HomeMy WebLinkAbout11-162MARCH 22, 2011 APRIL 12, 2011 11 -141 11 -162 ORDINANCE FIRST READING SECOND READING (CARRIED 6 -0 LOST LAID OVER WITHDRAWN ) PURPOSE: APPROVAL OF CHANGES IN PERMIT PARKING, LEASED PARKING AND SHORT -TERM PARKING IN THE OTTER EAST AND JEFFERSON PARKING LOTS, AND REVISION OF ALL NIGHT PARKING RESTRICTIONS IN MUNICIPAL PARKING LOTS INITIATED BY: PARKING UTILITY COMMISSION A GENERAL ORDINANCE OF THE CITY OF OSHKOSH AMENDING SECTIONS 27- 23(A -11), 27- 26(A), 27 -48 AND 27 -49 OF THE OSHKOSH MUNICIPAL CODE PERTAINING TO PARKING REGULATIONS ON DESIGNATED STREETS AND ALLEYS, ALL NIGHT PARKING PROHIBITIONS, PERMIT PARKING AREAS AND LEASED PARKING AREAS. The Common Council of the City of Oshkosh do ordain as follows: SECTION 1. That Section 27- 23(A -11) of the Oshkosh Municipal Code pertaining to parking regulations on designated streets and alleys is hereby amended as follows A-11 PARKING REGULATIONS ON DESIGNATED STREETS AND ALLEYS OTTER EAST PARKING LOT Remove Therefrom 90- minute parking, the four (4) most northwesterly stalls, between the hours of 9:00 a.m. and 6:00 p.m. daily, except on Sundays and holidays. Add Thereto 90- minute parking, the four (4) most northern stalls in each row of parking except for those spaces designated as handicapped parking, between the hours of 9:00 a.m. and 6:00 p.m. daily, except on Sundays and holidays. SECTION 2. That Section 27 -26(A) of the Oshkosh Municipal Code pertaining to all night parking prohibitions is hereby repealed and recreated as follows: (A) Regulations No person shall permit any vehicle of any kind or description to be parked on any public highway, or portion of street right -of -way, including but not limited to terraces and sidewalks, in the City of Oshkosh between the hours of 2:00 a.m. and 5:00 a.m. No person shall permit any vehicle of any kind or description to be parked in any free two (2) hour or less parking stall in the following lots between the hours of 2:00 a.m. and 5:00 a.m. MARCH 22, 2011 APRIL 12, 2011 11 -141 11 -162 ORDINANCE FIRST READING SECOND READING CONT'D P -01 —Algoma Lot P -03 — Jefferson Lot P -04 — Grand Lot P -07 — Library Lot P -09 — Otter East Lot P -10 — Otter Lot P -11 — Pearl Lot P -14 — State Street Lot P -15 —Washington Lot P -16 — 400 Block West Lot P -17 — Division Street Lot 9th Avenue Lot SECTION 3. That Section 27 -48(A) of the Oshkosh Municipal Code pertaining to permit parking areas is hereby amended as follows: Remove Therefrom are reserved. (3) Jefferson Lot, the north -south row of stalls on the western side of the eastern driving aisle, north of the northernmost driveway; and the stalls between and including the fifth northernmost and seventh southernmost stalls on the perimeter of the lot bordering Jefferson Street. The remaining stalls on the perimeter of the lot bordering Jefferson Street Remove Therefrom (5) Otter East, excepting therefrom the four most northwesterly stalls. Add Thereto (3) Jefferson Lot, the north -south row of stalls on the western side of the eastern driving aisle, north of the northernmost driveway; and the eleven (11) stalls immediately north and the five (5) stalls immediately south of the northernmost driveway, on the perimeter of the lot bordering Jefferson Street. The northern four (4) stalls and the southern eight (8) stalls on the perimeter of the lot bordering Jefferson Street are reserved. That Section 27 -49(C) of the Oshkosh Municipal Code pertaining to leased parking stalls is hereby amended as follows: Add Thereto (7) Jefferson Lot: the ninth and tenth southernmost stalls on the perimeter of the lot bordering Jefferson Street. Add Thereto (8) Otter East Lot: the ten (10) most southern stalls in each of the four eastern rows of stalls. SECTION 5. This ordinance shall be in full force and effect from and after its passage, publication and placement of the appropriate signage. SECTION 6. Publication Notice. Please take notice that the City of Oshkosh enacted ordinance #11 -162 (A GENERAL ORDINANCE OF THE CITY OF OSHKOSH AMENDING SECTIONS 27- 23(A -11), 27- 26(A), 27 -48 AND 27 -49 OF THE OSHKOSH MUNICIPAL CODE PERTAINING TO PARKING REGULATIONS ON DESIGNATED STREETS AND ALLEYS, ALL NIGHT PARKING PROHIBITIONS, PERMIT PARKING AREAS AND LEASED PARKING AREAS), on April 12, 2011. Winnebago County recently relocated some of its operations to a building on Otter Avenue, across the street from the Otter East parking lot. Although the County has an off - street parking lot available with the building, they are interested in leasing additional spaces to facilitate employee and /or customer parking. Their request includes a mixture of short-term spaces, to serve customers and the general public; and leased parking, to serve employees. The short-term spaces are proposed to be located in the northern end of the lot, closest to the County building (space numbers 2 -4, 25 -27, 29 -32, and 53- 55). The rest of the spaces in the eastern four rows of parking would be designated as leased parking (space numbers 5 -24 and 33 -52). If this proposal is passed, the County or others are free to lease any number of spaces they see fit. Utilization of this lot is relatively low, so that even if the County did choose to lease all of the spaces, there should be adequate capacity in the remaining spaces to handle other parking demand. The proposed lease rate for these spaces would be $20 per month, with no discount for annual purchase or for bulk purchase. This is consistent with most other leased parking in the City. Section 27 -26 of the municipal code prohibits overnight parking from 2 a.m. to 5 a.m. on City streets and street right of way. In addition, the code prohibits parking during these time frames in the short-term (2 hours or less) parking spaces in the following parking lots: • Algoma Lot City of Oshkosh — Department of Transportation Explanation of Parking Changes • Jefferson Lot • Grand Lot • Library Lot • Otter Lot • Pearl Lot • Washington Lot • 400 Block West Lot • Division Street Lot This prohibition facilitates snow removal operations. For consistency, it makes sense to extend this same rule to other municipal parking lots. The parking lots which currently have short-term parking but are not listed in Section 27 -26 are the 9th Avenue, Otter East and State Street lots. (Antoine M Tines, VP Retail Operations, Paper Tiger, 1000 South Lynndale Drive, Appleton, WI 54914) A business has relocated to 408 North Main Street, and is interested in securing a single parking space for use by one or more employees. The lot closest to this business is the Jefferson Lot. The current Jefferson lot parking layout is shown in Figure 1. Last fall, the Common Council voted to convert 15 spaces from permit parking to short-term parking. Staff's recommendation is that two spaces be designated as leased parking at the eastern edge of the lot, specifically spaces 49 and 50. While the business only needs one space, designating a single space for leased parking may generate more user confusion. As 24 -hour spaces, these were likely intended for residents. The proposed spaces would be daytime spaces priced at $20 per month geared toward employees. Parking outside of leased permit hours would be consistent with other permit parking spaces in the lot. Rohloff, City Manager FROM: Christopher Strong, Transportation Director DATE: March 16, 2011 RE: Items Defeated by the Traffic Review Board at their March 8, 2011 Meeting A REQUEST FOR EVANS STREET TO STOP AT ITS INTERSECTION WITH NEVADA AVENUE. (CURRENT CONDITION: YIELD SIGN.) A REQUEST FOR GROVE STREET TO STOP AT ITS INTERSECTION WITH NEVADA AVENUE. (CURRENT CONDITION: YIELD SIGN.) A REQUEST FOR OAK STREET TO STOP AT ITS INTERSECTION WITH NEVADA AVENUE. (CURRENT CONDITION: YIELD SIGN.) These are citizen requests. For each of these intersections, the citizen was concerned that vehicles on the cross - street would go through the yield sign without stopping, therefore being potentially struck by cross - traffic on Nevada Avenue. The citizen believes that stop signs would encourage greater driver compliance, and thereby improve safety. This phenomenon could happen for a couple of reasons: first, if Nevada Avenue volumes are high enough that it is hard for a car on a cross - street to find an acceptable gap; or second, if sight distance is limited, so that a car may not be able to see Nevada Avenue traffic while waiting at a yield sign. Both of these cases align with the existing warrants for stop signs, so these were examined to determine whether any of the intersections meet these warrants. The following warrants are used when considering whether stop signs should be installed on these cross - streets: 1. Three or more right angle accidents in a twelve -month period, or five or more right angle accidents in a 2 -year period. 2. 3,000 or more vehicles per day entering the intersection. 3. A severe sight distance problem. An analysis of these warrants is provided in Table 1, using traffic data collected in 2009 and 2010. As can be seen, the intersections do not meet the warrants for stop sign control.
