Please be advised that all work outside of the scope for what has been Permitted must cease until plans are approved and the
required Permits are obtained.
An inspection today, revealed areas of work have commenced on your Factory to Yacht Club Conversion project where the Required
Building Permits have not been obtained.
1. Foundations being installed under south and west walls of the remainder of the building
2. Foundation /piers - restoration and or addition of piers under the existing building.
3. Installation of patio, stairs at the north end of the building, retaining wall at west end of patio.
4. Treated plywood crawlspace skirting at the north end of the building.
5. Installation of interior partition walls.
6. Remodeling of the bathrooms, including adding showers and water heater.
7. Installation of North side entry door frame (multiple leaf frame set.)
A Building Permit was issued to Homestead Builders to "button up" the south and west walls opened up when the adjoining sections
of the building were razed to minimize damage from the weather. Homestead was informed a complete Building Permit for the
conversion of this building to the Yacht Club could not / would not be issued until renewed Stamped State Approved Plans were
secured and the required Zoning Review completed. It is my understanding plans have been submitted to both Planning and
Engineering for review and approval.
I also understand your architect is in the process of amending and submitting Building Plans for review and approval. Unfortunately,
some of the work that has been performed to date may not be done correctly. For example:
- the maximum stair risers are 7" and your landscape contractor was not aware of this and installed stairs in excess of this maximum
rise.
- Footings and foundation walls have been installed (possibly without the benefit of your Architect/Engineer's guidance) raising
concerns whether they have been designed properly (not only to support the weight of the building, but also to properly terminate
and mesh in with the rest of the building design (In this venue it was also brought to my attention that piers under the building have
been reconstructed, raising the same concern about design issues.)
- The contractor installing the foundations also indicated you desired to get a jump on an exterior ramp. This too cannot be
constructed without proper plans being approved as there are many design issues that can result in an erroneous installation.
- A quick observation with the bathrooms, the showers do not meet the accessibility requirements (transfer seats or roll in showers,
hand held shower. Also a water heater(s) have been installed without permits.
- The retaining wall west of the patio area appears to be stacked landscape blocks. How are they secured to resist the horizontal
Forces exerted on them by the backfill material or the same force by other uses /conditions at the grade level above?

Conversations with your various contractors indicate all have been hired by you, placing you in the role of General Contractor. As
such you can either require each contractor to secure their own permit and inspections or as is more of the norm, you can obtain the
required Building Permit. However, no further permits can be issued until all necessary approvals are obtained.
Additionally, you have been contacted in the past (8/3/06, 1/31/07, 8/30/07 and most recently this past June 18th) regarding the
change of use for the south and southwest buildings on this site from factory use to vehicle repair and vehicle storage. As previously
discussed, plans must be prepared and submitted for the change of use to the Planning /Zoning Division to review for Zoning
Compliance and this office to review for compliance with the Building Code.
Please be reminded all Building Plans submitted for review for Building Code Compliance must be prepared by a Wisconsin
Registered Architect or Engineer. Please contact Todd Muehrer, Zoning Administrator for Zoning Plan Review submittal
requirements and James Rabe, Engineer for guidance on the Storm Water Drainage/ Management submittal requirements.
Please advise me of your status in the preparation of the necessary plans, securing the necessary reviews /approvals and securing
the required Permits.

The submittal described above has been reviewed for conformance with applicable Wisconsin
Administrative Codes and Wisconsin Statutes. The submittal has been CONDITIONALLY
APPROVED. The owner, as defined in chapter 101.01(10), Wisconsin Statutes, is responsible
for compliance with all code requirements.
The following conditions shall be met during construction or installation and prior to occupancy
or use:

• IBC 705.6 Fire walls shall extend from the foundation to at least 30 inches above the roof on
both sides, unless an exception is met. By telephone this date, designer said foundation of
masonry fire wall is not properly shown on A2.0 section that does not show rated masonry
wall with rated support all the way to foundation below.
• IBC 705.5.1 The exterior wall shall be 1 - hour rated with opening protection provided as
required for 4 feet on each side of the fire wall, unless the angle of intersection is equal to or

exceeds 180 degrees. Rating of wall adjacent and door 11 on one end and window type B on
the other end of the fire wall is not clearly shown.
• IBC 302.1.1.1 /Comm 62.0302 Where Table 302.1.1 requires a fire- resistance -rated
separation, the incidental use area shall be separated from the remainder of the building with
a fire barrier (see IBC 702.1). Laundry room over 100 SF size does not show incidental use
separation, provide information to plans at job site on how you incorporated ratings in your
design to provide protection for that room 103.
• IBC 1003.2.13.7 The wall and any openings within 10 feet in any direction of the exterior
area of assisted rescue shall be a minimum of 1 -hour fire resistive construction with all
openings in this area protected with 3/4 -hour assemblies. This is not clearly shown at doors
100 & 104 and adjacent walls (& maybe windows C & G). Verify size & location of
wheelchair space outside of egress route at exterior landing to exit doors 100 & 104.

• IBC 714.2 Provide fire door and shutter assemblies that have the minimum fire- protective
rating required by Table 714.2. Side - hinged or pivoted swinging doors shall meet the
positive pressure testing requirements of UL 10C or NFPA 252. Schedule does not show
proper rating of any doors and sizes for doors 109 & 110.
• ICC /ANSI A117.1 Section 404.2.4.1 The maneuvering clearances required by this code
section shall be provided at door to accessible stall in women 107, verify this to building
inspector.
• ICC /ANSI A117.1 Section 604.2 The water closet shall be positioned with a wall to the rear
and one side. The centerline of the water closet shall be 16 inches minimum and 18 inches
maximum from the side wall or partition. Accessible stall in Men Shower 102 shall be
verified to meet this requirement.
• ICC /ANSI A117.1 Section 604.8.3 Accessible water closet compartments shall have
compartment door in opposite corner than water closet. Verify to inspector that accessible
toilet compartments in Men 102 is met.
• ICC /ANSI A117.1 Section 608.2.1 Both Men Shower 102 and Women Shower 101 need
accessible shower stall. Accessible shower compartments shall be 36 inches wide by 36
inches deep, with wheelchair clearance space 12" beyond the opening on the side opposite
the controls. Verify this with the building inspector.
• ICC /ANSI A117.1 Section 608.3.1 In transfer -type showers, grab bars shall be provided
across the control wall and on the back wall to a point 18 inches from the control wall.
Verify this with the building inspector.
• IECC 102.5.2 Fenestration U- factors and solar gain heat coefficients (SGHC) for windows
and doors shall use default values shown in Tables 102.5.2(1) and/or 102.5.2(2), unless the
plans or specifications identify the independently tested NFRC values used in the building
envelope calculations. Products installed in the field shall be labeled and certified to verify
these ratings. Verify rating used for this with the building inspector.
• IECC 701 /Comm 63.0701 /Comm 63.1016 When demonstrating building envelope
compliance using COMcheck -EZ, the data used for computational purposes must be shown

as a detail on the plans, be part of the building specifications, or included as a product cut
sheet. Verify to building inspectors that walls and fenestrations meet the values shown or
provide revised COMcheck -EZ to show building still complies as built.
Submit
• Comm 61.30(3) This review does not include heating, ventilating or air conditioning. The
owner should be reminded that HVAC plans, calculations, and appropriate fees are required
to be submitted for review and approval prior to installation. The submitted HVAC plans
shall match the approved building plans. Note as per Comm 2.10 installation of HVAC
without approved plans could result in double fees.
Reminders
• IBC 1003.2.10 Provide exit, exit access doors, and egress stairways with exit signs and
directional exit signs in compliance with this section. Address the need for 90 minute
continued illumination in case of power loss.
• Comm 61.30(3) This review does not include lighting. Comm 63.0001. Prior to installation,
lighting plans and calculations shall be prepared in compliance with the code and properly
signed and sealed. The plans shall be available at the job site as requested by the Department
representative or local official.
A copy of the approved plans, specifications and this letter shall be on -site during construction
and open to inspection by authorized representatives of the Department, which may include local
inspectors. If plan index sheets were submitted in lieu of additional full plan sets, a copy of this
approval letter and index sheet shall be attached to plans that correspond with the copy on file
with the Department. All permits required by the state or the local municipality shall be obtained
prior to commencement of construction /installation/operation.
If this construction project will disturb one or more acres of land, an Erosion Control Notice of
Intent (NOI) shall be filed with the department 7 days prior to any earth disturbing activities. You
will need to either file the NOI and an erosion control plan summary on -line at
www.commerce.wi.gov /sb or submit a completed NOI form and either a plan summary
or complete plan to us, with additional fees, or to the certified municipality.
In granting this approval the Division of Safety & Buildings reserves the right to require changes
or additions should conditions arise making them necessary for code compliance. As per state
statutes 101.12(2), nothing in this review shall relieve the designer of the responsibility for
designing a safe building, structure, or component.

New Rules: Effective April 1, 2007, the Division of Safety & Buildings will be implementing
new erosion control and stormwater rules in ch. Comm 60 for projects begun on or after that

CodeDevelopm.ent.html Included in the rules will be expanded erosion control coverage for all
commercial construction sites regardless of size. Required erosion control submittal information
to us may be done with a planned on -line webtool.
