Grant Variances to the Municipal Code for Excessive Noise (Section 15 -18) & Street to Remain
Open to Traffic (Section 25 -22) to the WisDOT for Pavement Marking Work at the Jackson Street/
Murdock Avenue Intersection
BACKGROUND
The Wisconsin Department of Transportation (WisDOT) reconstructed the intersection of Jackson Street (STH 76)
and Murdock Ave (STH 45) in 2010. As part of the construction, pavement marking tape was placed to delineate
the cross walks, lane lines, yield symbols and directional arrows. Immediately upon opening the intersection to
traffic, the marking tape began to fail. Temporary repairs were made last fall. The WisDOT has worked with the
supplier and contractor that installed the tape on a solution and means to have the marking repaired.
The supplier, 3M, has agreed to repair /replace the failed markings. The process involved will include sandblasting
the existing markings and re- installation of the product. Due do the traffic volumes on these roadways the repair
work is scheduled to be completed at night between the hours of 9:00 pm and 5:00 am. Due to traffic volumes and
roundabout configuration making the repairs under traffic is not a safe alternative. It is anticipated the work will
take two or three nights to complete. The work will be scheduled as soon as possible; it is likely the work will be
completed the week of June 27 , if approved.
The WisDOT will have a detour route posted during the closure. The detour route will be Packer Avenue, Harrison
Street, Main Street and Irving Avenue. A press release will be issued prior to closure.
ANALYSIS
The night work will require a variance to the Noise Ordinance, Section 15 -18. The section prohibits construction
between the hours of 10 pm and 7 am. Closure of the roads requires a variance to the Street to Remain Open to
Traffic Ordinance, Section 25 -22. The combination of the night work and closure of the roads will allow for the
least impact to the traveling public and the safest alternative for the repair crew to complete the work.
The proposed detour route is on designated truck routes through the City. The route is the most direct route
around the closed intersection and will help prevent truck traffic from using the non -truck routes.
FISCAL IMPACT
There is no cost to the City of Oshkosh for the proposed repairs.
RECOMMENDATIONS
I recommend allowing the night work for construction and closure of Murdock Avenue and Jackson Street
intersection.
