STEIGER PARK BETWEEN WISCONSIN STREET & VACATED OSCEOLA STREET FROM M -2 CENTRAL INDUSTRIAL TO R -5 MULTIPLE DWELLING WITH A PLANNED DEVELOPMENT OVERLAY INITIATED BY: CITY ADMINISTRATION PLAN COMMISSION RECOMMENDATION: Approved A GENERAL ORDINANCE OF THE CITY OF OSHKOSH AMENDING SECTION 30 -16 (B) OF THE OSHKOSH MUNICIPAL CODE PERTAINING TO ZONING DISTRICTS. The Common Council of the City of Oshkosh do ordain as follows: SECTION 1. That Section 30 -16(B) of the Oshkosh Municipal Code pertaining to Zoning Districts and the map therein described is hereby amended by changing the district character of the following described area from M -2 Central Industrial to R -5 Multiple Dwelling with a Planned Development Overlay. Lots 1, 2, 3, 4, 5, 6 and part of Lot 7, Block P, Western Addition, also part of vacated Hancock and Osceola Streets in Doc. No. 601275 thru Doc. No. 601282, Register of Deeds, all in Block P, Western Addition, all in the 1st Ward, City of Oshkosh, Winnebago County, Wisconsin plus public right -of -way abutting said lots extending to the centerline of Wisconsin St. and vacated Osceola Street. SECTION 2. This Ordinance shall be in full force and effect from and after its passage and publication. SECTION 3. Publication Notice. Steiger Park Between Wisconsin Street and Vacated Osceola Street from M -2 Central Industrial to R -5PD Multiple Dwelling with a Planned Development Overlay (Plan Commission Recommends Approval) BACKGROUND In 1983 the City acquired the former Deltox Rug Company property (7.8 acres) that resulted in the elimination of a number of blighted former manufacturing and warehouse structures and the eventual creation of Carl E. Steiger Park (2.43 acres) along the river. The subject property retained one of the old manufacturing buildings that the City had leased out for a number of years ending in 2007 when the lease ended and the building was demolished in 2008 to provide additional room for the Wisconsin Street Bridge reconstruction. Last August, the City approved of the disposition of the old warehouse site to the University for future development in keeping with the Campus Master Plan. ANALYSIS This action simply updates the zoning for the area making it consistent with the balance of property in the campus area. The PD ensures that all development will be required to obtain Plan Commission and Common Council approval through the Planned Development process. The zoning does not impact the Steiger Park property as park/institutional uses are permitted in all zones. FISCAL IMPACT None anticipated. RECOMMENDATION The Plan Commission approved of this request at its March 15, 2011 meeting. Approved, City Manager ITEM: ZONE CHANGE FROM M -2 CENTRAL INDUSTRIAL DISTRICT TO R -5 PD MULTIPLE DWELLING DISTRICT WITH A PLANNED DEVELOPMENT OVERLAY FOR PROPERTY LOCATED AT 19 WISCONSIN STRE (former Deltox Property) Plan Commission meeting of March 15, 2011 GENERAL INFORMATION Applicant: City of Oshkosh Owner: City of Oshkosh Action(s) Requested: Zone change from M -2 Central Industrial District to R -5 PD Multiple Dwelling District with a Planned Development Overlay. Applicable Ordinance Provisions: The Zoning Ordinance does not establish criteria relative to appropriateness of changing zoning but relies on recommendations of the Comprehensive Plan, redevelopment plans and sound planning principles. The Plan Commission approved of the zone change as requested. The following is the Plan Commission's discussion on this item. Mr. Burich presented the item and reviewed the site and surrounding area. He explained the reasoning for the proposed R -5 PD zoning classification which is consistent with the balance of properties in the area and will ensure that all development will be required to obtain Plan Commission and Common Council approval through the planned development process. Ms. Lohry questioned if the integrity of Carl Steiger Park will be retained and if the property to the north of the park was the only site to be developed in the future. Mr. Burich responded that there would be no change with the status of the park other than changing the zoning from the current manufacturing status to the R -5 PD classification. He further stated that the property to the north of the park had already been sold to the University and any future sale of park land or any portion of it would require approval of the Plan Commission and Common Council, Mr. Thorns inquired if the zoning classification could be changed in the future if deemed necessary. Mr. Burich responded affirmatively and stated that the zone change was a cleanup of inappropriate zoning from past use of the site and referred to the zoning map displaying current zoning classifications for surrounding properties. The M -2 zoning designation is less restrictive and the proposed R -5 PD is more consistent with surrounding uses. The City is being proactive in changing the zoning in advance of any development'and it will be more convenient when the University moves forward with development plans as appropriate zoning will already be in place. Motion by Vajgrt to approve the zone change from M -2 Central Industrial District to R -5 PD Multiple Dwelling District with a Planned Development Overlay for property located at 19 Wisconsin Street. Seconded by Borsuk. Motion carried 9 -0.
