In answering questions from the Board, Mr. Francis explained the
following: They purchased the home as a potential rental property.
The house is 2200 sq. ft. There are two existing stairways that go up
to the second floor and the bathroom is already set up. They only
need to add a kitchen upstairs to make it a duplex. The structure and
the existing setbacks predate the Ordinance. They also own the
property next door.
Motion by Hintz to move approval of variances to convert a single
family structure with a 5' side yard setback to a duplex with an
under- requirement of lot width and lot size. Seconded by Nitkowski.
Motion carried 5 -0.
Regarding the findings of fact, Mr. McGee stated all of the conditions
predate the Ordinance. Granting the variances allows them to increase
the density but not beyond what is permitted. It does not increase
pr - existing infringements.
I II. 1200 S. KOELLER STREET - The Copps Corp., owner/ applicant
The applicant is requesting a variance to install 2 projecting signs;
whereas Section 30- 31(E)(2)(c) of the City of Oshkosh Zoning Ordinance
allows only 1 projecting sign for each premises in a C -2 district.
In answering questions from the Board, Mr. Richard Schwartz of the
Copps Corporation and Jane Borowitz of Orde Advertising, • explained the
following: The problem is caused because of the mansard roof - this
is not really a projecting sign. They are allowed 1700 sq. ft. of
signage and they have only used 280 sq. ft.
Ms. Moore stated that the Livesey Company submitted a letter
supporting the Copp's Corp. request.
Motion by Nitkowski to move approval of a variance to install 2
projecting signs. Seconded by McDonald. Motion carried 5 -0.
Regarding the findings of fact, Ms. Hintz stated the projecting sign
really isn't projecting but because of the mansard type of roof this
variance is needed.
IV. 400 N. SAWYER STREET - Zion Lutheran Church, owner /applicant
The applicant is requesting a variance to construct an accessory
structure with a 50' front yard setback; whereas Section 30-
15(B)(2)(b)(ii) of the City of Oshkosh Zoning Ordinance requires a 60'
minimum front yard setback.
In answering questions from the Board, Reverend Nerenhausen explained
the following: They have provided green landscaping around the
proposed structure to provide adequate screening. They would like the
structure in this area to leave room for volleyball and picnic areas.
There are no homes along this street and the Titan Stadium is across
from this structure. There would be no negative impact on anyone.
