PURPOSE: ACCEPT VARIOUS EASEMENTS FROM UW- OSHKOSH /BOARD
OF REGENTS RELATING TO CONSTRUCTION OF NEW
RESIDENCE HALL AND PEDESTRIAN MALL IN THE ALGOMA
BOULEVARD /ELMWOOD AVENUE AREA

PLAN COMMISSION RECOMMENDATION: Approved
BE IT RESOLVED by the Common Council of the City of Oshkosh that the
proper City officials are hereby authorized and directed to accept necessary easements
from UW- Oshkosh /Board of Regents for the following purposes:
600 Block of Elmwood Avenue: easement to allow public sidewalk to jog onto
University property to accommodate short -term parking stalls along Elmwood
Avenue.
Corner of Elmwood Avenue and Algoma Boulevard: easement to construct code
compliant wheelchair ramp in the pedestrian street crossing.
West Lincoln Avenue: easement for construction of public sidewalk on University
property.
Elmwood Avenue: two easements to allow construction of a cul -de -sac bulb on
Elmwood Avenue, north of proposed pedestrian mall.
BE IT FURTHER RESOLVED that the proper City officials are authorized and
directed to execute any and all documents necessary for purposes of same.

BACKGROUND
The subject site is the location of the new residence hall currently under construction and a section of
Elmwood Avenue which will be converted into a pedestrian mall as approved by the Common
Council. All lands are under ownership of the University of Wisconsin Oshkosh and they are
requesting the city to accept five easements in relation to these projects.
ANAT NSIS
The first easement is along the west side of the 600 block of Elmwood Avenue in front of the new
residence hall to allow the public sidewalk to "jog" onto University property to accommodate short-
term parking stalls. The second easement request is located at the corner of Elmwood Avenue and
Algoma Boulevard to provide adequate space for a proper wheelchair ramp in the street crossing. The
third easement is to allow construction of public sidewalk on West Lincoln Avenue as it is too narrow
to provide adequate area for terrace space and sidewalk within the right -of -way. The fourth and fifth
easements are to allow for the construction of a cul -de -sac bulb on Elmwood Avenue just north of the
pedestrian mall. The Department of Public Works and City Attorney will work with the property
owner to have appropriate easement documents signed and recorded at the Winnebago County
Register of Deeds.
FISCAL IMPACT
None anticipated.
RECOMMENDATION
The Plan Commission approved of this request at its June 7, 2011 meeting.

AVENUE AND THE 800 BLOCK OF W. LINCOLN AVENUE

GENERAL INFORMATION
Petitioner /Owner: Board of Regents — University of Wisconsin Oshkosh
Action Requested:
The University of Wisconsin Oshkosh is requesting the city to accept five easements in relation to
the construction of the new residence hall and pedestrian mall.
Applicable Ordinance Provisions: N/A
Property Location and Type:
The subject site is the location of the new residence hall currently under construction and a section
of Elmwood Avenue which will be converted into a pedestrian mall as approved by the Common
Council. All lands are under ownership of the University of Wisconsin Oshkosh.
Analysis:
Easement 1 — The first easement is an approximately 6 -foot by 165 -foot strip along the west side of
the 600 Block of Elmwood Avenue, in the front of the new residence hall. The easement is needed
to allow the public sidewalk to "jog" onto University property to accommodate proposed short-term
parking stalls along Elmwood Avenue. The current 50 -foot right -of -way of this section of
Elmwood Avenue makes it impossible to provide for the short term parking and public sidewalk
entirely within the right -of -way.
Easement 2 — The second easement request is located at the corner of Elmwood Avenue and
Algoma Boulevard. This is a very sharp corner which currently does not provide enough space in
the right -of -way to provide for a proper wheelchair ramp in the pedestrian street crossing. The
proposed crescent - shaped easement will provide ample space for the city to construct a wheelchair
ramp meeting minimum ADA requirements.
Easement 3 — The Department of Public Works is requesting an easement along W. Lincoln Avenue
to allow construction of public sidewalk on University property. This segment of Lincoln Avenue
is only 42.78 feet wide, making it difficult to provide terrace space and sidewalk entirely within the
right -of -way.
Easements 4 & 5 — These easements are required to allow construction of a cul -de -sac bulb on
Elmwood Avenue, just north of the proposed pedestrian mall. Easements are needed on the east
and west sides of Elmwood Avenue, just south of W. Lincoln Avenue. These easements will allow
for construction of street pavement and public sidewalk on University property.
The Department of Public Works and City Attorney will work with the property owner to have
appropriate easement documents signed and recorded at the Winnebago County Register of Deeds.
RECOMMENDATION /CONDITIONS
Staff recommends approval of the acceptance of the proposed easements as requested.
The Plan Commission approved of the easements as requested. The following is the Plan
Commission's discussion on this item.
Mr. Nau presented the item and reviewed the site and surrounding area as well as explaining the
location and purpose of each easement.
Mr. Bowen arrived at 4:02 pm.
There was no discussion on this item.
Motion by Vajgrt to approve the acceptance of easements at the 600 and 700 block of
Elmwood Avenue and the 800 block of W. Lincoln Avenue as requested.
Seconded by Borsuk. Motion carried 8 -0 -1. (Fojtik abstained as he is employed by the
University and this request has a direct affect on his department.)

Conditional Use Permit Application
Dear Community Development Staff:
On behalf of the UW System Board of Regents and University of Wisconsin — Oshkosh,
we are submitting the following applications and other documentation for the University
of Wisconsin — Oshkosh New Residence Hall Project:

• Easement Application & Documentation
• Check for Easement Fee - $75
On July 13, 2010 the common council conditionally approved a request by the University
of Wisconsin Oshkosh to construct a new five story 165,000 s.f. residence hall at the
above referenced location. At that time, the recommendation by. Planning Department
staff for on -site signage to be regulated as if a C -1: Neighborhood Business District
was rejected. The council requested that signage areas be calculated for the site and
resubmitted for approval.
In addition to the sign approval, an easement will be needed for a portion, of Gity
sidewalk to be relocated partially onto the Campus property. The sidewalk relocation is
necessary to accommodate several short-term parking spaces to be constructed along
Elmwood Avenue at the entrance to the new Residence Hall.
Since all other components of the site have been approved, the documents included in
this submittal focus exclusively on the proposed easement and property signs. Please
refer to the previous submittal for the proposed site development overview description.

Existing Signage on the Property:
The parcel on which the proposed residence hall will be built also contains the Reeve
Union, Albee Hall, and half of the Polk Library. The following sign areas existed on site
prior to the deconstruction of the Breese, Clemans and Nelson Residence Halls in
preparation for this project:

A map showing the locations of these signs has been included in the submittal package.
In addition to the signs listed above, a large granite university sign is currently located on
the parcel at the comer of Algoma Boulevard and Elmwood Avenue. This sign is in the
process of being relocated to a different area on campus and will no longer reside on
this parcel. As a result, its area was not included in calculations for the parcel signage.
Proposed Modifications to Signage:
The proposed development on the site will eliminate two of the existing post & panel
signs. Two signs affixed to the new building will be added and will match the wall -
mounted signs throughout campus. In addition, one sign affixed to a retaining wall along
Algoma Boulevard and two freestanding masonry signs are included in the plans.
Details for these signs have been provided. The University is undecided whether these
signs will be constructed at this time, but would prefer to include them in the proposed
totals for council approval. Revised sign areas for the entire parcel areas follows:
