PURPOSE: APPROVAL OF CHANGES IN PERMIT PARKING AND LEASED
PARKING IN THE PEARL MUNICIPAL PARKING LOT
INITIATED BY: PARKING UTILITY COMMISSION
A GENERAL ORDINANCE OF THE CITY OF OSHKOSH AMENDING SECTIONS 27 -48
AND 27 -49 OF THE OSHKOSH MUNICIPAL CODE PERTAINING TO PERMIT
PARKING AREAS AND LEASED PARKING AREAS.
The Common Council of the City of Oshkosh do ordain as follows:
SECTION 1. That Section 27 -48 of the Oshkosh Municipal Code pertaining to
permit parking areas is hereby amended as follows:
(A) City -Owned Parking Lots
Remove Therefrom (7) The Pearl Avenue lot, except the easterly row of
stalls.
SECTION 2. That Section 27 -49 of the Oshkosh Municipal Code pertaining to
leased parking areas is hereby amended as follows:
Remove Therefrom (B) Residential Permits Outside the BID District The
following described parking areas are designated
for vehicles with a valid residential parking permit
and holders of such a permit shall be entitled to
lease a designated stall at the rate of Thirty Dollars
($30.00) per month. Enforcement of the residential
parking stalls shall be all days 24 hours.
Remove Therefrom (C) Daytime Permits The following described parking
areas are designated and established as parking
areas to be leased on a monthly basis at the rate of
Twenty Dollars ($20.00) per month. Enforcement of
the monthly parking stalls shall be between 7:00
a.m. and 6:00 p.m. except as otherwise provided
herein.
Remove Therefrom (D) Discounted Daytime Permits The following
described parking areas are designated and

established as parking areas to be leased on a
monthly basis. Each monthly permit shall cost
$20.00 per month, or fraction thereof, for 1 -20
permits purchased. For greater than 20 permits
purchased by a single source, each permit after the
twentieth shall cost $14.00 per month or fraction
thereof. Each annual permit shall cost $210.00 per
year for 1 -20 permits purchased. For greater than
20 permits purchased by a single source, each
permit after the 20 shall cost $150.00 per year.

SECTION 3. This ordinance shall be in full force and effect from and after its
passage, publication and placement of the appropriate signage.
SECTION 4. Publication Notice. Please take notice that the City of Oshkosh
enacted ordinance #11 -XXX (A GENERAL ORDINANCE OF THE CITY OF OSHKOSH
AMENDING SECTIONS 27 -48 AND 27 -49 OF THE OSHKOSH MUNICIPAL CODE
PERTAINING TO PERMIT PARKING AREAS AND LEASED PARKING AREAS), on
February 22, 2011. The ordinance changes permit parking and leased parking areas in
the Pearl Avenue lot. The full text of the ordinance may be obtained at the Office of the

RE: EXPLANATION OF APPROVAL OF CHANGES IN PERMIT PARKING
AND LEASED PARKING IN THE PEARL MUNICIPAL PARKING LOT
The ordinance change includes two items: a change in permit and leased parking in the Pearl
Avenue lot; and technical corrections to the existing ordinance language related to leased parking
rates.
Conversion of Permit Spaces to Leased Spaces in the Pearl Avenue Lot
The requestor owns the building at 217 N Main Street, and is interested in attracting tenants. The
requestor is concerned that there is inadequate employee -type parking, and believes that
switching to leased parking would make it easier to market the property. Leased parking involves
spaces which are assigned to specific individuals for their use. Numerous City lots have leased
spaces, including Algoma, High Avenue, 400 Block West and Division Street. They are
numbered to make it easier to understand where someone is allowed to park.
The current parking lot layout is shown in Figure 1. The requestor sought to convert all of the
lot's spaces, both permit and 90- minute, to leased parking.
There are a couple of issues with this request which staff communicated to the requestor. First,
an earlier Parking Utility Commission agenda item referenced "satellite parking ", where spaces
closest to Main Street tend to be more expensive and available for a shorter duration. The
"satellite parking" concept has not been formally endorsed by the Commission; however, it
should be noted that this proposal may not align with that concept. The second concern is that the
property owner would likely prefer that the spaces be dedicated to the building. However, leased
spaces are available on a first- come - first -serve basis. If the property owner secures the spaces and
pays for them on -time, they can retain those spaces indefinitely.
The property owner has expressed interest in similar ideas for the Ceape and Otter East lots.
These may be introduced as agenda items at future meetings.

The following is from the minutes of the January 12, 2011 Parking Utility Commission meeting,
where this request was discussed.
Mr. Strong explained how the owner of the building at 217 N. Main Street feels this change
would help secure tenants for their building.
Mr. Herman suggested holding off until a subcommittee is formed. Mr. Strong didn't know
how long it would take for the subcommittee to get going.
Mr. Herman asked if this change would conform with the allocation of parking spaces in
other downtown lots. Mr. Strong replied that they are all different.
Mr. Strong noted the owner was thinking the tenants would be office workers, requiring eight
hour parking spots. Ms. Murken noted there is a parking problem for office workers in the
downtown area.
Mr. Strong suggested changing the existing permit parking spaces to leased spaces, while
preserving the existing short -term spaces. This would allow the lot to be used similarly to
how it is used today, but the leased spaces would be available to help the building owner to
secure tenants. Mr. Herman felt this made sense.
Ms. Murken moved to convert spaces 8 -25 and 28 -31 in the Pearl Avenue lot to leased
spaces. Mr. Schuster seconded the motion. Motion carried (3 -0).
2. Leased Parking Fees
The other parts of the ordinance correct language in the ordinance which indicates specific rates
for various types of leased parking. A fee schedule already exists and is referred to by reference
in Section 27- 49(E); the ordinance changes place similar language for Sections 27- 49(B), 27-
49(C) and 27- 49(D). This allows parking fees to be changed by resolution rather than by
ordinance.
