HomeMy WebLinkAbout10-409DECEMBER 28, 2010 10 -409 RESOLUTION (CARRIED 6 -0 LOST LAID OVER WITHDRAWN ) PURPOSE: AMEND SPECIAL ASSESSMENT POLICY RELATIVE TO SUMP PUMP PIPE CONNECTIONS BY PRIVATE PROPERTY OWNERS INITIATED BY: PUBLIC WORKS DEPARTMENT BE IT RESOLVED by the Common Council of the City of Oshkosh that the following amendment to the Policy for Special Assessments is approved: From Page 8, Section V Storm Sewers /Section C — Waiver of Fees/ Item 1: Delete: 1. All fees for plumbing permits necessary for the connection of sump pump drains to the special storm sewers are hereby waived by the City of Oshkosh. Property owners are hereby allowed to make sump pump drain connections to the special storm sewers without the use of a licensed plumber. However, a plumbing permit is required without any fee. If excavation is required to accommodate the connection between the property line and curb, and no pavement is removed, all bonding require- ments by the owner are waived, provided the property owner making the connection recognizes his or her liability on the excavation. Replace with: 1. All fees for plumbing permits necessary for the connection of sump pump drains to existing storm sewer systems, existing storm sewer laterals, and special ( "mini ") storm sewers are hereby waived for the property owner. These plumbing permit fees shall be paid by the City of Oshkosh Stormwater Utility. BE IT FURTHER RESOLVED that these changes shall be effective for all projects beginning on or after the date of passage and publication of this resolution. Patek, Director of Public Works DATE: December 22, 2010 RE: Amend Special Assessment Policy Relative to Sump Pump Pipe Connections by Private Property Owners BACKGROUND The policy currently allows private property owners to connect their sump pump pipes without the use of a licensed plumber and fees for sump pump connections are also waived. This text has been included with the policy since prior to 1993. The intent of this variance was to encourage sump pump connections to the storm sewer system versus the sanitary sewer system. ANALYSIS The State of Wisconsin Department of Commerce has notified the City of Oshkosh Plumbing Inspector that this variance for property owner installation is not allowed per State Statues. Per James H. Miller of the Bureau of Integrated Services, "the law clearly states they (a property owner) can do plumbing "in" the building. They are not allowed to install any plumbing outside of their home unless they are a properly licensed plumber." FISCAL IMPACT The proposed revision to the policy eliminates the allowances for property owner installation but it will not change the waiver of fees to the property owner for plumbing permits necessary for the connection of sump pump piping. The proposed revision to the policy does clarify that these plumbing permit fees will be paid by the Stormwater Utility.
