PLAN COMMISSION STAFF REPORT MAY 03, 2011 ITEM III: CONDITIONAL USE PERMIT FOR A PUBLIC UTILITY STRUCTURE (WET STORM DRAINAGE DETENTION BASIN) EAST OF WE'STHAVEN CIRCLE (SOUTH OF WESTHAVEN GOLF COURSE CLUBHOUSE) GENERAL INFORMATION Applicant: City of Oshkosh- Department of Public Works Property Owner: Westhaven Golf Club Action(s) Requested: The Department of Public Works requests a Conditional Use Permit for construction of a wet storm water detention basin. Applicable Ordinance Provisions: Public utility structures including stormwater detention basins are permitted only through the approval of a conditional use permit within the C -2, General Commercial Zoning District. The Zoning Ordinance establishes criteria and guidelines for establishment and/or amendment of a Conditional Use Permit in Section 30 -11 (D). Property Location and Background Information: The subject site is located on the east side of Westhaven Circle, south of the Westhaven Golf Course clubhouse and parking lot. The area where the basin is proposed to be constructed is currently vacant and undeveloped. The city is not the current owner of the property, but is in negotiations to acquire approximately five acres of the clubhouse property. In December of 2009, the Plan Commission reviewed an official mapping request for this project which was approved by the Common Council in January of 2010. The general area is a mix of single and multiple family residential uses with exception of the golf course and clubhouse to the north and east. The proposed wet detention pond will provide flooding relief in the immediate upstream area (including the Newport Court and Westhaven Circle area) as well as downstream areas. The pond as designed will have the capacity to store approximately 16.6 acre -feet of water. The pond will also allow for the settling of suspended solids and will be able to capture 6,8 tons of sediment from storm water runoff each year, At this time, no landscaping plan has been submitted. However, the plan will be required to meet minimum requirements of the C -2 District and be approved by the Department of Community Development. Staff feels this project is in the best interest of the city and the pond should provide relief to area properties who have historically dealt with flooding issues, Construction of the detention basin is included in the Preliminary 2012 Capital Improvements Program. RECOMMENDATION /CONDITIONS Planning staff recommends approval of the Conditional Use Permit for a wet storm water detention basin as requested with the following conditions: 1. The Department of Public Works have a Certified Survey Map prepared to split off the detention pond area from the clubhouse parent property. 2. Mechanical equipment includes, but is not limited to; FIVAC equipment, electrical transformers and boxes, exhaust flues, plumbing vents, gas regulators, generators, etc. 2 4 Westhaven Clubhouse Area Detention Basin Conditional Use Permit Project Narrative The existing property is vacant land located immediately south of the Westhaven Golf Course Clubhouse at 1 100 South Westhaven Drive. The proposed project will construct a wet detention basin on this vacant land. The wet detention basin will receive runoff from the storm sewers in Westhaven Circle, Maricopa Drive to the south of Westhaven Circle and Westhaven Drive to the south of Westhaven Circle. The runoff will enter the southern side of the detention basin, and will discharge from the northern side of the detention basin. The detention basin will have the capacity to store 16,6 acre -feet of water. The detention basin will serve to slow the release of runoff into the downstream areas. The storm sewer upgrades taking place as a part of this project will serve to get water from the upstream areas to the detention basin in a more efficient manner. By getting water into the detention basin in a more efficient manner, and slowing the release, the impacts of flooding in the areas upstream and downstream of the detention basin will be reduced. The detention basin will also allow for the settling of suspended solids within the detention basin prior to discharging water back into the storm sewer system. It is estimated that the detention basin will remove 6.8 tons per year of sediment from the storm water.
