Re: Temporary parking occupancy at 105 N. Sawyer Street
Mr. Daun,
The Planning Division has approved your request to use an area previously graveled
without zoning or building approval as interim employee parking for the Winter 06 and
early Spring 07seasons. The request has been granted due to the immediate need for
parking on the site and the paving exception granted due to the seasonal closure of the
local hot mix asphalt plants. Additional consideration was given to your imminent plans
for development of the north property (( #06- 0794 - 0000), and the fact that the subject
area will be part of a future cross access parking area serving both parcels.
The temporary occupancy is allowed with the following conditions:
1) The subject gravel area be re- constructed per the December 13, 2006
correspondence to Daun Bock LLC from Albright Construction.
2) Access to the area north of the subject area by vehicular traffic is prohibited and
measures taken to prevent this movement from occurring. Per our conversation
on 12/18 you will be installing boulders at approximate 6 -foot intervals to allow
snow storage on the undeveloped property.
3) To prevent sediments from washing off -site due to the proposed snow storage,
the silt fence installed around the perimeter of the site will need to be maintained
per applicable erosion control standards. Those areas that have been knocked
down or driven over need to be corrected immediately.
4) In addition to the boulders installed near the edge of the temporary parking area,
access needs to be restricted to the site from Faust Avenue and Sawyer Street
per Planning Division approved control measures.
5) If the temporary gravel parking base area fails to prevent debris from being
tracked onto the adjacent right -of -way, the area will be immediately fenced to
prohibit parking.
6) The clean up of any and all mud, ice and other debris tracked onto or over the
public right -of -way is the responsibility of the property owners, and shall be
conducted without delay at the property owner's expense.
7) Debris tracked onto adjacent right -of -way not immediately removed by the owner
or agent, will be removed by the City with such costs being billed to the property
owner.
8) Use of the temporary parking area shall cease by May 1, 2006 or within two
weeks of the opening of the local hot mix asphalt plant. Permanent paving of the
temporary parking area will require zoning and building approval.

Hello Mr. Daun,
have performed a cursory review of the e- mailed site plan. Comments are below:
1. I do not see a drive - through proposed /illustrated on the site plan.
2. Setback variance is needed for the dumpsters located completely in the 19' -3" west side transitional yard.
They are located with a 0' setback.
3. Setback variance is needed for the the drive aisle located within the 19' -3" west side transitional yard. It is
located with a 15' -5" setback.
4. Setback variance is needed for the the parking stalls located within the 20' east side /Sawyer Street
setback. They are located with an approx. 9' -6" setback.
5. Widened driveway (turning to a 3 lane) will require an Access Control Variance from the Plan
Commission. Standard 3 lane drive configuration for commercial properties in the City has a 12' wide
ingress lane, a 4' wide rumble strip separation, and two 10' wide egress lanes for a total of 36' wide at the
property line & 46' wide curb -cut.
6. Right turn egress lane is in conflict with Taco John's landscaped island.
7. Stalls abutting traffic internal lane should be curbed and /or separated with a landscape island.
8. Sidewalks to the building should be extended to public walks on Faust and on Sawyer.
9. Parking aisle ends should include landscape islands as site has 20 stalls.
10. If all proposed landscaping is shown on plan, it appears to be deficient.
11. Has area for the location of ground signage been considered? It must be outside of setbacks.
It is important that the development of the northern lot continue in a timely manner as use of the temporary gravel
parking area should have ceased by May 1, 2007 or within two weeks of the opening of the local hot mix plants,
per the temporary parking occupancy at 105 N Sawyer (via letter dated Dec. 18, 2006) and the drives /aprons to
the north lot should have been physically removed, per the Conditional Use Permit for Taco John's Restaurant.
Development of the northern lot (that addresses these issues) must move forward or approval of the expanded
parking area and use of the northern lot must receive conditional use approval by the City Plan Commission and
Common Council.
