HomeMy WebLinkAbout11-126MARCH 22, 2011 11 -126 RESOLUTION (CARRIED 7 -0 LOST LAID OVER WITHDRAWN ) PURPOSE: APPROVE LAND PURCHASE AT 1400 SOUTH WESTHAVEN DRIVE FOR THE WESTHAVEN CIRCLE AREA STORMWATER DETENTION BASIN PROJECT INITIATED BY: PUBLIC WORKS DEPARTMENT WHEREAS, on May 25, 2010, by Resolution No. 10 -167, the Common Council previously approved a Relocation Order pursuant to Secs. 62.22 and 32.05 of the Wisconsin Statutes declaring that it was in the public interest for the City of Oshkosh to acquire a portion of 1400 South Westhaven Drive for stormwater detention in the Campbell Creek Drainage Basin; and WHEREAS, the parties have concluded negotiations that include these points of agreement: Purchase price $621,000.00 Real estate taxes shall be prorated through closing. NOW, THEREFORE BE IT RESOLVED by the Common Council of the City of Oshkosh that the proper City officials are authorized and directed to purchase a portion of 1400 South Westhaven Drive as outlined above, and to execute all documents necessary for purpose of same. Patek, Director of Public Works DATE: March 18, 2011 RE: Approve Land Purchase at 1400 South Westhaven Drive for the Westhaven Circle Area Stormwater Detention Basin BACKGROUND On February 22, 2010, the Common Council approved a jurisdictional offer to purchase property adjacent to the Westhaven Golf Course Club House. The City has officially mapped the undeveloped land that is located immediately south of the Club House for construction of a stormwater detention basin. ANALYSIS Our right -of -way consultant has had additional discussions with the property owner. Also, it has been determined that 4.52 acres (from a total parcel area of approximately 8.3 acres) is required for the detention pond facility. The Westhaven Golf Club has agreed to sell their property for $621,000. The following information pertains to this property acquisition: Initial Offer Owner Request Jurisdictional Offer Agreed Upon Price $548,900 $835,950 $610,000 $621,000 FISCAL IMPACT Funding for this acquisition is included in the "Storm Sewer Section" of the 2010 Capital Improvement Program.
