( 0 Of HKO1H ON THE WATER MEMORANDUM DATE: TO: FROM: RE: BACKGROUND March 17, 2011 Honorable Mayor and Members of the Common Council James E Rabe, Civil Engineer II Wisconsin Department of Natural Resources Municipal Separate Storm Sewer System Annual Report The City of Oshkosh received coverage under the Wisconsin Department of Natural Resources Municipal Separate Storm Sewer System (MS4) General Permit on January 2, 2007. This permit requires the City to comply with the following six minimum control measures (as mandated by the Federal Clean Water Act and the Environmental Protection Agency): 1. Public Information and Education Plan 2. Public Involvement and Participation Program 3. Illicit Discharge Detection and Elimination Program (including new or revised ordinances) 4. Construction Site Pollutant Control Program (including new or revised ordinances) 5. Post - Construction Storm Water Management Program (including new or revised ordinances) 6. Pollution Prevention Program (Prevent pollution from the daily operations of the City) The Storm Water Utility Committee reviewed the Annual Report and recommended approval as discussed during the meeting, at their March 17, 2011 meeting. ANALYSIS The annual report contains information on the activities performed by the City of Oshkosh in compliance with the MS4 Permit requirements. This report includes summary outputs from the City's MS4 Permit Tracking Software (ASIST) and a completed DNR form. City staff has more details available for the DNR, should they be requested. FISCAL IMPACT There is no anticipated fiscal impact from the approval of this resolution. RECOMMENDATION Staff recommends approval of the resolution. An owner or operator of a municipal separate storm sewer system covered by the general permit under Chapter NR 216, Wis. Adm. Code, is required to submit an annual report to the Department of Natural Resources by March 31 of each year to report on activities for the previous calendar year. This form is for reporting on activities undertaken in calendar year 2010. Use of this specific form is optional. The Department of Natural Resources has created this form for the user's convenience and believes that the information requested on this form meets the reporting requirements for an owner or operator of a municipal separate storm sewer system covered by the general permit. Personal information collected will be used for administrative purposes and may be provided to the extent required by Wisconsin's Open Records Law [ss. 19.31- 19.39, Wis. Stats.]. Instructions: Complete each section of the form that follows. If additional space is needed to respond to a question, attach additional pages. Provide descriptions that explain the program actions taken to -date to comply with the general permit. General information a. Describe what efforts the municipality has undertaken to invite the municipal governing body, interest groups, and the general public to review and comment on the annual report. The Annual Report has been posted on the City's Storm Water Utility Webpage, and has been reviewed and approved at public meetings of the Storm Water Utilility Committee and the Common Council. The general public, in addition to members of interest groups and the elected official have the opportunity to comment at any of these meetings, as well as arrange a meeting with the Department of Public Works staff to discuss comments. b. Describe how elected and municipal officials and appropriate staff have been kept apprised of the municipal storm water discharge permit and its requirements. Elected officials are kept apprised of the MS4 Permit and it's requirements through Common Council workshops. Staff are kept apprised during routine conversations and staff meetings when necessary. c. Permit Conditions a. Minimum Control Measures For each of the permit conditions listed below, provide a description of the status of implementation of program elements, the status of meeting measurable goals, and compliance with permit schedule in section 3 of the MS4 general permit. Be specific in describing the actions that have been taken during the reporting year to implement each permit condition and whether measurable goals have been met, including any data collected to document a measurable goal. Also, explain the reasons for any variations from the compliance schedule in the MS4 general permit. As outlined in the City of Oshkosh Citywide Stormwater Management Plan and previous submittals, the City of Oshkosh will not meet the 40% standard by March, 2013. The City of Oshkosh constructed two wet detention basins in 2010 that provide water quality benefits towards this requirement. Based upon WinSLAMM modeling of the detention basins, the two basins combine for 20.1 tons /year of TSS removal. This equates to 1.23% reduction of the City of Oshkosh base load. Has the municipality completed an evaluation of all municipal owned or operated structural flood control facilities to determine the feasibility of retrofitting to increase TSS removal? ® Yes ❑ No If yes, describe: All municipally owned flood control structures currently provide TSS removal to the best level that is possible. c. Provide a fiscal analysis that includes the annual expenditures for 2010, and the budget for 2010 and 2011. A table to document fiscal information is provided on page 6. b. What financing /fiscal strategy has the municipality implemented to finance the requirements of the general permit? ® Storm water utility ❑ General fund ❑ Other c. Are adequate revenues being generated to implement your storm water management program to meet the permit requirements? ® Yes ❑ No Please provide a brief summary of your financing /fiscal strategy and any additional information that will assist the Department in understanding how storm water management funds are being generated to implement and administer your storm water management program. The Storm Water Utility Rate Analysis performed in 2010 recommended a rate increase for 2009. That rate was implemented in April of 2009. That rate held steady through 2010. A Rate Analysis was performed in 2010 and recommended a new rate for 2011. That rate is scheduled to be implemented in April of 2011. SECTION VII. =Inspections and Enforcement Actions Note: If an ordinance listed below has previously been submitted and has not been amended since that time, a copy does not need to be submitted again. If the ordinance was previously submitted, indicate such in the space provided. a. There are no current discharges that would contibute to this pollutant. Lake Butte des Mortes: Listed for Mercury, PCBs, Sediment, and Phosphorus. Mercury is atmospheric deposition, which the City cannot implement a means to reduce. PCBs are no longer used in industrial processes along the river, and thus there are no longer discharges that would contribute to this polluntant. Sediment is being addressed on a City Wide basis, as required by the MS4 Permit. Phosphorus reductions will be associated with the reduction in sediment on a City Wide basis. Phosphorus is being addressed under the I &E plan to get residents to reduce the use of phosphorus. Until such time as a TMDL is prepared for the Upper Fox River Basin, it would be inappropriate to attempt to formulate a plan to reduce phosphorus. Upon investigation, it was found that the rocks along the shoreline, about six inches above the water line, showed evidence of petroleum staining. This discovery caused representatives from the DNR and the City of Oshkosh to begin looking into the possible cause. An inspection of the manholes directly upstream from the storm sewer outfalls in the channel on Nicolet Avenue took place and none of the manholes inspected had petroleum sheen or odor present. A City of Oshkosh Vac -Truck was brought in to remove floating dead vegetation, plastics bottles, tennis balls, etc. from the southern shoreline of the channel. After removing the debris, the sheen could be seen emanating outward from the shoreline into the water. The City of Oshkosh Fire Department Hazardous Materials Team deployed a boom on the water in order to keep the sheen from traveling down the entire channel. The DNR and City of Oshkosh continued to investigate the source of the release by checking the DNR Spills Database for any recently reported spills that might provide insight into the situation. No related incidents were identified. Additionally, officials continued to observe the storm sewer outfalls and manholes in the surrounding neighborhoods. No additional petroleum product has been detected in the storm sewer system since the initial incident. FOLLOW -UP RESPONSE ACTION During a follow -up inspection on April 21, the previously inspected storm sewer lines on Nicolet Avenue (where the outfalls are partially or fully submerged due to lake levels) showed signs of a petroleum sheen and an odor. Manholes upstream of intersection of Harrison St and Packer Avenue still did not have evidence of petroleum. This information led investigators to believe that the petroleum causing the sheen on the water did not originate from the storm sewer system, but rather that the petroleum product migrated into the system over time as the water levels of Lake Winnebago flowed both into and out of the storm sewer system. Public Information Flyer Page t of 2 Lake Winnebago Channel Between Starboard Court and Nicolet Avenue Oshkosh, Wisconsin SUBSEQUENT ACTIONS On April 28, the DNR dispatched its emergency response contractor, Veolia ES, to the channel to remove the original boom and pads placed on the channel. These materials were saturated, and as a result, harboring diesel fuel odors. The contractor was also instructed to place new booms around the location of each storm sewer outfall in order to capture any petroleum which may be in the storm sewer system. A boom was also placed along the stained rocks to capture any petroleum that may sheen off of the rocks from wave action or precipitation. These booms will remain in place until after the next rain event. FUTURE OPTIONS The DNR emergency response contractor, Veolia ES, evaluated clean -up options for the petroleum stained rock and suggested pressure washing the rocks and capturing the petroleum that is washed off with booms, pads, and a surface water skimmers. The DNR is evaluating this option. If approved, this remediation action will take place during the week of May 3. Veolia will also remove any additional oily debris from the channel, if necessary, while they are on -site. These actions will minimize any remaining odors in the area. CURRENT STATUS The DNR and City of Oshkosh will continue to investigate the source of the release, check for illicit discharges from the storm sewer, and clean -up petroleum from the channel. Property owners and tenants in the neighborhood indicated to officials that they first noticed the petroleum sheen and odor on April l O and that there had been a "barge" parked in the southern portion of the channel (near the impacted shoreline) during the winter.
