DECEMBER 28, 2010 10 -406 RESOLUTION (CARRIED 6 -0 LOST LAID OVER WITHDRAWN ) PURPOSE: APPROVE DEDICATION OF STREET RIGHT -OF -WAY FOR KNAPP STREET AT THE KNAPP STREET /POBEREZNY ROAD INTERSECTION INITIATED BY: CITY ADMINISTRATION PLAN COMMISSION RECOMMENDATION: Approved BE IT RESOLVED by the Common Council of the City of Oshkosh that the City hereby accepts right -of -way for Knapp Street and Poberezny Road on the south /south- west side of Knapp Street at the Knapp Street/Poberezny Road intersection, per the attached. A WHKOIH ON THE WATER TO: Honorable Mayor and Members of the Common Council FROM: Darryn Burich Director of Planning Services DATE: December 21, 2010 RE: Approve Dedication of Street Right -of -Way for Knapp Street at the Knapp Street/ Poberezny Road Intersection BACKGROUND Council is being asked to dedicate street right -of -way for Knapp Street and Poberezny Road on the south/southwest side of Knapp Street at the Knapp Street/Poberezny Road intersection to correct a technical error that probably occurred during construction of this intersection in 1975. ANALYSIS Omni Associates discovered a 12 foot gap separating the Knapp Street and Poberezny Road right -of- way while conducting survey work for Wittman Field Airport. The dedication will have no affect on surrounding properties as the land has been used as right -of -way for the last 30+ years. FISCAL IMPACT None anticipated. RECOMMENDATION The Plan Commission approved of this request at its December 21, 2010 meeting. Approved, City Manager ITEM: RIGHT -OF -WAY DEDICATION NEAR THE INTERSECTION OF POBEREZNY ROAD AND KNAPP STREET Plan Commission meeting of December 21, 2010 GENERAL INFORMATION Petitioner: City Administration Owner: Winnebago County Action Requested: The City is requesting a right -of -way dedication of an approximately 12 -foot wide, 0.13 acre strip of land along the western curve of Knapp Street at the Poberezny Road intersection. Applicable Ordinance Provisions: N/A BACKGROUND INFORMATION /ANALYSIS While conducting survey work for Wittman Field Airport, Omnni Associates discovered a discrepancy with the right -of -way descriptions of Knapp Street and /or Poberezny Road. After a thorough investigation of legal documents and construction plats, Omnni determined that an approximate 12 -foot gap separates the rights -of -way of the streets, technically making them disconnected (see attached map). The error most likely occurred during the platting and construction of Poberezny Road in 1975. Omnni informed the City of the discrepancy and suggested that a Certified Survey Map be created to dedicate the non- dedicated portion of right -of -way. All lands surrounding the intersection are owned by Winnebago County but are located within the Oshkosh municipal boundary, requiring the City to make and accept the dedication request. This dedication request will have no effect on the surrounding properties as the land has been used as right - of -way for the last 30+ years. Staff has no concerns with this dedication as it is a cleanup of the original right -of -way descriptions. RECOMMENDATION /CONDITION S Staff recommends approval of the right -of -way dedication as requested. The Plan Commission approved of the street dedication as requested. The following is the Plan Commission's discussion on this item. There was no discussion on this item. Motion by Thoms to approve the consent agenda. Seconded by Hinz. Motion carried 9 -0.
