GENERAL DESCRIPTION AND BACKGROUND
HGM Architecture, applicant, Oshkosh Housing Authority, owner, requests variances to reconstruct a
parking lot with 5' setbacks; whereas Section 30- 35(B)(1)(c) requires a 19'3" side yard transitional
setback.
The general area is characterized by residential uses, and is zoned R -2 Two Family Residential
District.
ANALYSIS AND RECOMMENDATION
In reviewing a variance request, the following questions should be addressed:
Is there an unusual or unique characteristic about the subject property which
creates a hardship?
Is the hardship self - created?
Is the variance being requested the least possible needed to remove any
hardship?
Will granting of the variance have a considerable adverse impact on the
neighboring properties?
The applicant is requesting variances to reconstruct a parking lot on the east side of the subject
property. The existing lot is only setback from 0' to 2' from the east and south property lines. As
proposed the new lot will be at least 5' off the east and south property lines, and a portion of the
driveway will be about 17' from the east lot line.
It would appear granting the variances would not have a considerable adverse impact on neighboring
properties, but would in fact be an improvement because of the new setbacks being greater than
existing setbacks. Additionally, because of the larger setbacks the parking lot can be screened in
accordance with the applicable regulations which require a fence or evergreen shrub border at least 5'
high to be installed between the parking lot and the abutting residential properties.
Staff recommends approval of the variances as requested with the condition that a 5' high evergreen
shrub border or fence be installed to screen the parking lot and drive.

Please write legibly with black ink and also submit a complete reproducible (maximum size 11" x 17 ") site plan. (A complete site
plan includes, but is not limited to, all structures, lot lines and streets with distances to each.) There is a 525.00 fee for each variance
application. The fee is payable to the City of Oshkosh and due at the time the application is submitted.

In order to be granted a variance, each applicant must be able to prove that an unnecessary hardship would be created if the variance is not
granted. The burden of proving an unnecessary hardship rests upon the applicant. The attached sheet provides information on what
constitutes a hardship. (Attach additional sheets, if necessary, to provide the information requested. Additional information may be
requested as needed.)
1. Explain your proposed plans and why you are requesting a variance: The proposed plan is to renovate the existing
bituminous parking lot on the east property line. Renovation proposes to reconstruct the
drive and reverse direction of the parking lot that will create additional green space between
drive and lot lines. The variance is being requested on these points:

of the parking lot and drive be constructed in setbacks.

Variance requested to construct drives and parking in setbacks will actually increase green spac
from 0 -2' to 5 -17'on the east and increase to 5 -10' on the south line.
3. Describe the special conditions that apply to your lot or structure that do not apply to surrounding lots or structures: The transition
lot requirement /parking lot requirements. As indicated on the site plan, fences and /or hedges
already exist on the ad-jacent east lot lines. To place additional hedges in the newly proposed

4. Describe the hardship that would result if your variance were not granted: The existing parking lot could not be
renovated to create additional green space along the east and south property lines.
