The decision of the Board was filed in the Planning Services Division Office of the Department of Community Development on November 13, 2003. Per Section 30- 6(C)(3) and (4) of the City of Oshkosh Zoning Ordinance, your variance will expire on May 13, 2004 unless you have obtained a permit for the activity allowed by the variance. If you fail to get a permit by this date, you must reapply for a variance if you intend to go ahead with the activity allowed by the variance. Please be advised that any person or persons aggrieved by any decision of the Board of Appeals may commence action in Circuit Court within thirty (30) days after the filing of the decision. Permits may be issued on approval of the Board, but you should be aware that further action could take place until as much as 30 days after the date of the decision. Building permits may be applied for from the Inspection Services Division in Room 205 at the Oshkosh City Hall between 7:30 - 8:30 AM and 12:30 - 1:30 PM, Monday thru Friday, or call (920) 236 -5050 for an appointment. Osen, applicant, and Thomas Witte, owner, are requesting a variance to permit a detached garage to be located in a side yard setback area with a 2.5 foot side yard setback, whereas Section 30- 19(B)(4)(c)(iv) of the City of Oshkosh Zoning Ordinance requires a 7.5 foot side yard setback for detached garages located in a side yard area. The general area is characterized by residential land use and is zoned R -2, Two Family Residence District. The subject property is a single family home. ANALYSIS AND RECOMMENDATION In reviewing a variance request, the following questions should be addressed: Are there any unnecessary hardships present, where in the absence of a variance, no reasonable use can be made of the property? Are there any unusual or unique physical limitations of the property which creates a hardship? Will granting of a variance result in harm to the public interest? The applicant is requesting a variance in conjunction with a small home addition and deck project, to allow for the existing detached garage to remain in its current location, which is 2'6" feet from the side lot line. The Zoning Ordinance regulates detached garages (and their required setbacks) relative to the garage's location in context to the home. The applicant is proposing to construct the addition into the rear yard area, the only available area for expansion, which will result in the garage being located along side the principal structure, in a portion of the side yard area. When a garage is located in a side yard area, a 7'6" side yard setback must be maintained to the side lot line. Rather than pick the garage up and construct a new slab to move the garage behind the addition, the applicant is requesting the garage remain in the current location, with a substandard side yard setback. The subject property is 50+ years old, with the current owner purchasing the property in May of 1989. The property has a detached garage that is in good condition, currently located in the rear yard area, 6'8" behind the home. A physical limitation is established by the location of the garage, which restricts expansion of the home to the east since the side yard setback of the garage cannot be made nonconforming as a result of the construction of the house addition. The location of the detached garage, 60 feet from the front lot line, is the minimum required setback for a detached garage to be built in a typical rear yard area of a property. With the exception of a small portion of the principal structure and deck, which is proposed to be alongside the detached garage, there is no other exterior indication that the garage is any different than any other property where a detached garage is located in a rear yard area.
