Alteration plans have been stamped "Construction may proceed ". Three copies are
being returned to you. All items that are required to be changed by this letter
must be corrected before commencing that part of the work. This approval is not
a Building Permit. Necessary city permit must be secured before commencing work.
You are hereby advised that the owner, as defined in Chapter 101.01(i) of the
Wisconsin State Statutes, is responsible for all code requirements not specifically
cited herein. Code requirements are set forth in Chapters 50 thru 64 of the rules
of the Department of Industry, Labor and Human Relations.
The building will be inspected during construction and a final inspection will be
made after completion to insure complete compliance with city and state codes.
The architect, professional engineer, builder or owner shall keep at the building,
as evidence of approval, one set of plans bearing the stamp of approval.
Ind. 64.02, Ind. 64.67 This approval does not include heating and ventilating.
Such plans are required to be submitted and approved prior to installation of
such equipment. Calculations and data shall be included showing how exhaust
hood requirements are being complied with.
This plan approval is for alterations in anticipation of building additions and
further alterations. The State of Wisconsin Department of Industry, Labor and
Human Relations has already approved additions and alteration under priority
plan approval #82 -09- 060 -B. That plan approval included exiting and illumination.

The City of Oshkosh Zoning Ordinance requires off street parking spaces based
on building use and sizes. Your notes on the site plan are based on those
requirements. However, the Zoning Ordinance does not allow the spaces shown
in the required front and side yards along the north, west and south property
lines. In accordance to our past conversation, revised parking information
in accordance to the Zoning Ordinance will be required before a Building Permit
can be issued.
Ind. 55.06 Capacity of building shall not exceed 142 persons.

Dear Mr. Erfurth:
I have recently been discussing with you the remodeling of the
former Happy Joe's located at 320 South Koehler Road, Oshkosh,
Wisconsin, to a Mexi.an style resta rant, which will b: known
as Casa Del Rey. The r- vision, as planed, would not provide enough
on -site parking to conform to the c rrent Oshkosh zonin: code.
However, there is a ontiguous parki g lot of large di ensions
which is available as a parking area for the proposed C.sa Del
Rey restaurant. The a ailability of his additional par ing is
by virtue of an agreement made approximately ten years ago by
all of the parties o ning property al what was then the Welles
shopping plaza. The cu rent owners of the parcels of real estate
in that plaza have s cceeded to the interests of the o iginal
parties to that agreemen .
When I brought the a:reement to you, attention, you had asked
that I demonstrate with a site plan the availability of the .arking
in order to justify .arking sufficie t for all of the urrent
enterprises at the old Welles plaza si•e. Currently the old Welles
building is being used as a bowling alley. The alley has forty -
eight lanes. In additio , there is a the.lter located on the so thside
of the site which has five hundred -eats. The building e are
proposing renting as th:• Casa Del Rey r- staurant will have a.proxi-
mately two thousand tiree hundred sq are feet of food .erving
area.
My understanding of the current Oshkosh zoning code is that there
be four parking spaces for each bowling alley, one parking space
for each one hundred square feet in a restaurant, and one narking

space for five seats in a theater. By this calculation, it
would appear that the necessary parking spaces to meet the current
Oshkosh code in the old Welles plaza site is computed as follows:
1. 48 lanes times 4 = 192
2. 500 seats in theater divided by 5 = 100
3. 2,300 square feet divided by 100
square feet = 23
TOTAL 315
From the drawing which accompanies this letter, you will note
that there are fourteen rows of parking. The parking appears to
be planned at about a sixty degree angle. Accordingly, we have
allowed ten and one -half feet in width for each parking stall
in computing the available parking stalls. From the drawing you
will see that there are eleven rows of thirty -two parking spaces,
one row with twenty -seven parking spaces, and two rows with twenty -
nine parking spaces. Total parking spaces available are four hundred
thirty- seven.
Therefore, you can see there are more than ample parking spaces
to meet the current zoning code.
I would very much appreciate your prompt attention to the resolu-
tion of this problem. If you believe we have now met the requirements
of your zoning code, I would appreciate a letter confirming same.
