HomeMy WebLinkAbout1970-Letter (court decision) December 11, 1970
Mr. Oscar L. Hildebrandt
227 High Avenue
Oshkosh, Wisconsin 54901
Dear Sir:
On December 3, 1970, the Honorable Arnold J.
Cane, Circuit Judge, ruled that your building at
5 -62 Broad Street was not in danger of collapsing
and is fit for use as presently employed.
His decision went on to state that the City
may require you to paint and repair said shed in
a reasonable fashion so as to permit the continued
use of the premises as a storage shed. Please see
that a Building Permit is secured and repairs are
made to repair this building in a reasonable fash-
ion as brought out in the court proceedings.
We wish to remind you that because this build-
ing is a non - conforming use, the repairs are limited
to a maximum valuation of 1 Since Mr. E. A.
13eibein and Gilbert Pitz both have stated under oath
that they could fix the building; for that amount, it
should be no problem to have those repairs made for
$200 or less.
Also, please be advised that once this building
requires further repairs, it must be replaced with
a conforming use in the R -4 Multiple Family District.
Very truly yours,
Edward Reimer
Building Inspector
