The decision of the Board was filed in the Planning Services Office of the Department of Community Development on August 14, 1997. Per Section 30- 6(C)(3) and (4) of the City of Oshkosh Zoning Ordinance, your variance will expire on February 13, 1998 unless you have obtained a permit for the activity allowed by the variance. If you fail to get a permit by this date, you must reapply for a variance if you intend to go ahead with the activity allowed by the variance. Building permits may be obtained from the Inspection Services Division in Room 205 at the Oshkosh City Hall between 8 -9 AM and 1 -2 PM, Monday thru Friday, or call (920) 236 -5050 for an appointment. MONTICELLO DRIVE/WEST POINT SQUARE Byron Murken, representing L & M of Winnebagoland Inc., is requesting a variance to construct a 24'2" high optional identification sign with 100 sq. ft. of sign area, whereas the Ordinance permits 4 ft. high optional identification signs not to exceed 10 sq. ft. in total area. Mr. Byron Murken, 1332 Maricopa Dr., stated the existing sign is not aesthetically pleasing to the overall development of the site. Also traffic coming from the east cannot easily see the sign. Ms. Kepplinger noted the front lot line is further back from the street pavement edge than is normal due to additional right -of -way being reserved for the future widening of Witzel Ave. Motion by Husman to move approval of a variance for a 24'2" high optional identification sign with 100 sq. ft. of sign area. Seconded by Goers. Motion carried 5 -0. Regarding the findings of fact, Mr. Husman felt a hardship exists due to the larger than normal right -of -way creating a larger than normal distance from the lot line to the street pavement edge. The sign height is also required due to placement and height of the buildings in the development. By granting the variances, there is no adverse impact on the neighborhood. There being no further business, the meeting adjourned. • Respectfully submitted, SUSAN KEPPLINGER Principal Planner STAFF REPORT BOARD OF ZONING APPEALS AUGUST 13, 1997 ITEM V: MONTICELLO DRIVE, WEST POINTE SQUARE - L &M of Winnebagoland, Inc., owner /Byron Murken, applicant. GENERAL DESCRIPTION AND BACKGROUND The applicant is requesting a variances needed to install an identification sign having a height of 24'2" and a sign area of 100 square feet, whereas Section 30- 37(2)(e) requires that optional identification signs do not exceed four (4) feet in height and ten (10) square feet in total area. The subject property is zoned C -2 with a Planned District Overlay and can be described as an office park. Highway 41 lies to the west of the property, the areas to the north and east contain residential uses and the area to the s ercial uses. The proposed 10' front yard setback of this sign conforms to setback requirements for this type of sign and therefore no variance is needed for the proposed sign placement. ANALYSIS AND RECOMMENDATION FOR FINDINGS OF FACT In reviewing a variance request, the following questions should be addressed: Is there an unusual or unique characteristic about the subject property which creates a hardship? Is the hardship self- created? Is the variance being requested the least possible needed to remove any hardship? Will granting of the variance have a considerable adverse impact on the neighboring properties? The applicant is proposing to install a new identification sign for this which is taller and with a larger sign face area than the existing identification sign. According to the applicant, the existing sign height and dimension are not sufficient to make the sign effective. Because the current sign is difficult to see, it is not serving the intended function of an identification sign. The proposed 10' distance from the front lot line is consistent with the setback standards for an identification sign. However, it should be noted that the front lot line is significantly further back from the street pavement edge than is normal. This increased distance from the current street pavement edge is due to having additional right of way reserved for future widening of Witzel to accommodate anticipated increased traffic flow. It should be further noted that this front lot line results in increased setback distance from the pavement edge at the west end of this development than exist at the east end of this development. For this reason, motorists approaching the entrance to this development from the east would not readily see an identification sign which conformed to the zoning ordinance requirements. Page Two The face of the proposed identification sign will be 10' above grade, which would not appear to obstruct visibility from a driver safety perspective. It appears that the proposed sign height and sign face area are necessary to permit the identification sign to serve it's intended function in Tight of the larger than normal distance between the pavement edge and the front lot line.
