BE IT RESOLVED by the Common Council of the City of Oshkosh that a
conditional use permit for a canine service facility, including day care, grooming, retail
and transportation services, 1921 South Washburn Street, per the attached, is hereby
approved with the following conditions:
1) Overnight boarding of animals is prohibited.
2) No animal shall be allowed outdoors unless leashed and accompanied by a staff
handler.
3) Immediate removal of any animal waste from the parking areas and green
spaces.

BACKGROUND
The 35,100 square foot (0.81 acre) site is located at the west side of the South Washburn Street
frontage road approximately 600 feet north of West 20`" Avenue. The site is fully improved with an
approximately 9,500 square foot single -story three - tenant commercial strip center and associated 40
stall parking lot. The applicant indicates that they intend to occupy a 3,200 square foot storefront
space and the business will be sharing the strip center with a financial service business and a retail
business. The site also shares a common drive and lot line with a similar strip center adjacent to the
south.
ANALYSIS
The petitioner is proposing to operate a canine service facility with the primary service of dog
grooming and secondary services of dog daycare and transportation services. The facility will include
a supervised indoor daycare area, a small retail store and a grooming suite with hours of operation
from 6:30 am to 7 pm weekdays and 9 am to 3 pm on Saturdays. The applicant anticipates having an
average of 30 -35 dogs in daycare per week and an estimated 30 dogs for grooming per day with a staff
of 4 -6 employees at any given time. The site is currently developed and the petitioner is proposing to
use it as is. The applicant does not include any details of an outdoor play area and has indicated that
all activity will be indoors with the exception of a 525 square foot greenspace in the rear of the
building that will be used as an area for animals at the facility to relieve themselves but will be leashed
and accompanied by a handler at all times. The establishment of an indoor canine service facility in
such close proximity to service and retail businesses may not be ideal, however the almost exclusive
indoor use should address potential issues.
FISCAL IMPACT
None anticipated.
RECOMMENDATION
The Plan Commission approved of this request at its March 15, 2011 meeting.

The applicant is requesting a conditional use permit to establish a canine service facility including
daycare, grooming, retail and transportation services within an existing 3,200 square foot
storefront at a multiple tenant strip center at 1921 South Washburn Street.
Applicable Ordinance Provisions:
Animal care facilities and pet shops are permitted only through conditional use permits in the C -2
General Commercial Zoning District as regulated in Section 30 -25 (A)(11) of the Zoning
Ordinance. Standards imposed on Conditional Use Permits are located in Section 30 -11 (D) of the
"Zoning Ordinance.
Background Information Property Location and Type:

ANALYSIS
The petitioner is proposing to operate a canine service facility with the primary service of dog
daycare and secondary services of professional dog grooming and transportation services
associated with the canine service. Specific details of the uses proposed include a large supervised
indoor daycare area, a small retail store for food and animal supply items and a grooming suite.
Hours of operation are from 6:30 am to 7 pm during the weekdays and 9 am to 3 pm on Saturdays.
The applicant anticipates having an average of 30 -35 dogs in daycare per week and an estimated
30 dogs for grooming per day. A total of 4 -6 employees are anticipated to be on staff at any given
time. Besides the CUP, all regulations related to the boarding and care of animals as well as a
grooming license have or will need to be acquired.
The site is currently fully developed with very little greenspace and the petitioner proposes to use
it as -is. Noise and odor are typically major concerns with animal kenneling and /or daycare use as
they often include outdoor play areas /dog runs. The applicant does not include any details of
outdoor play areas in his application and has indicated to staff (verbally) that all activity will be
indoors. The applicant does depict a small 525 square foot greenspace in the rear of the building
(approximately 15' x 35') that will be used as a dog walk area to allow animals at the facility for
grooming to relieve themselves outdoors but have indicated that all animals would be leashed and
accompanied by a handler at all times when outside. As all proposed activity is to be indoor, staffs
concerns of noise and odor associated with the facility is minimal but as added protection, staff
recommends that the condition that all animals be accompanied by a handler when outdoors as
well as the condition that all waste be immediately cleaned up.
The establishment of an indoor canine service facility on the subject property is not ideal as it is a
tight site with little greenspace and is shared by service and retail businesses, however it is also not
an inappropriate or conflicting use. Potential issues arising from the proximity of an animal care
business to the service and retail uses within the commercial strip center is being proposed to be
addressed by almost exclusive indoor use.
RECOMMENDATION /CONDITIONS
Staff recommends approval of the CUP to operate a canine service facility at the subject property,
with the following conditions:
1. Overnight boarding of animals is prohibited.
2. No animal shall be allowed outdoors unless accompanied by a handler.
3. Immediate removal of any animal waste from the parking areas and greenspaces.
The Plan Commission approved of the conditional use permit as requested with conditions noted.
The following is the Plan Commission's discussion on this item.
Mr. Buck presented the item and reviewed the site and surrounding area as well as the zoning in
said area. He stated that the Comprehensive Plan recommends commercial use for this area and
reviewed the proposed use and site plan. He also discussed the hours of operation, the number of
employees, and services to be provided which would be mainly indoors. He also reviewed the
conditions recommended for the request and commented that the petitioner had indicated that this
site was a temporary location and another location for the business was in the planning process.
Item -1921 S Washburn Dog Daycare CUP
Mr. Borsuk stated that he felt condition #2 relating to animals being allowed outdoors only when
accompanied by a handler should include the word "leashed" as well.
Mr. Thorns questioned if there would be adequate parking for the proposed use and if there were
any traffic concerns or noise issues related to this request.
Mr. Buck replied that the existing parking should be sufficient as retail business was the highest
and most intense use and this type of service usually experiences very low parking necessities. He
further stated that there were no traffic concerns with this use of the site as it is a pre- existing
commercial center. He did not anticipate noise issues as the petitioner indicated that materials had
been installed as sound barriers in the facility.
Bruce Balthazor, 1921 S. Washburn Street, petitioner for the request, stated that he had been in
contact'With tenants in the structure next door and had no complaints of noise issues. He explained
the use of sound barrier materials in the facility and stated that the existing doors had been
replaced with steel doors to mitigate noise issues. He also stated that animal waste is picked up
immediately and all dogs taken outdoors to relieve themselves would be on a leash at all times.
Mr. Thorns inquired about this location being a temporary situation for the business.
Mr. Balthazor responded that another site at the corner of West 20 Avenue and South Washburn
Street was the potential new site and discussed features of the new location.
Ms. Propp voiced her concerns with the small outdoor area on the site and questioned where the
business was previously located.
Mr. Balthazor replied that there would be no more than eight dogs in daycare per day and multiple
dogs would not be going out at any one time which would be for bathroom breaks only and not for
outdoor play purposes. He further commented that they were previously located at 2275 Omro
Road however their lease had come due and they could not afford to remain at this location.
Ms. Lohry questioned when they would be moving into their new location if the conditional use
permit was granted and how animal waste was disposed of.
Mr. Balthazor responded that they were already operating at this location as they were not aware
that a conditional use permit was required and the animal waste was disposed of in a dumpster on
site.
Ms. Lohry then questioned whether the disposal of animal waste in a dumpster met city codes.
Mr. Balthazor replied that it met code standards and the City's Health Department had issued all
the necessary permits and /or licenses required. He also noted that the staff report made reference
to the primary service being dog daycare with the secondary service being grooming whereas it is
actually the opposite with grooming being the majority of their business.
Mr. Thorns commented that he personally used Ruff Cut's services and they did a nice job and
operated a well run facility.

Motion by Borsuk to amend condition 92 to read "No animal shall be allowed outdoors
unless leashed and accompanied by a staff handler ".

The establishment, maintenance, or operation of the proposed conditional use:
1. Will not be detrimental to or endanger the public health, safety, comfort or general welfare.
The proposed use of the property as a canine facility (dog daycare, boarding,
grooming, and retail facility) should not have negative impacts on the area nor endanger the
public health, safety comfort of general welfare. The applicant requires that all dogs be
vaccinated for rabies, parvovirus, distemper and bordetella. The applicant has a thorough
evaluation process for all daycare and boarding dogs and does not accept any that are
dangerous or aggressive. The dogs on the premises will be under control of the adult
handlers at all times.
2. Will not have a negative effect on pedestrians and vehicular circulation and safety.
The proposed location is an existing building and has adequate off - street parking. Clients
pull into the parking lot when dropping off or picking up dogs. The drop off and pick up
times are staggered which does not contribute to additional congestion or generate any
more traffic on public streets. All dogs on the premises will be under control of the adult
handlers at all times and fenced off from pedestrians. The applicant will meet all city
requirements on fencing.
3. Will not contribute to noise or environmental pollution or have a negative effect on air and
water quality.
It is understood that noise may be an issue; however, the proximity of the highway
increases the ambient noise level of the area. To date the applicant has not had a noise
complaint at their Neenah facility as handlers have control of the dogs at all times and
noise levels are strictly monitored. The Neenah facility has no negative effects on the
environment; Oshkosh will be run the same way.
4. Will not affect the demand for and availability of public services and facilities.
The utilities, access roads, and drainage are existing and adequate.
S. Will not affect the character and future development of the area.
The surrounding area is fully developed. The use of the building for a canine facility
(dog daycare, boarding, grooming and retail sales) should have little impact on the area.
Industrial and commercial uses have operated on this property in the past. Planning Staff
would not expect that their use of the existing building would be injurious to the use and
enjoyment of other property in the vicinity nor would it impede the normal or orderly
development and improvement of surrounding property for uses permitted in the district.

The Ruff Cuts Grooming Salon opened its doors April 1, 2008 as a grooming, retail, and daycare for the
fox cities area. Shortly after opening, there was a need for transportation, dog training, and more
holistic food needs. Over the course of the last 3 years we have built a great reputation for intregrity,
health,and safety for our canine facility. We have been recommended by many professionals in the pet
care industry. Through market research, and the construction of high way 21, we realize we needed to
move our location to a more stable area of the city. We also will be building a new facility on 20"' street
later this year.
Dog Daycare Services:
The primary service of Ruff Cuts Grooming and Daycare, is daycare . Through supervision, and a safe
environment we provide a fun way to exercise and keep our clients socialized. We cater to those who
want to keep their dogs healthy and active, as well as those that don't want their dogs to be left alone
for extended hours or don't have the time to always to meet their canines demanding schedule. We use
scratch resistant surfaces of the walls and a sealed concrete floor, windows for our staff for viewing, and
steel doors for sound control and safety. All dogs are screened for temperament prior to admittance, to
limit dogs with any aggression. Should an emergency arise, our staff is trained in pet first aid.
During daycare play, dogs are divided into groups depending on size and energy. While in these play
groups dogs are free to play with each other, play with toys provided, or lounge around soaking in the
attention from our dog handlers. Our daycare play area is equipped with a doggie cam which is seen by
our staff at all times. Daycare is fully heated or air conditioned depending on the season. They play
comfortably in any conditions outside.
Professional Dog Grooming:
Understanding the importance of good canine hygiene is important, our professional groomers cater to
what the clients needs are, and we do what is best for their pet. All our groomers have at least 20 years
experience and have hands on training when we teach new groomers. We use only the best products on
our dogs and cats. We are a "green" grooming salon.
Transportation Services"
Ruff Cuts Grooming Salon understands that not everyone can transport their pets. We will for an added
fee pick up or deliver their pets for them. We also have an emergency number for after hours to be
there for any situation.

Existing Use: The section we are renting is 3200 sq. ft. With one other business operating next to us in
the same building. We moved in to an empty section and do not know what was there before us. Ruff
Cuts Grooming Salon is looking to obtain a conditional Use Permit of operate on the entire section of the
building.
Surrounding Land Use: To the east of us is C -2 an auto repair shop, the North of us is R -1 single family
living, to the West is C -2 is Oshkosh Animal Hospital, and to the South is C -2 storage and strip mall
businesses.
Traffic Generation: The location of 1921S. Washburn is currently a high traffic area. The addition of our
business will not increase traffic nor cause any traffic congestion hazards beyond any surrounding
business currently located on Washburn Street.
Common Concerns Addressed :
Noise:
Noise is typically the largest concern with a facility like ours. To date Ruff Cuts has had no noise
complaints at out Oshkosh location. Our Handlers work hard to maintain a stress free environment . In a
stress free environment dogs not feel the need to bark needlessly and in turn focus their energy on
playing. To help with noise control our handlers engage in games of fetch and we use the outside wall
area for a quieter play area.
Odor:
Odor will not have an effect on the surrounding properties as cleanliness is one of Ruff Cuts highest
priorities. Ruff Cuts maintains a strict cleaning schedule which includes the disposal if waste many times
throughout the day. Ruff Cuts has no complaint or concern with odor at the Oshkosh location.

Fiberglass reinforced panel
Interior play area surfaces are covered with FRP which is scratch resistant will not absorb moisture
and is easily cleaned and sanitized. FRP is made for daycare applications and will last longer than other
wall surfaces on the market.
