Your petition for variance of section ILHR 52.04 (4)(c) 1., 1984 Wisconsin
Administrative Code, Chapters ILHR 50 -64, Building and Heating, Ventilating
and Air Conditioning Code, has been reviewed.
The rule ILHR 52.04 (4)(c) 1. is not the one to be petitioned in that there
are water closets for the disabled provided for each sex in separate toilet
rooms. The canpliance of these compartments with the dimension requirements
of the code is the issue. The code rules to be petitioned are ILHR 52.04
(8)(c) and the referenced Table 52.04 -3.
In your petition you state that the water closet compartments do not comply
because they are 4 feet x 5 feet (48 inches x 60 inches) in size and that our
office advised the owner the compartments cannot receive a "grandfather"
approval because they do not comply with the 1984 DILHR requirements.
Research of our file for this building and of the codes indicates the
following:
1. The first submittal for plan review was April 1981. The project was not
constructed.
2. The project was resubmitted to DILHR in October 1983 and assigned a 1983
plan file number.

3. Code requirements for water closet compartments permitted 48 inches x
57 inches dimensions until January 1, 1984, when the dimensions were
changed to 48 inches x 78 inches.
4. The final building plan conditional approval was granted in May 1984.
Based on this research, we have concluded that the 48 inches x 60 inches
compartments provided for each sex are in compliance with the code in effect
at the time of plan review and no further processing of the petition for
variance is necessary.
The construction of a unisex handicapped accessible toilet room will be viewed
as a building alteration over and above the minimum requirements of the
Wisconsin Administrative, Building and Heating, Ventilating and Air
Conditioning Code. Although the construction is not required by code, it will
need to comply with the minimum requirements of the code.
We will proceed with a full refund of the petition fee to Sornmervil l e
Associates, whose check #12437 we received on May 5, 1992. ! t

Dear Mr. Tilley:
I wanted to confirm with you that the conditions for your approval
on construction of this ShopKo store remodeling have been met.
We have applied directly to Mr. Blasdel of your department for a
variance to allow for a single unisex ADA compliant handicap
accessible toilet. This would be a part from the existing toilet
rooms - adjacent to them.

The hazardous impact lites in all appropriate doors are safety 1-
glazed.
We have removed the gas unit heater from room 142 and specified an
electrical unit.
The security grille covers only the Pharmacy area which, when
closed, is exited by door 128a.
Thank you for your quick and complete response to our review. I
trust that the unisex toilet design will be sufficient for
compliance.

Your April 9 letter and calculations are acceptable, confirming that nineteen
36 inch wide doors will satisfy the exit width required by ILHR 51.15(6) and
using the criteria in the new 1992 Code Commentary, 60 square feet per person
based upon the gross floor area.
Mr.LePage's April 2 letter is not acceptable, seeking approval of the 4 feet
by 5 feet waterc1oset compartments for the handicapped because they were not
cited as nonconforming in the original inspections. My 1984 code indicates
this was nonconforming construction at that time. ILHR 50.03 notes that
nonconforming construction, when discovered, shall be replaced with code com-
plying construction. Therefore, I have stamped your detail sheets Not Approved
and copies are attached to this letter.

Mr. Griese' April 9 fax letter was stamped approved, and I faxed a copy back
to you on April 10, authorizing reducing the number of exit doors to 19, based
upon 60 square feet per person figured on the gross area of the main floor and
mezzanine, as authorized under ILHR 54.05 in the new 1992 Code Commentary.
When deleting existing doors, maintain the distance to an exit as required by
ILHR 54.02 at the main floor and ILHR 54.08 at the mezzanine. The 1/32" per ft
scale sketch indicates these requirements are satisfied.

The plans have been reviewed for compliance with the code requirements set
forth in Chapter ILHR 50-64 of the rules of the department. Construction may
proceed subject to local regulations, but all items that are required to be
changed by this letter must be corrected before commencing that part of the
work.
This plan has not been reviewed for compliance with Chapters ILHR 32 -86, the
plumbing rules of the department.
You are hereby advised that the owner, as defined in s. ILHR 101.01 (2)(e) of
the Wisconsin State Statutes, is responsible for all code requirements not
specifically cited herein.
The building will be inspected during and after construction. The owner
shall notify the state building inspector and the local officials before
taking possession of the building.
ILHR 50.15 EVIDENCE OF APPROVAL. The architect prgfes ' onal engineer,

While application form indicates #6 construction,its 5B in 1984 correspondence
ILHR 52.04 April 2 fax letter states 4x5' toilet compartments for the handi-
capped are existing and requests retaining them. My 1984 code indicates 4x5'
is nonconforming undersized. Compartments meeting the minimum size required by

ILHR 51.14 Hazardous impact lites in doors shall be safety glazed.
ILHR 64.2.1 Gas unit heater can't be hidden by new wall at sprinkler room 142.
It is not clear to me where the pharmacy security grille terminates. If a sim-
ilar grille secures "optical" while the rest of the store is open, ILHR 54.06
requires a standard exit, such as the one being removed at column line 1J -K.
This building is classified as No. 5B, exterior masonry, unprotected construction.
This building is completely sprinklered.
This building qualifies for unlimited area.
