in the future, it would be at the expense of the petitioner. FISCAL IMPACT None anticipated. RECOMMENDATION The Plan Commission approved of this request at its June 21, 2011 meeting. Approved, C ty Manager ITEM: GRANT PRIVATE UTILITY EASEMENT AT 2175 PUNHOQUA STREET (MUNICIPAL GOLF COURSE) Plan Commission meeting of June 21, 2011 GENERAL INFORMATION Petitioner: Wisconsin Public Service Corporation Owner: City of Oshkosh Action Requested: Wisconsin Public Service Corporation is requesting a private utility easement located at the southwest corner of Lakeshore Municipal Golf Course. Applicable Ordinance Provisions: N/A Property Location and Type /Analysis: The subject property is the site of Lakeshore Municipal Golf Course and Mary Jewel Park. The 107 acre property is bounded by U.S. Highway 41 to the west, Rath Lane & Oshkosh Avenue to the south, Punhoqua Street to the east and Lake Butte des Morts to the north. The easement is proposed to be 12 feet wide and follows the property golf course property line, running west from Rath Lane approximately 171 feet, then north approximately 225 feet, then west approximately 225 feet to the U.S. Highway 41 right -of -way. The purpose of the easement is for underground utilities and for future extension to utilities located along Highway 41. There is an existing transformer directly to the north of the hotel property that services a portion of the Lakeshore Golf Course currently and will be included in this easement. WPS is planning for future utility needs and the future connection to the Hwy 41 corridor area. The Advisory Park Board considered this request on June 13 and unanimously recommended approval. The Parks Department and City Attorney will work with Wisconsin Public Service to have appropriate easement documents signed and recorded at the Winnebago County Register of Deeds. RECOMMENDATION /CONDITIONS Staff recommends granting of the proposed private utility easement as requested. The Plan Commission approved of the easement as requested. The following is the Plan Commission's discussion on this item. Mr. Nau presented the item and reviewed the site and surrounding area as well as the easement location and explained that the easement request was for the placement of underground utilities. He further stated that the Parks Advisory Board unanimously approved of this request and a condition was recommended to be added that if the City needs any of the utilities to be relocated, it would be at the expense of the petitioner. Mr. Thorns questioned what effect it would have on the hotel adjacent to the site. Mr. Nau responded that it would not have any impact on that property. Motion by Nollenberger to approve granting a private utility easement at 2175 Punhoqua Street (Municipal Golf Course) as requested with the following condition: 1) If the City requires any utilities to be relocated, it would be at the expense of the petitioner.
