Appeal of Bren Hartinger, agent for Cow's Corp . , owner of the property located at 1200 S Koeller St., proposes to relocate an existing ground sign and requests the following: A 5' front yard setback is proposed; whereas a 25 "front yard setback is required. Ms. Porter stated the appellant proposes to relocate an existing ground sign and is requesting a variance to the front yard setback reguirements. Nr. Bren Hartinger, agent for Copp's Corp., distributed pictures of existing M nard's and McDonald's signs. (Said pictures not made part of these minutes.) Mr. Hartinger indicated the sign for Copp's will be setback about the sa*,a distance. Also, due to gas lines in this area, he pointed out the sign would have to be_ setback 70' to miss there. If the sign were setback that far, it would not be visible. Mc. King inquired hcm wide the area for the gas lines is? Mr. Hartinger replied probably 100' from the lot line to the other side of the gas lines. Mr. King imuired if there is an easalrant prohibiting placing the sign within this area? Mr. Hartinger replied they could not place the sign within this area because of the supports that are used, they would be too close to the mains. He pointed out they can not be any closer than 5', at a mininum, td a gas line. Mr. Coldthwaite in aired if the proposed sign would be in line with the rest of the signs in this area? Mr. Hartinger replied yes. Ibti_on by Dan Goldthwaite to move the appeal. Motion seconded by Jim Tarson. Ebtion approved 5-0. Regarding the findings of fact, Mr. Goldthwaite felt the proposed location is the best place to put the -sign. There will be no hardship to any one else because other signs are setback the same distance in this area. Mrs. Cartwright stated Copp's would have a hardship for identification if the sign would have to be placed on the other side of the gas line. This privilege has also been granted to others in the area. XIV. Appeal of Bob Boeeder, agent for Wallace Wickander, owner of the vacant property located at the northeast corner of W. 9th Ave. and S. Washburn St., proposes to construct a fast food restaurant on a vacant lot and requests the following: (1) Proposes to proviOe parking in the front yard setback; whereas parking is not permitted in designated setback areas. (2) Proposes to locate directional signs, an ID sign, bicycle rack and durpster within the 25' front and /or rear yard setbacks; whereas a 25' front and rear yard setback is required.
