11 -125 RESOLUTION

PURPOSE: APPROVE LAND PURCHASE AT 1039 -1041 WEST SOUTH
PARK AVENUE AND 1043 -1045 WEST SOUTH PARK AVENUE
FOR THE QUARRY PARK LANDFILL GAS VENTING SYSTEM
PROJECT
INITIATED BY: PUBLIC WORKS DEPARTMENT
WHEREAS, on May 25, 2010, by Resolution No. 10 -166, the Common Council
previously approved a Relocation Order pursuant to Secs. 62.22 and 32.05 of the
Wisconsin Statutes declaring that it was in the public interest for the City of Oshkosh to
acquire 1039 -1041 West South Park Avenue and 1043 -1045 West South Park Avenue
for Quarry Park Landfill Gas Venting System; and
WHEREAS, the parties have concluded negotiations that include these points of
agreement:
Purchase price $158,000.00 for 1039 -1041 West South Park Avenue
Purchase price $160,000.00 for 1043 -1045 West South Park Avenue
Real estate taxes shall be prorated through closing.
NOW, THEREFORE BE IT RESOLVED by the Common Council of the City of
Oshkosh that the proper City officials are authorized and directed to purchase 1039-
1041 West South Park Avenue and 1043 -1045 West South Park Avenue as outlined
above, and to execute all documents necessary for purpose of same.
Money for this purpose is appropriated from:

RE: Approve Land Purchases for the Quarry Park Landfill Gas Venting System Project
BACKGROUND
On February 8, 2010, the Common Council approved jurisdictional offers to purchase two properties adjacent to
the former solid waste landfill located at Quarry Park. Our consultant (AECOM) has recommended the
purchase of these properties because of the close proximity of the existing buildings to the landfill materials.
ANALYSIS
Our right -of -way consultant has had additional discussions with the property owners. Mersim and Isabel Mena
have agreed to sell their two properties for $311,768.75 (this amount includes real estate tax proration). The
following information pertains to these property acquisitions:

FISCAL IMPACT
Funding for these acquisitions is included in the "Property Improvement Section" of the 2010 and 2011 Capital

RECOMMENDATION
I recommend approval of the land purchases.
