HomeMy WebLinkAboutBoard of Zoning Appeals (minutes) - 06/06/1984 BOARD OF ZONING APPEALS MINUTES JUNE 6, 1984 MEETING PAGE SIX Mr. Ehrfurth stated the appellant proposes to construct an accessory building on a corner lot and several variances are required to utilize the existing slab. Mr. Wayne Steinbach, 1303 Congress Avenue, stated the new building will be 8' closer to the sidewalk; the rear and side yards will remain the same. He continued the existing garage is a one car garage and he needs a larger one to store equipment and cars. Mr. Steinbach indicated he would like to utilize the existing slab. Mr. Luebke inquired how far is it from the house to the sidewalk? Mr. Steinbach replied about 15'. He continued the garage will be setback farther than the house. Motion by Dan Goldthwaite to move the variance. Motion seconded by Anne Hintz. Motion approved 5 -0. Regarding the findings of fact, Mrs. Hintz felt that due to the size of the lot, and being that it is a corner lot, a hardship would be present to construct any garage on the lot. She continued the proposed accessory building will be an improvement and no further infringements on two sides are proposed and the Spruce Street side will only be a couple of feet. Mr. King stated the proposed accessory building does not infringe on the front yard setback any farther than the home does. VI. Appeal of David Schettle, agent for Al Robl, owner of the property located at 1854 Simpson Street, proposes to construct a 9'9" x 10'2" addition to the rear of the home and requests the following variance: A 6'4" side yard setback is proposed; whereas a 7 1/2' side yard setback is required. Mr. Ehrfurth stated the appellant proposes to construct an addition to the rear of the principle structure and requires a side yard variance. Mr. David Schettle, agent for Al Robl, owner of the property at 1854 Simpson Street, stated the addition will extend the existing side yard setback of the home. Motion by Elaine Cartwright to move the variance. Motion seconded by Anne Hintz. Motion approved 5 -0. Regarding the findings of fact, Mrs. Hintz stated the existing house pre -dates the Ordinance and a hardship is apparent with any addition to the home. VII. Appeal of Frank Kaul, agent for Richard Pollock, owner of the property located at 1105 Baldwin Street, proposes to demolish an existing accessory building and construct a 22' x 28' accessory building and requests the following variances: (1) A 4' rear yard setback is proposed; whereas a 25' rear yard setback is required. (2) A 22' front yard setback is proposed; whereas a 25' front yard setback is required. (3) Appellant proposes to occupy more than 30% of the rear yard; whereas accessory buildings cannot occupy more than 30% of the rear yard.
