PURPOSE: DECLARE AND APPROVE DISPOSITION OF SURPLUS
PROPERTY AT 1039 -1041 WEST SOUTH PARK AVENUE AND
1043 -1045 WEST SOUTH PARK AVENUE TO HABITAT FOR
HUMANITY OF OSHKOSH RESTORE
INITIATED BY: DEPARTMENT OF PUBLIC WORKS
WHEREAS, the City has purchased residential property located at 1039 -1041 West
South Park Avenue and 1043 -1045 West South Park Avenue in the City of Oshkosh for
demolition; and
WHEREAS, Habitat for Humanity of Oshkosh Restore has requested that its
volunteers be allowed to remove from the property cabinets, windows, fixtures, and any
other salvageable goods for the sole purpose of reuse to be resold in their Restore; and
WHEREAS, the cost to the City to advertise and solicit proposals for removal of the
property, or for the city to remove the property either through the use of city employees or
contractors, exceeds the value of the property to be removed, resulting in the property
having no or a negative value; and
WHEREAS, Section 12 -12(A) of the City of Oshkosh Municipal Code provides that
where property has no apparent value, the City may dispose of such property by any
appropriate means.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of
Oshkosh that pursuant to Section 12 -12(A) of the City of Oshkosh Municipal Code that the
cabinets, windows, fixtures, and any other salvageable goods and remaining personal
property located within the structures is hereby declared to be surplus property with no
apparent value and that the request to remove such property by Habitat for Humanity of
Oshkosh Restore is hereby approved with the following conditions:
1) That Habitat for Humanity of Oshkosh Restore coordinate all activities
to remove salvageable items and secure the property, at Habitat for Humanity of
Oshkosh ReStore's expense, with the Department of Public Works;
2) That before entering the property, Habitat for Humanity of Oshkosh Restore
and all volunteers and /or employees of Habitat for Humanity of Oshkosh
Restore execute appropriate waivers of liability;
3) That Habitat for Humanity of Oshkosh Restore file with the City Clerk a
Certificate of Insurance in the amount of $2,000,000.00 showing City of
Oshkosh as an additional insured.

RE: Disposition of Surplus Property at 1039 -1041 and 1043 -1045 West South Park Avenue
BACKGROUND
In May of 2010, the Common Council approved a relocation order which authorized the purchase of four
properties adjacent to the former solid waste landfill located at Quarry Park. Our consultant (AECOM) has
recommended the purchase of these properties because of the close proximity of the existing buildings to the
landfill materials.
ANALYSIS
On March 22, the Common Council finalized the purchase of two of the properties. These duplexes are located
at 1039 -1041 West South Park Avenue and 1043 -1045 West South Park Avenue. Similar to the previous
Common Council action for property located on Westfield Street, we do not feel that the fixtures in these two
buildings have any value. Habitat for Humanity of Oshkosh Restore has indicated that they would be willing to
salvage material from the two buildings which can be resold at their store.
FISCAL IMPACT
This disposition will reduce the tipping fee expense for the disposal of the demolished buildings at the
Winnebago County Landfill.
RECOMMENDATION
I recommend approval of this disposition of the salvageable material from these properties to Habitat for
Humanity of Oshkosh Restore.
